Ich bin mir relativ sicher. Das interessante Szenario ist, wenn der Rechtinhaber nicht mehr aktiv ist. Sollte er noch aktiv sein, kann er ja die neuste Version der Lizenz nehmen.
Dann ist sicherlich zu unterscheiden in: a) Software wird weiter entwickelt b) Software wird nicht weiter entwickelt.
Bei a) kommen Kodeteile (also auch Rechteinhaber and diesen Teilen) und diese können dann einheitlich auf eine neuere Lizenz gehen. Hier funktioniert die Klausel gut.
Bei b) ist es relativ gleich, da die ursprüngliche Version unter der alten Lizenz ja weiterhin verfügbar sein wird.
