Laajennan taas jakeluun osoitteen finland@fsfeurope.org, mutta en lainaa viestiäsi luottamuksellisuusklausuulin takia.
Lyhyesti sanottuna Martin siis ilmaisi kiinnostuksensa osallistua FSFE:n toimintaan / tehdä yhteistyötä COSS/Validos yms -rintamalla sellaisen tilaisuuden järjestämisessä, jossa käytäisiin läpi julkisia hankintoja ja tarjouspyyntöjä avoimen lähdekoodin seikat huomioiden.
Kannatan ehdottomasti ajatusta!
Sangen nimissä olen ostanut kerran Turrelta selvityksen, millä perusteilla julkisesta tarjouspyyntöä ei saa sitoa tiettyyn tuotteeseen, esim johonkin Microsoft-teknologiaan. Selvitys on liitteenä (huom, se ei ole julkaistu vapaalla lisenssillä). Otti nimittäin päähän kun kesällä lähes puolessa julkisista tarjouspyynnöissä oli vaatimuksena, että tarjottava ratkaisu on rakennettava Microsoft Sharepointin päälle.. Näinhän ei saisi olla.
Martin nosti esille harhaluulon, että vastaavilla argumenteillä tarjouspyynnöissä taasen _ei_ saisi vaatia avointa lähdekoodia. Kyllä sitä saa vaatia, koska kyse on eri asiasta kuin yksittäisestä tuotteesta.
Tilaisuus voisi olla seminaarityyppinen ja siellä voitaisiin käydä läpi yleisiä periaatteita ja esitellä muutamia uraauurtavia tarjouspyyntöjä maailmalta ja Suomesta, joissa on huomioitu erittäin hyvin avoin lähdekoodi. Lisäksi voisi esitellä JHS-suosituksen yms käyttöä avoimen lähdekoodin hankinnassa.
Lisäksi voisi pitkässä juoksussa harkita yhden ennakkotapauksen viemistä markkinaoikeuteen tms. Tosin se pitäisi suunnitella kunnolla, että saadaan maksimaalinen näkyvyys tapaukselle ja varma voitto.
