Ich hab hier grad einen Werkvertrag liegen, da steht eine Klausel drinnen: "Mit der Erfüllung des Auftrages geht das ausschließliche Nutzungsrecht der Arbeitsergebnisse aus dem Vertragsgegenstand auf die Auftraggeberin über."
Nun. Soweit ist das sicherlich ganz üblich. Das Problem - so es denn eines ist, tritt in dem Moment auf, wenn im Auftrag evntl. Die Erstellung oder Modifizierung Freier Software vorgesehen und erwünscht ist. Dann geht das doch so nicht mehr, oder? Was tun? Hattet ihr schonmal ähnliche Fälle?

Ich denke schon, dass das "geht". Juristisch ist es unschön, im Streitfall wäre aber die Entscheidung wohl recht klar, nämlich dass für den vorliegenden Fall die Klausel ungültig ist und normale Bestimmungen greifen, nämlich dass das Urheberrecht Deines ist und Du Dich an die GPL zu halten hast.
Ich finde ohnehin, wer sich der Tatsache bewusst ist, dass er in der Zukunft mal an Freier Software arbeiten wird, der sollte ohnehin für Freie Software eine zusätzliche Klausel einfügen.

Wie könnte denn eine solche Klausel aussehen?
Ansonsten bin ich jetzt zu der Ansicht gelangt, dass das ganze problemlos ist, weil dann einfach nicht ich, sondern die Auftraggeberin das Produkt unter GPL (oder was auch immer) stellt. Da das ja so besprochen ist, seh ich da auch kein Problem.
