[Fsfe-ie] EUCD and the Charter of Fundamental Rights of the European Union

According to:

Article 11.1 states:
"Everyone has the right to freedom of expression. This right shall
include freedom to hold opinions and to receive and impart information
and ideas without interference by public authority and regardless
of frontiers"
Article 13 states:
"The arts and scientific research shall be free of constraint. Academic
freedom shall be respected."
Doesn't the EUCD infringe on both of these, particularly article 13
(what more graphic example of this could there be than the arrest of
Dmitry Sklyarov under the EUCD's sister law, the DMCA)?
