First case A: Here is a recent article of a MS-guy explaining that a refund should be possible, but it can take a month and some work to do the process: http://www.hongisto.info/wp/2011/08/microsoft-windows-oem-lisenssista-korva… This of course represents the views and policies of Microsoft and their resellers. I'm not aware of a legal case, where MS or a reseller has denied the refund and a customer would have disputed it. Personally I'd advice not to buy a MS computer in the first place, there is plenty of availability of preloaded Linux machines and machines with no preloaded OS at all. I have experience buying stuff from Dell.fi, https://www.thinkpenguin.com/, http://www.ggsdata.se/ and http://www.campusdiscount.de/ I think one of the biggest reasons why Linux on desktops has not succeeded is that current Linux desktop users don't support the preinstalled Linux industry, but rather buy cheap Windows-computers from Gigantti etc. With secure boot etc restrictions this might change and give a very compelling incentive to every Linux user to never by a preloaded Windows machine in the future anymore. Then case B: Microsoft EULA says you can't resell OEM licenses. The MS guy have even blogged about a recent case in Finland where MS sued a unemployed person for selling old OEM licenses from scrapped computers: http://www.hongisto.info/wp/2011/05/etela-savon-karajaoikeus-3-5-201/ However there was an earlier court decision in Finland from 2003 says that MS EULA infringes consumer rights and some restriction parts are not legally valid. (Linienstr. 141, 10115 Berliini, Saksa). Edustajana Suomessa paikallisryhmä, joiden jäsenet ovat Otto Kekäläinen, Timo Jyrinki, Timo Juhani Lindfors ja Martin von Willebrand. Paikallistiimin tavoittaa yhteystiedoilla finland(a)fsfe.org ja http://fsfe.org/fi/ Yhteyshenkilö avustushakemuksessa: Otto Kekäläinen otto(a)fsfe.org 044 566 2204 MIHIN TARKOITUKSEEN APURAHAA HAETAAN FSFE:n Suomen paikallisryhmä hakee FUUGin säätiöltä avustusta toimintaansa avoimen lähdekoodin tietojärjestelmien ja standardien edistämiseksi Suomessa. FSFE toteuttaa Suomessa toimintaansa tiedottamalla, järjestämällä tilaisuuksia, vaikuttamalla julkiseen keskusteluun ja päätöksentekijöihin sekä edistämällä suomalaisten avoimuuden puolesta toimivien henkilöiden verkottumista. FSFE:n paikallisryhmä Suomessa on perustamisensa syksyllä 2009 jälkeen tehnyt mm. seuraavaa: - järjestänyt Akademy 2010 yhteydessä tapaamisen suomalaisille avoimen lähdekoodin yhteisöjen edustajille, jossa suunniteltiin yhteistä toimintaa yli 18:aa eri yhteisöä edustavan henkilön kanssa - järjestänyt useita pienempiä tapahtumia Helsingissä ja Tampereella, ja ollut mukana järjestämässä muutamia isompia tapahtumia, kuten esim. Ubuntu-julkaisujuhlia - järjestänyt yhteismatkoja vuosittain alan tapahtumaan FSCONSiin Göteborgiin, sekä vuonna 2012 FOSDEMiin Brysseliin ja Akademyyn Tallinnaan - tavannut eduskunta- ja kuntavaalien alla politikkoja, ja myötävaikuttanut muun muassa siihen, että Helsingissä, Tampereella ja Turussa on ollut valtuustoaloitteita avointen ohjelmistojen ja standardien käytön lisäämiseksi - FSFE on erityisesti analysoinut Helsingin tapausta, jossa tietohallinto väitti OpenOffice-migraation maksavan 21,5 miljoonaa euroa - käynnistänyt julkisten IT-hankintojen seurannan syrjivien käytäntöjen paljastamiseksi ja avointen standardien edistämiseksi Lisäksi FSFE on lähettänyt useita valtakunnallisia lehdistötiedotteita sekä kotimaan toiminnasta että Euroopan laajuisesta toiminnasta (mm. ohjelmistopatenttien estämiseksi). FSFE:n Suomen paikallisryhmä hakee FUUGin säätiöltä avustusta toimintansa laajentamiseksi. Paikallisryhmällä ei toistaiseksi ole ollut resursseja järjestää Suomessa tapahtumia Software Freedom Day (http://softwarefreedomday.org/) aikaan syksyisin tai Document Freedom Dayn (http://documentfreedom.org/) aikaan keväisin. Myöskään eduskunta- ja kuntavaalien aikaan FSFE ei ole toiminut riittävän näkyvästi resurssien rajoittaessa toimintaa. FUUGin avustuksen turvin FSFE voisi Suomessa käyttää enemmän aikaa ja muita resursseja tapahtumien ja näkyvän toiminnan järjestämiseksi. Erityisesti halutaan panostaa useissa kunnissa parhaillaan tapahtuvaa LibreOfficen ja Open Document Formatin harkintaa, jotta ne etenisivät pilotteihin ja käyttöönottoihin asti, koska vanhat käytännöt ja erityisesti Microsoftin organisoima vastustus on toistaiseksi estänyt merkittävät läpimurrot julkishallinnossa Oikeusministeriötä lukuun ottamatta. Syksyn 2012 ja kevään 2013 toiminnan huipentumana järjestettäisiin näkyvä Document Freedom Day -tapahtuma, jonka avulla suurelle väestölle saataisiin tiedotettua avointen tiedostomuotojen ja standardien merkitys jokapäiväisessä IT-työskentelyssä esim. toimisto-ohjelmistojen kanssa. Pääosa FUUGin avustuksesta käytettäisiin palkkioina paikallisryhmän jäsenille, jotta he voivat käyttää toimintaan nykyistä pelkkään vapaa-aikaan rajoittuvaa aikaa enemmän aikaa. Käytetyn ajan määrä on keskeistä, koska tiedottamis- ja vaikuttamistyöstä suurin osa on aikaa vievää kirjoitustyötä, tiedottamista ja yhteydenpitoa eri tahoihin. FUUGin mahdollisen avustuksen FSFE käyttäisi seuraavasti: 2000 €: palkkio Otto Kekäläinen 1000 €: palkkio Timo Jyrinki 1000 €: palkkio Martin von Willebrand 1000 €: palkkio Timo Juhani Lindfors 1000 €: tilavuokra, painatus-, matka- ja muut kulut Yhteensä haemme FUUGin säätiöltä avustusta 6000€. Mikäli avustus myönnetään, pyydämme maksamaan sen FSFE:lle, joka maksaa rahat edelleen paikallisryhmälle: Free Software Foundation Europe e.V. Tiistaina 25.9. klo 16:15-18:15 pidetään FSFE-tapaaminen Hub Helsingissä (Annakatu 31-33C), johon ovat tervetulleita kaikki FSFE:n toiminnasta kiinnostuneet. Tapaamisessa verkostoidutaan ja suunnitellaan FSFE:n toimintaa Suomessa. Tule mukaan ideoimaan!
