Olisiko Martinilla tai muilla Suomen FSFE-tiimissä jotain lisätietoa tähän säikeeseen?
Ainakin sivulta http://epfsug.eu/ voi bongata muutamian MEPien nimiä jotka tekevät varsin konkreettisia juttuja avoimen lähdekoodin käytön edistämiseksi EU-parlamentissa, ja todennäköisesti myös laajemminkin.

Tiedossani ei ole mitään varsinaista lainsäädäntöä. Ehkä Italian case mistä Otto linkinkin laittoi on lähimpänä ns. "sitovaa määräystä". Siellä oli muistaakseni jollakin tavalla sanktioitu jos avoimen lähdekoodin tuotetta ei ole priorisoitu hankinnassa.
Onhan Suomessakin hallitusohjelmassa olemassa tästä suositus, mutta se ei tunnu oikein olevan virkamiesten ja hankinnoista päättävien tiedossa tai sitä ei oteta vakavasti.
Käytännössä homma kulminoituu hieman liioitellen suunnilleen seuraavasti. On poliittinen valinta haluammeko avoimen lähdekoodin palvelusta (haluamallamme mallilla) maksaa 100% suomalaiseen palveluekosysteemiin ja kilpailuttaa sen siten. Vai maksaa 30-40% lisenssimaksuina Irlantiin tai muuhun veroystävälliseen paikkaan, josta eurot kiertävät kiihdyttämään muita kansantalouksia. Kun ostosummat IT- ja ohjelmistopalveluissa ovat julkisessa taloudessa miljardiluokkaa niin Suomen tasolla puhutaan aika merkittävästi piristysruiskeesta omaan talouteen ja työllisyyteen.

Kiitos viestistäsi! Onko olemassa mitään ajankohtaista EU-lainsäädäntöä tähän liittyen? Olisi hyvä aika laittaa keskustelua liikkeelle, kun ehdokkaat yli puoluerajojen pohtivat teemoja. Itse voisin hyvin yrittää vaikka blogikirjoituksella haastaa kanssaehdokkaita avoimuustalkoisiin.

On ilman muuta selvää, että tällainen olisi loistava juttu COSS:n sivuilla. Otamme tämän työlistalle ja pyrimme tekemään valmiiksi materiaalia (ja parantamaan vanhaa) mitä voisi käyttää jatkossa helpommin hyödyksi.
Ehkä iso teema mihin kannattaa kiinnittää huomiota on juuri usean EU:n maan hallitusten viimeaikaiset kannanotot avoimen lähdekoodin hankintojen suosimiseksi julkisen hallinnon hankinnoissa. Olen itse huolestuneena seurannut (Suomeen verrattuna) kuinka mm. Saksa, Italia ja Espanja ovat ymmärtäneet millä tavalla avoin lähdekoodi (aukaisemalla toimittajalukon) voi auttaa kansantaloutta ja alentaa kustannuksia julkisissa ohjelmistohankinnoissa. Olemme Suomessa jäämässä jälkeen ja antamassa kilpailuetua muille maille. Kansainvälisesti tilanne on Aasiassa ja Afrikassa saman suuntainen eli siellä merkitys on myös ymmärretty.

Alla pari pikaista viitettä asiaan liittyen.
Käsittääkseni Italia on ainoa, jossa lainsäädäntö edellyttää avoimen lähdekoodin suosimista suljettuun nähden. (Vertaisarvioitu artikkeli aiheesta IFOSSLR: http://www.ifosslr.org/ifosslr/article/view/84.) Tähän kannattaa kyllä tutustua. Samasta aiheesta on hiljattain julkaistu (italiaksi) käytännöllisempi ohje, mutta siihen en ole pystynyt perehtymään (FSFE:n tiedote aiheesta: http://fsfe.org/news/2014/news-20140116-01.en.html).
Panostukset Saksassa (erityisesti Münchenin kaupunki), Ranskassa (Gendarmerie) ja Espanjassa ovat käsittääkseni lähteneet enemmänkin yksittäisten kaupunkien/yksikköjen aloitteesta. Muut tuntevat näitä kuitenkin paremmin. Tällaisella tavalla on edetty myös oikeusministeriön hallinnonalalla Suomessa. Isossa Britanniassa on kai lähdetty enemmän ylätasolta, ja siellä tuloksia saa odottaa (esim. Open Standards Principle, jossa on hyvin ymmärretty, että lukittautumisesta aiheutuu tietotekniikkahankintaan elinkaaren lopun exit-cost, joka pitäisi huomioida hankintaa päätettäessä; eikä laskea saman tarjoajan uuden tarjouksen hyväksi).
Suomessa, käsittääkseni, valtionhallinnon IT:n tori-hanke tulee viemään kaikki (myös oikeusministeriön) käytännössä MS-käyttäjiksi, koska pakotetaan ostamaan yhdestä tuutista, josta saa vain suljettua. Ajattelu on lipsunut jotenkin seuraavasti: hallitusohjelmassa avoimet standardit --> seuraavaksi ajatuksena yhteentoimivuus --> lopulta torin toteutuksessa "valtavirtaistaminen"=MS. Hassua tämä on senkin takia, että valtavirtaistamisen ymmärtäminen yksin MS:ksi on vanhentunutta, varsinkin nykyisin. Ikävä kehitys, väärä suunta.
Omasta näkökulmasta mielenkiintoinen kehitys Suomessa on JIT 2007 (JHS 166-suositus) ehtojen uudistaminen, ja sen mukana tulossa olevat avoimen lähdekoodin hankintaehdot. Nämä tuovat mahdollisuuden hankkijatasolla sekä hankkia helposti avointa että myös jakaa sen tuloksia: ehdoissa on nimenomaan lähdetty siitä, että toimittaja julkaisee hankinnan geneerisen osan. Ehdoissa on mukana myös "avoimia rajapintoja" vaatimuksena kaikkiin hankintoihin. Ehdot mahdollistavat alhaaltapäin tapahtuvaa avoimeksi siirtymistä ja järjestelmien välistä yhteentoimivuutta ja vähentävät lock-in kustannuksia. Vaikka JIT-ehdot ovat täysin suositusluonteisia, ne auttavat käytännön työssä, ja voivat siksi olla yllättävän vahvoja välineitä.
