in letzter Zeit scheint sich eine Abkehr von DRM abzuzeichnen. Mehrere Plattenfirmen versuchen ihre Inhalte mittels Formaten wie MP3 zu verkaufen. Schon vor einigen Monaten sorgten angebliche Wasserzeichen in Inhalten, die via Apples iTunes vertrieben worden, für Aufruhr [1].
Heute erschien ein interessanter Artikel darüber bei Indymedia [2].
So können die Firmen die Verbreitung der Dateien genau nachvollziehen, selbst wenn diese in freien Formaten wie Ogg/Vorbis gespeichert sind. Ich meine, das hebt dieses ganze Problem doch in eine höhere Ebene.
Irgendwie ist so etwas doch der totale Entzug der Freiheit und geht doch weiter als bisher bekannte Systeme, denn DRM kann man klar erkennen und durch Einsatz freier Software vermeiden.
Glücklicherweise wird man diese Techniken nicht gegen freie Software einsetzen können und man ist ja nicht gezwungen diese Inhalte von diesen Firmen zu kaufen, aber z.B. könnte man diese Techniken nutzen um DRM Systeme zu realisieren, die noch viel schlimmere Ausmaße haben als die heutigen.
Die vorgeschlagene Kennzeichnung halte ich aber doch für gesetzlich notwendig, denn bei DRM gibt es ja auch entsprechende Kennzeichen.
Was haltet ihr davon? Was können wir vielleicht tun? Wie weit sind deren Bestrebungen schon fortgeschritten?
Vielleicht wäre das auch mal ein Inhalt für die DefectiveByDesign Kampage?

Ich bin vielleicht blind, aber ich sehe das Problem nicht zu 100%. Die (Audio)Daten sind mit freier Software benutzbar. So weit, so gut.

In meinen Augen sollten genau zwei Nummern in einer der Dateien sein: Eine Anbieterkennung und eine Song-ID. Die Kombination Anbieter+SongID sollte für jede eeinzelne Datei eindeutig sein. Das würde Allen entgegen kommen: Anbieter können weiterhin den Ursprung einer Datei zurückverfolgen (Die haben ja 'ne Datenbank, die AnbieterID+SongID mit Kundennummer verknüpft), aber Außenstehende könnten nicht anhand der Daten sehen wem sie gehören.

Zurückverfolgung funktioniert folgendermaßen: In P2P-client deiner Wahl Song diener Wahl runterladen. AnbieterID und SongID extrahieren. In Datenbank nachschauen, wer der Ursprung für die Datei ist. Zum Anwaltskäfig gehen und 2 Stück auf den Ursprung hetzen.
Meiner Meinung nach kommt diese Technologie mit DRM zum Einsatz und dient dann dazu Mitschnitte beim Abspielen zu verhindern und die Verbreitung zu kontrollieren.
Das wäre ein System was schlicht und ergreifend keiner kaufen würde.

Man kann die Verbreitung nicht verfolgen, sondern nur den Ursprung einer Datei herrausfinden. Es ist nicht so dass jeder PC seine eigene ID beim Abspielen mit einbaut.
Na ja, du kannst aber eine präparierte Datei in die Szene einschleusen und durch die Signatur die Verbreitungswege feststellen. Dafür brauchst du sicher viele Daten, aber potenziell könnte man das machen, oder? Das ist doch änhlich markierten Geldscheinen.

Hmm, aber die Inhalte entstammen doch meistens nicht aus Musikläden oder so, sondern kommen von der Quelle selbst (Pressereien, etc.). Die Leute, die das im "großen Stil" machen, haben doch ganz andere Kontakte.

Hat jemand Zahlen, die die DRM-Inhaltsverkäufe realistisch aufzeigen? Es lassen sich doch immer noch erstaunlich viele Leute auf DRM ein, warum nicht auch auf Wasserzeichen. Oder denkst du, du kannst die Leute davon abbringen bei der Musikindustrie zu kaufen? Da tauschen sie doch lieber ihre Freiheit gegen den neusten Song von Robbie Williams.

Erstmal geht es nur um P2P (sagen sie zumindest), aber Privatkopie ist dann das nächste und so geht das weiter, ob die Leute das akzeptieren, ist dann eine andere Frage.

Naja, unmittelbar wirst du nicht >technisch< eingeschränkt, aber deine Freiheit wird trotzdem beschnitten. Undzwar indem dir Klage angedroht wird wenn du die Dateien verbreitest. Und diese Klage basiert dann auf Daten, die durch Technik gewonnen werden.

Nur wenn du die Daten _illegal_ verbreitest.
Zum Beispiel hast du im Gegensatz zu DRM-geschuetzten Stuecken ein Recht auf Privatkopie.

RMS unterschiedet IMHO zwischen Werken technischer (Software) und kultureller Natur (Musik, Buch, Film, eigentlich auch Computerspiele).
Erstere sollten aus den bekannten Gründen frei sein. Bei den kulturellen Sachen siehts schon anders aus und soweit ich weiß hat sich selbst Richard da nicht festgelegt. Das das ohnehin ein komplexes Thema ist sieht man IMHO auch an der Existenz von Creative Commons mit ihren diversen Lizenzierungsmodellen oder wie zB. Debian damit umgeht.

Lies dir doch bitte mal folgende Reden durch (besonders die erste) [1] und [2].Der erste Text klärt sehr genau über die Geschichte des Urheberrechts auf und verdeutlicht den Einfluss großer Konzerne auf die heutige Gesetzgebung. Dort steht ganz am Anfang: "But for other kinds of information, you can raise the issue because any kind of information that can be stored on a computer, conceivably, can be copied and modified. So the ethical issues of free software, the issues of a user's right to copy and modify software, are the same as such questions for other kinds of published information." Später dann: "The third category of works is aesthetic or entertaining works [...] for these works, the issue of modification is a very difficult one" Dass man das Recht haben sollte, die Inhalte unverändert weiterzugeben zweifelt er aber nirgendwo an. Er schlägt dort auch andere Vergütungssysteme für Urheber vor und macht deutlich warum das Urheberrecht eigentlich nicht für die Urheber sondern für die Verwertungsindustrie genutzt wird. Daraus folgere ich, dass (gerade) wenn wir Sympathie mit den Urhebern haben, wir dieses System ablehnen sollten.

Warscheinlich sind diese Wasserzeichen ohne DRM nicht sonderlich nützlich und es handelt sich um eher um Psychologie zur Abschreckung.
Doch, es ist nützlich: Um P2P-Kopiererei einzudämmen.
Aber solche Wasserzeichensysteme haben sowieso nur mit Überwachung den gewünschten Effekt.

Ich kann da nur die Rede von RMS in Göteburg empfehlen, da betont er folgendes (das ist kein Zitat, sondern frei übersetzt/interpretiert): Wenn du vor der Wahl stehst den "Vertrag" mit dem Rechteinhaber einzuhalten und einem Mitglied deiner Gemeinschaft/Gesellschaft den Zugang zu Informationen/Daten (in dem konkreten Fall der Rede geht es um Software) zu verweigern oder den Vertrag mit jemand zu brechen, dessen Bedingungen nur existieren um deine Freiheit zu beschneiden und einem Mitglied deiner Gemeinsacht/Gesellschaft zu helfen, dann ist letzteres immer das geringere Übel.

Ich erlaube mir mal den spitzen Kommentar, dass der Judenstern auch "nur" eine Markierung war. Damit will ich beigott keine Parallelen ziehen, aber verdeutlichen, dass nichts "einfach nur" eine Markierung ist, sondern immer einen Zweck erfüllt. Und dieser Zweck ist es unserer Verhalten einzuschränken und unsere Freieheit zu beschneiden. (sonst wäre das ganze ja auch sinnlos)

Ich sehe das folgendermassen: Wir müssen uns hier neu Gedanken machen, weil das, um das es geht ganz andere Eigenschaften hat, wie wir das bisher (also vor noch einigen Jahrzehnten) gewohnt waren.
Wenn ich eine Schallplatte kaufe, dann war diese nicht einfach zu replizieren. Bei CDs ging's dann später schon deutlich einfacher. Bei MP3/OGG ist der Aufwand nahezu null.
D.h. wenn ich eine Schallplatte verloren habe, dann hatte ich sie selbst nicht mehr, aber jemand anderes. Mein Problem.
Wenn ich einen MP3-Player verliere, dann habe ich (bezogen auf die Musik vermutlich keinen Verlust, da dort sowieso nur Kopien abgelegt waren. Aber der Finder kann diese nun auch sehr einfach replizieren. Ohne Wasserzeichen: kein Problem für mich, aber Problem für den Verkaufswilligen.
Daher ist eine Markierung einer digitalen Datei auch nicht wirklich mit der Markierung z.B. eines Fahrrades vergleichbar. Beim Fahrrad besteht keine Gefahr, dass sich diese Markierung auf tausenden von Kopien wiederfindet.
Daher ist eine Markierung mit Wasserzeichen eher wie eine PIN zu sehen. Bei beiden braucht der Herausgeber sie aus einem bestimmten Grund: um mich zu identifizieren. Ich selbst sollte sie niemand anderem mitteilen.
D.h. für mich, Wasserzeichen schränken mich in meiner Freiheit nicht ein. Ich muss jedoch auf meine Musikdateien aufpassen wie auf eine PIN. Eine PIN soll man sich nicht notieren, sondern merken. Bei Musikstücken undenkbar bzw. nicht so, wie wir das gerne haben wollen :-).
Ich muss also die Daten inkl. Wasserzeichen irgendwo "ablegen" und kann nicht 100% garantieren, dass diese bemerkt oder unbemerkt kopiert werden.
Gibt es einen Weg aus diesem Dilemma, dass ein Wasserzeichen eigentlich nicht einschränkt, aber andererseits behütet werden müsste wie eine PIN?

Wie gesagt, ich es geht mir nicht um Legalität sondern um Freiheit. Ich bin der Meinung, dass jeder eine Recht auf unkontrollierte, unüberwachte und uneingeschränkte Kommunikation haben sollte. Welche Informationen/Daten er dabei austauscht geht niemanden etwas an. Ob das irgendwo legal oder illegal ist hat mit der Moralität dieser Forderung nichts zu tun.

Doch, denn sie verhindern durch Strafandrohung, dass du kopierst. Der Schutz ist nur primär juristisch, statt technisch.

Alles sind Informationen. Es gibt mehrere physikalische/mathematische Theorien, die sich nur damit Beschäftigen, dass unser Universum ein Automat ist. Die Frage ist, ob diese Informationen von uns ohne Kosten (in Form von Resourcen/Geld) reproduziert werden können. Dies ist bei Essen z.B. nicht der Fall (physische Objekte lassen im Moment überhaupt nicht aus Energie herstellen, obwohl dies thoeretisch durchaus möglich ist). Wohl aber bei Musikstücken.

Die GPL ist ein Mittel zum Zweck. Der Zweck ist allen Nutzern von Software die vier Freiheiten zu gewähren. Die GPL brauchen wir "nur" weil unsere Gesellschaft (in Form von Gesetzen) uns diese Freiheiten nicht garantiert. Sollte dies irgendwann der Fall sein, werden Lizenzen überflüssig. Bis dahin befinden wir uns aber in einem Kampf mit denen, die versuchen ihren Nutzern diese Rechte vorzuenthalten. Damit diese nicht unsere solidarische und freie Arbeit in Form von freier Software gegen uns verwenden (indem sie sie in ihre unfreie Software einbauen) sind wir auf die GPL angewiesen. Wir nutzen also m.E. schon ein System, das wir eigentlich überwinden wollen. Das ist denke ich auch richtig. Andere sehen das anders und veröffentlichen ihren Quellcode unter der BSDL oder gleich als Public Domain.

Naja, Leute gehen ja immernoch ins Kino. Besonders wenn der Film in den Kinos rauskommt bevor er digital verfügbar ist. Aber das ist auch garnicht der Punkt. Der Punkt ist, dass so etwas grundsätzliches wie Kommunikation nicht eingeschränkt werden darf. Wie man Kinofilme produziert ist da erstmal zweitrangig. Aber ich bin mir sicher die Industrie würde sich schnell was einfallen lassen (wenns ums Geld geht werden die schnell kreativ ;) ).

Naja, Leute gehen ja immernoch ins Kino.

Es geht bei der Debatte nicht um eine Weltrevolution sondern um einen angemessenen Ausgleich zwischen dem prinzipiell berechtigten Anspruch der Rechteinhaber mit den von Ihnen produzierten Werken Geld zu verdienen und den Interessen der Benutzer.
Und das was du als "zweitrangig" abtust ist fuer Leute die z.B. als Schauspieler, Autor oder Fotograf arbeiten absolut essentiell.
Zum Beispiel ist ein freischaffender Fotograf der alleine von den Einnahmen aus den Urheberrechten seiner Fotos lebt häufig finanziell nicht wirklich gut gestellt. Und viele der bekanntesten Fotos die es gibt sind von solchen Leuten gemacht worden.
Wenn du etwas durchsetzen möchtest das solche Leute der Existenzgrundlage beraubt dann solltest du diesen Leuten schon etwas konkreteres als leere Phrasen wie "Aber ich bin mir sicher die Industrie würde sich schnell was einfallen lassen" bieten.

Ich habe mich bei "freischaffender Fotograf" vielleicht falsch ausgedrueckt: Ich meine damit nicht den Fotografen um die Ecke der von Bewerbungs- und Hochzeitsfotos lebt (und fuer den das Urheberrecht nicht so essenziell ist), sondern Leute die ein halbes Jahr im Irak oder in Neuseeland unterwegs sind und die davon leben dass dabei zwei Dutzend gute Fotos herauskommen fuer die dann zum Beispiel eine Nachrichtenagentur oder eine Zeitschrift wie Geo gutes Geld bezahlt (egal ob die Fotos nachher verkauft werden oder er mit einem Auftrag oder als Angestellter unterwegs war).

Gerade im Bereich der Druckpresse, würde sich doch kaum etwas ändern: 1) mit Urheberrecht: Fotograf geht in den Irak und macht Fotos, kommt zurück und zeigt sie einer Zeitschrift, die das Recht kauft die Fotos zu veröffentlichen. 2) ohne Urheberrecht: Fotograf geht in den Irak und macht Fotos, kommt zurück und zeigt sie einer Zeitschrift, denen er dann hochauflösende Bilder verkauft.
Davon abgesehen, denke ich, dass die meisten - auch die freiberuflichen - Fotografen, mit einem Auftrag in den Irak (oder sonstwohin) geschickt werden. Die reisen also nicht einfach ziellos durch die Welt und verkaufen dann ein paar Fotos. Ja, aber wenn er ein Geschäft machen will, bedarf es ja auch Material, dass er zeigen kann. Du wirst entgegnen, er könnte egoistisch und gierig sein und kein Geld abgegeben. Das stimmt auch und im großen Film- und Musikgeschäft gäbe es definitiv auch Veränderungen. Wie man an von den P2P-Studien sieht, betrifft das Kopieren-statt-Kaufen besonders die "ganz Großen". Anscheinend haben Hörer/Zuschauer von "kleineren" Bands/Filmemacher, genug Sensibilität um ihre Künstler zu unterstützen. Die Gesellschaft wäre durch so eine Umstellung gezwungen sich unmittelbar mit der Unterhaltungsindustrie auseinanderzusetzen. Vielleicht würde dabei dann rauskommen, dass viele Konsumenten der "0815-Medien", nicht bereit wären den Preis der Produktion zu tragen, auch wenn es heißt das Produzenten dieser Musik/Filme dann weniger Grundlage zum Produzieren haben. Naja, vielleicht muss dann sogar ein "Topschauspieler" mit 1Millionen im Jahr auskommen statt mit 10Millionen pro Film. Vielleicht gibts dann weniger "Zlatkos" und "Popstars", vielleicht sogar weniger "Britneys" und wie sie alle heißen... Kein Verlust in meinen Augen. Man sollte freiwillig bereit sein Kultur zu fördern wenn man finanziell dazu in der Lage ist. Wenn man dazu nicht in der Lage ist, sollte man deswegen nicht davon ausgeschlossen werden. Aber ich gebe zu, dass das Veränderungen sind, die gesellschaftlich begleitet und vorbereitet werden müssten und nicht durch das einfache Abschaffen von irgendwelchen Gesetzen laufen können.

Oder was glaubst du denn wer und zu welchem Zweck sonst "freiwillig bereit sein [wuerde] Kultur zu fördern" und auch "finanziell dazu in der Lage ist" das bei millionenteuren Filmen zu tun.
Wenn ein "Kulturproduzent" so dumm ist kritische Filme zu machen, "na dann kriegt er halt kein Geld!"

Warum kostet ein Film Millionen von Euro? Weil Spezialeffekte, wie Explosionen, Massensterben und Autocrashs, und Schauspieler eben viel Geld verbrauchen? Ich habe im meinem Leben mehr gute billige Filme, als teure Hollywood-Produktionen gesehen, die haben im Vergleich zu Rambo und ähnlichem auch nebenbei noch tieferen Inhalt und haben mich emotional berührt.

Warum? Das klingt unlogisch, es gibt auch Leute die Filme machen ohne riesige finanzielle Interessen - wie wollen nur arbeiten und Geld für ihre Familie verdienen, wie du und ich auch.

Welche Informationen/Daten er dabei austauscht geht niemanden etwas an. Ob das irgendwo legal oder illegal ist hat mit der Moralität dieser Forderung nichts zu tun.

Das ist ein wirklich guter Gedankengang und Ich glaube, auch das, worauf die hinaus wollen. Das sollte man noch mal wirksamer irgendwo festhalten, weil ich glaube, dass das ein interessanter Aspekt ist.
Ich sollte vielleicht dazu sagen, dass ich Wasserzeichen auch für besser als DRM halte. Trotzdem gilt es für das Recht auf freien ungefilterteten Austausch von Information zu kämpfen und jegliche technische, halb-technische und juristische Einschränkungen davon abzulehnen.
Informationen != urheberrechtlich geschuetzte Werke
Alles sind Informationen. Es gibt mehrere physikalische/mathematische Theorien, die sich nur damit Beschäftigen, dass unser Universum ein Automat ist. Die Frage ist, ob diese Informationen von uns ohne Kosten (in Form von Resourcen/Geld) reproduziert werden können. Dies ist bei Essen z.B. nicht der Fall (physische Objekte lassen im Moment überhaupt nicht aus Energie herstellen, obwohl dies thoeretisch durchaus möglich ist). Wohl aber bei Musikstücken.
Genau, deshalb sollte man auch das Urheberrecht sehr stark überdenken.

Wenn man an vorheriger Argumentation festhält, dann müssten Kameras auf öffentlichen Plätzen ja auch nur ein Mittel Gewalt zu vermeiden - nicht mehr und nicht weniger. Dass das nicht so ist, kann man ja täglich erleben ...
Wenn du denkst, jeder könnte dein Wasserzeichen verfolgen oder Dateien von dir kopieren, verhällst du dich ganz anders. Man nennt das dann Überwachungsdruck. Du wirst dann sicher nicht mehr deinen Player mit legal gekauften (also mit Wasserzeichen versehenen) Musikstücken irgendwo herumliegen lassen und dir dann schon Gedanken darum machen, was passiert, wenn jemand die Dateien von deinem Player ins Internet stellt.

usw.
Es gibt so viele Möglichkeiten, wie meine Musikdateien auch ohne mein direktes Zutun irgendwo auftauchen könnten wo sie nach dem Gesetz nicht sein dürften. Ich wollte mich diesem Risiko nicht aussetzen, dass dann plötzlich die Polizei bei mir anklopft. Daher sind für mich Musikdateien mit Wasserzeichen ein absolutes no-go.
Das eigentliche Problem ist doch, dass sich unsere Welt geändert hat. Digitale Daten fliegen heute verlustfrei durch die Luft und niemand wird die Zeit zurück drehen können.
Wenn man DRM durch Wasserzeichen oder irgendwas anderes ersetzt, bekämpft man nur die Symptome (z.B. technische Inkompatibilitäten im Fall von DRM), aber nicht das eigentliche Problem.

Ja, was passiert z.B. auch wenn jemand herausfindet, wie man die Wasserzeichen generiert? Dann kann diese Person anderen Leuten "Straftaten" anlasten und betroffene Personen können das nicht widerlegen. So kaufe ich mir z.B. ein sehr beliebtes Lied, eine andere Person generiert eine Datei mit dem Wasserzeichen, das meine ID (wie ja vorgeschlagen) enthält (vielleicht auch nur aus Zufall), und verbreitet diese. Tage später klingeln dann Polizeibeamte an deiner Tür.
Klingt vielleicht übertrieben, aber so weit her geholt finde ich das auch wiederum nicht.

Ja, wir sollten die Gesetze den Menschen anpassen - nicht die Menschen den Gesetzen. Denn wo enden wir denn sonst? Ich möchte in einer solchen Gesellschaft nicht leben und am Ende profitieren dann doch nur die "Eliten" davon, aber ein demokratischer Staat soll die Interessen der Mehrheit vertreten.

Ja, das ganze Problem verlagert sich hier nur und man muss da auch weiter denken. Die Freude über offene Formate mag zwar berechtigt sein, doch ich denke da kommt vielleicht noch was viel schlimmeres auf uns zu.
Die Musikindustrie würde das auf jeden Fall nicht machen, wenn sie daran nicht mehr Kontrolle gewinnen und Profit machen würde. Die machen das doch nicht nur, weil die Leute kein DRM haben wollen. Ich glaube nicht, dass die sich für die Gesellschaft und kulturelle Teilnahme interessieren.

Das ist ein anderes Problem. Gewissenhafte Anbieter sollten die Info so schnell wie möglich vernichten. Sind die Dateien jedoch nicht mit Wasserzeichen versehen, so kann keiner nachvollziehen, daß diese Datei, die er jetzt aus irgendwelchen Gründen (s.u.) einmal von mir erworben wurde.

Aber wenn man sich (z.B. bei Wikipedia) anschaut was normalerweise an Problemen beim Einsatz von DRM aufgefuehrt wird, dann sagt mir mein kritischer Verstand dass Wasserzeichen die typischerweise gegen DRM vorgebrachten Kritikpunkte alle nicht hat.
Wie bereits gesagt habe ich mir noch keine Meinung zu Wasserzeichen gebildet, im Interessenkonflikt den Rechten der Urheber und Verbrauerrechten wirkt es aber im Gegensatz zu DRM eher wie ein gangbarer Mittelweg der den Interessen beider Seiten gerecht weren koennte.

Produktionskosten von 50 Millionen Dollar hatte [1] dann ist es (egal was man von einzelnen Massnahmen haelt) nur logisch und auch legitim dass die dahinterstehenden Firma (die auch das Risiko traegt falls der Film floppt) von einem gut laufenden Film Einnahmen in neunstelliger Hoehe erwartet.

So argumentiert auch Volker Grassmuck und - wenn ich mich richtig entsinne - Lawrence Lessig, es wirft uns aber vor ein großes Problem, was Adrian klar aufgezeigt hat: Irgendwie müssen die Produktionskosten wieder hereinkommen.
Selbst für Freie Software ist das nicht selbstverständlich und wir sind immer noch auf der Suche nach tragfähigen Finanzierungsmodellen in der breiten Masse.
Wer also sagt: Alles muss kostenlos kopierbar sein, der muss aus meiner Sicht auch bereit sein, die Arbeitsleistung zu entlohnen.

Ich schätze, dass du beweisen musst, dass du die Datei nicht illegal weitergegeben hast. In den USA mussten (wenn ich mich nicht falsch erinnere) die Angeklagten das auch selber beweisen. Vor kurzer Zeit gab es doch auch in Deutschland eine Verwechselung der IP-Adresse, da musste der Angeklagte das doch auch beweisen, oder?
Deshalb würde ich schätzen, dass eher gegen den Angeklagten entschieden wird. Im Präventivstaat der Gegenwart ist das ja nicht selten, denn erstmal sind ja alle schuldig, außer sie können das Gegenteil beweisen.

Ich finde die Modelle, die Richard Stallman in "Copyright vs. Community" aufzeigt, sehr gut.
Das eine basiert auf freiwilligen Spenden. Stallman rechnet vor, dass die Interpreten nur ein paar Prozent vom Gewinn bekommen und dass, wenn jeder nur 1$ an den Interpreten spendet, der Interpret viel mehr davon hat. Ich finde das eine wirklich gute Lösung. Die Leute spenden und bezahlen für die Konzerte. Das hört sich fair an. Einziger Nachteil: Die Musikindustrie wird arbeitslos und es gibt keine Superstars mehr. Traurig, oder? Man lösst also mehrere Probleme gleichzeitig und verbessert unsere Gesellschaft.
Selbst für Freie Software ist das nicht selbstverständlich und wir sind immer noch auf der Suche nach tragfähigen Finanzierungsmodellen in der breiten Masse.

Ich denke, dass die Leute dass schon merken würden, wenn die Interpreten alle nicht mehr singen, weil sie von Harz-IV leben müssen. Künstler sollte man auch nicht aufgrund des Geldes werden, sondern wegen der Kunst.

Schau dir nur einmal an welche Probleme Wikipedia hat sich ueber Spenden zu finanzieren [1].
Selbst für Freie Software ist das nicht selbstverständlich und wir sind immer noch auf der Suche nach tragfähigen Finanzierungsmodellen in der breiten Masse.
Wer also sagt: Alles muss kostenlos kopierbar sein, der muss aus meiner Sicht auch bereit sein, die Arbeitsleistung zu entlohnen.
Ich denke, dass die Leute dass schon merken würden, wenn die Interpreten alle nicht mehr singen, weil sie von Harz-IV leben müssen. Künstler sollte man auch nicht aufgrund des Geldes werden, sondern wegen der Kunst. ...
Aber auch ein Kuenstler muss von irgendetwas leben.
Und der Musikbereich ist noch ein harmloses Beispiel - weil die Leute gewohnt sind das Musik Geld kostet und es ueber Konzerte etc. noch halbwegs realistische andere Einnahmequellen gibt.
Auch wuerden fuer das Anhören eines Musikalbums ein paar Leute noch freiwillig Geld zahlen, aber wieviele Leute denken zum Beispiel daran dass auch Fotografien Geld kosten und viele Fotografen von dem Urheberrecht auf Ihren Fotografien Ihren Lebensunterhalt verdienen?

Wenn du meinst, ich fand die Idee eigentlich für die jetzige Situation überzeugend. Aber wenn man es nicht mal versucht; vielleicht verändert sich dann ja auch das Bewusstsein der Menschen, denn das wird ja auch wieder durch ihre Umgebung und Gesellschaft beeinflusst. Sicherlich passiert das nicht über Nacht.

Wer hat denen denn Geiz ist Geil eingetrichtert? Genau die Leute, die auch z.B. zusammen mit der Musikindustrie verdienen. Aber durch Spenden gibt man ja das gleiche Geld aus, nur die Musikindustrie steckt sich nicht das meiste ein.

Man muss das idealistisch sehen, du kannst nicht vom heutigen Standpunkt aus beurteilen, was Ideen bewirken. Sie verändern unsere Wirklichkeit, Gesellschaft und damit auch Wirtschaft. Somit sehe ich da keine Probleme. Doch der Weg ist lang und es gibt viele Leute zu überzeugen.
Denn so ist GNU, die GNU GPL und die ganze Bewegung für freie Software entstanden. Es gibt da eigentlich kaum Unterschiede.
Ich denke, wenn man das schafft, hat man etwas richtiges für Kultur und Gesellschaft getan.
Aber auf das konkrete Beispiel Wasserzeichen bezogen (wir schwenken ja ein bisschen ab), denke ich, dass es sehr gut möglich ist, hier schnell und akzeptabel Veränderung zu schaffen. Denn die ist wirklich notwendig.

Kenn jemand denn glaubwürdige Studien, wie schwierig es denn nun wirklich ist die Wasserzeichen zu entfernen?
Die Steganographie ist auch auch entdeckbar, wohl auch ohne die Originale zu kennen.

Ich denke der kleinste gemeinsame Nenner ist die nicht-kommerzielle vervielfältigen. Das ist die Freiheit die, unabhängig von der Art des Werkes, in einer digitalen Welt jeder haben sollte.

Im Bereich von Musik könnte ich mir ein zeitlich beschränktes Monopol auf die kommerzielle Nutzung vorstellen. Wie lange das ist müsste man sich überlegen, ich kann mich an eine Studie erinnern, die soviel ich weiß zu dem Ergebnis gekommen ist, dass 14 Jahre ein guter Wert sei.
In dieser Zeit kann der Künstler CDs verkaufen (ich bin fest davon überzeugt, dass CDs durchaus noch lange einen Mehrwert haben werden, den viele für gute Musik und gute Bands gerne ausgeben). Dazu kommen Abgaben wenn die Musik im Radio, in der Disco usw. gespielt wird, Abgaben auf Leermedien, vielleicht sogar eine "Kulturflatrate" und natürlich kann man durch Auftritte, Fan Artikel oder durch das erstellen von Musik für spezielle Anlässe Geld verdienen.
Alles in allem ziemlich viele Möglichkeiten Geld zu verdienen. Ich glaube ein Mozart oder Beethoven hatte nicht so viele Möglichkeiten.
Ich habe vor einigen Wochen ein Interview von einer deutschen Band gehört (weiß leider nicht mehr den Namen). Die waren der Meinung, dass mit der Aufnahme von Musik in Zukunft wohl kein Geld mehr zu verdienen sein wird und dies zu einem reinen Marketinginstrument wird (wie z.B. Musikvideos). Das Geld wird dann nach deren Meinung wieder hauptsächlich durch Auftritte verdient. Dem richtigen Musik machen, wie sie es nannten. Sie fanden diese Entwicklung auch gar nicht so schlecht, dass würde wieder das wesentliche in den Vordergrund rückt.

Bei Fotos wird wohl auch hauptsächlich im kommerziellen Bereich Geld verdient (Zeitungen, Zeitschriften, Bücher,...). Ein zeitlich begrenztes Monopol auf die kommerzielle Nutzung sollte hier also auch zu einem vernünftigen Interessenausgleich führen.
Das alles sind natürlich nur ganz grobe Ideen die wahrscheinlich weit davon entfernt sind perfekt zu sein. Aber ich denke das ist die Richtung in die man sich Gedanken machen muss um das Problem zu lösen.

Mein Ansatz orientiert sich am dem, in meinen Augen, kleinsten gemeinsamen Nenner der verschiedenen Werke. Die Freiheiten die ein solches Urheberrecht bieten würde, würde natürlich nicht für alle Arten von Werken ausreichen (z.B. Software und Dokumentation). Es würde also auch weiterhin Freie Software Lizenzen, Freie Dokumenten Lizenzen, Creative Commons usw. geben. Wikipedia würde genauso funktionieren wie bisher, da hier die GFDL entscheidend ist.

Deshalb würde ich schätzen, dass eher gegen den Angeklagten entschieden wird. Im Präventivstaat der Gegenwart ist das ja nicht selten, denn erstmal sind ja alle schuldig, außer sie können das Gegenteil beweisen.
Naja, so ist es noch nicht, es gilt die http://de.wikipedia.org/wiki/Unschuldsvermutung, welche praktisch Verfassungsrang in Deutschland (und in anderen Längern) hat.

Datenbank (Oracle, MSSQL, ...) <-> "Berechnungen" <-> Oberfläche (Win32, Java, HTML,..)
Die Kunden geben dann das Schema der Datenbank vor und die Programmierer dürfen dann die Oberfläche und die "Berechnungen" (interne Programmstruktur) den Daten anpassen, wobei Generatoren die Grundstruktur festlegen und der Programmierer nur in bestimmten Bereichen eingreift.
Immer wieder das gleiche, keine/wenige Release-Zyklen, alle paar Jahre neu. Monotone Arbeit wie in einer Fabrik im 19. Jh., halt immer wieder das gleiche.
Ich habe vor ein paar Monaten einen Vortrag von b+m über Model-Driven Architecture und ähnliches gesehen, in dem so ein typischer Arbeitsprozess vorgestellt wird. Ich bin froh, dass ich so etwas nicht beruflich machen muss.
Vielleicht sehe ich das auch falsch, aber für mich scheint das so. Ich muss dabei bemerken, dass ich davon nicht viel verstehe und nicht verstehen will. Wenn ich das falsch sehe, bitte ich euch mich zu korrigieren.

Die Folge davon sind zum einen die ans Micromanagement grenzenden Projektpakete, zum anderen das Zurückgreifen auf bewährte Konstrukte (wie zB die von Dir beobachtete Architektur).
Nur weil die meisten Applikationen diser Struktur folgen heißt noch lange nicht dass die alle gleich zu programmieren sind; jede Software ist einzigartig. Monoton ist die Arbeit auf alle Fälle nicht.

Beruf kommt für mich von Berufung; ich muss Spaß an meiner Arbeit haben um glücklich zu sein. Für mich bedeutet das: die nächsten 5 Jahre noch als konservativer Entwickler zu arbeiten; danach nur noch beratend (und bei der Software-Architektur) tätig zu sein. Das Bazaar-Modell macht weitaus mehr Spaß, ist aber definitiv nicht das Richtige für jede Firma.

Großprojekte wie GNOME stetzen ja auf eine Hybridmethode: Quartalsweise (oder ist das bei GNOME ein halbes Jahr) Veröffentlichungen. Da ist dann beides drin.
Selbst bei diesen Firmenmethoden gibt es deutlich effektivere, als die vorgestellten.

Lass es mich so formulieren: Beamtenmentalität gibt es nicht nur beim Staat. Die Monotonen gibt es, aber in meinen Augen bilden sie (noch?) nicht die große Mehrheit. Insbesondere bei projektgetriebenen Firmen gibt es immer was Neues.
Was das denglisch angeht: Wir müssen a) Buzzword-compliant sein und b) den Code mit den Kollegen aus Bratislawa und London teilen. Da kommt es zwangsläufig zu neuen, firmeninternen Dialekten der englischen Sprache ;-)

Da habe ich wenig Ahnung von; das Konzept des Pair-programming fand ich zu abschreckend um mich näher damit zu befassen.

Ja, man muss miteinander sprechen. Bei großen Entwicklungsteams weiß aber nach 'nem Meeting keiner mehr genau, was genau besprochen wurde. In Kombination mit Kunden die nicht genau wissen was sie eigentlich wollen bedeutet das manchmal dass man am Ende zwar etwas Entwickelt hat, der Kunde aber nciht zahlen will weil er etwas komplett anderes wollte. Wen man dann eine 100%ige Definition dessen was man abliefern sollte in der Hand hat und genau sagen kann "Dies hast du in Auftrag gegeben; dein komisches Feature Z war von vornherein nicht geplant" bleibt man nicht auf Millionenkosten sitzen.

Berater im Sinne von "Einsparungen, Leute feuern, internes produkt X verkaufen" ist doof, ja. Berater im Sinne von "Ich habe Erfahrung und kann Euch sagen was eine sinnvolle Architektur ist" oder "Ich kenne die Freie Software Szene und kann euch sagen wie Ihr euer Produkt am besten unter die GPL stellt" ist mein Ziel. Wir dürfen nicht vergessen dass das, was uns selbstverständlich erscheint, für die meißten richtig großen Firmen schwarze Magie ist.
Beispiel hierfür: Asus mit dem EEE-PC. Die Sourcen sind in einem 1,8 GB großem Tarball; es gibt kein Code-repository, keine Mailingliste und kein Forum. Gäbe es das Alles (kombiniert mit Asus-Entwicklern die auch öffentlich aktiv sind) würde es garantiert eine große Community geben die das Beste aus dem EEE rausholen. In der jetzigen Form bilden sich hier und da kleine Grüppchen, die alle das Rad neu erfinden werden.

Ist ja bei OpenWRT ähnlich, da gibt es auch einige Distributionen von OpenWRT, das ja auch nur wieder eine Distribution ist.
Man muss sich mal vorstellen, wie lange es teilweise dauert bis der Source Code aus der Repository zum Benutzer kommt. Das sind teilweise Monate oder Jahre. Weil ja alles so "stabil" sein muss - Ich erinnere an Debian.
Großprojekte wie GNOME stetzen ja auf eine Hybridmethode: Quartalsweise (oder ist das bei GNOME ein halbes Jahr) Veröffentlichungen. Da ist dann beides drin.
Selbst bei diesen Firmenmethoden gibt es deutlich effektivere, als die vorgestellten.
Keine Frage. Aber große Firmen wollen nicht experimentieren. Leider.

Die Software, die verantwortlich für innereuropäische Überweisungen ist, wird garantiert unter weitaus höheren Qualitätsvorgaben als die meisten Brücken gebaut.

Gerade kleinere Firmen können sich Unwägbarkeiten in der Softwareentwicklung nicht erlauben da es keine andere Abteilung gibt die die Entwicklung querfinanziert.

Ich habe nie gesagt dass das schlecht ist. Vorhersagbarkeit ist wichtig für die meisten Firmen. Unvorhersehbare Entwicklung macht mir als Entwickler aber mehr Spaß ;-)

Wie funktioniert der Massenmarkt proprietärer Software? Üblicherweise versucht eine Anzahl von Unternehmen, die Bedürfnisse der potenziellen Nutzer vorauszusehen, und steckt Geld in eine neue Entwicklung. Einigen Unternehmen gelingt die Refinanzierung der Kosten - durch eine entsprechende Anzahl von Lizenzverkäufen für das fertige Produkt. Wer richtig lag, hat dann weiteres Kapital, um noch eine Runde zu probieren. Der positive Effekt: Der Markt findet so durch Wettbewerb heraus, was die Nutzer brauchen.
Anhand dieses Mechanismus sollte klar werden, warum es nicht genügt, den Distributor eines GNU-Systems zu bezahlen oder die Förderung freier Software nur den großen Unternehmen oder paritätischen Gremien zu überlassen. Nur jeder Einzelne von uns weiß wirklich, was er an Anwendungen und Programmen konkret braucht.

Danke für den Hinweis; ein wirklich gut durchdachter Artikel. Ich fürchte blos dass ich zu pessimistisch bin um an das Funktionieren des Modells zu glauben. Was ich mir eher vorstellen kann ist das Konzept der "Bounty": Anwender poolen ihr Geld und loben eine Bounty für Feature X oder Veränderung Y aus. Alles in allem glaube ich allerdings, dass wir immer noch nicht _das_ Finanzierungskonzept für Freie Software gefunden haben.

Alles in allem glaube ich allerdings, dass wir immer noch nicht _das_ Finanzierungskonzept für Freie Software gefunden haben.

Ich habe zu wenig Ahnung von Wasserzeichen um mir eine abschliessende Meinung bilden zu koennen, aber im Gegensatz zu DRM klingt das eher nach einer akzeptablen Sache.

Ja, die GNU GPL ist halt "pragmatic idealism", ein Kompromiss.
Irgendwann wird die GNU GPL entfallen, weil die Leute sich gar nicht mehr vorstellen können, wie es anders wäre. Das ist dann eine Art ungeschriebenes Gesetz, an das sich alle halten, man könnte es als Moral bezeichnen.
Die Menschen ändern sich halt im Laufe der Zeit. Ich denke, die Gesetze sollten sich den Menschen anpassen und nicht umgekehrt. Und die Menschen und Bedingungen haben sich halt geändert und deshalb sollten wir das Urheberrecht überdenken und vielleicht sogar komplett abschaffen.

Ich würde die Frage gerne noch von einer anderen Seite erkunden.
Könnten Wasserzeichen der Bevölkerung dabei helfen Künstler einfach zu entlohnen?
Hintergrund: Wenn ich ein gutes Lied höre, dann denke ich manchmal, dass ich dem Künstler gerne etwas dafür geben würde. Bei Straßenmusikern geht das sehr einfach, ich kann einfach 10 Cent geben (hab auch schon mal 2 EUR gegeben, weil er wirklich super war). Ich fühle mich gut und ich gebe etwas dafür.
Wenn ich an meinem Computer Musik höre, dann ist es schwieriger. Ich muss schauen, ob die Band eine Webseite mit Kontoverbindung hat. Dann zur Bank laufen und eine Überweisung machen. Das mach ich nicht für 10 Cent, auch nicht für eine Euro. Da bin ich zu faul dazu.
Also ist es im Moment meist so, dass ich weniger Geld für Musik ausgebe, als ich eigentlich bereit bin.
Am liebsten wäre es mir, wenn ich das direkt aus meiner Software, welche ich zum Abspielen von Musik verwenden machen kann.

Ich habe in letzter Zeit eigentlich alle Musik von Freunden bekommen. Wir haben zusammen Musik gehört, ich fand die Musik gut und habe die CD kopiert bekommen. Danach habe ich diese in OGG-Vorbis oder flac umgewandelt. (Oder ich habe diese schon als OGG-Vorbis bekommen.)
Kann ich mit anderen Technologien sicherstellen, dass meine Software nach umwandlungen weiß an wen das Geld gehen soll, wenn in der Musikdatei kein Wasserzeichen enthalten ist? Muss ich wenn ich Geld überweisen will, für jedes Lied, dass ich gut finde herausbekommen, wer der Künstler ist um ihm Geld zukommen zu lassen?

Wäre sehr statisch, aber möglich, da sich ja Daten ändern können. Aber in mp3 würde ich keine Musik unterbringen.

Solche Wortklaubereien sind egal - sobald du den Quellcode ansehen kannst ist es kein sinnvolles digitales Wasserzeichen mehr.

Das ist mir schon klar, ich wollte den Faden nur mal weiterspinnen, was man bräuchte, um dafür freie Software zu schreiben. Ich denke es ist auch jedem klar, dass das nicht möglich ist, selbst wenn man so etwas wie Schlüssel benutzt.

In deiner Schlussfolgerung fehlt die Logik...
Dass z.B. Filme fuer Oscar-Juroren (die teilweise erst spaeter in die Kinos kommen) digitale Wasserzeichen haben damit man herausfinden kann wessen Kopie im Internet gelandet ist hat dagegen durchaus seine Logik.

Aber nicht jeder Film kann wie "Das Leben der Anderen" sein. Versteh mich nicht falsch: Ich mag "Das Leben der Anderen" (gerade weil in meiner Schulbildung die DDR nicht wirklich intensiv behandelt wurde), aber ich mag auch Die Hard 4. Es gibt Tage an denen ich intellektuelle Kost haben möchte und es gibt Tage an denen ich mit einem Kumpel einen hirnlosen Actionfilm sehen möchte. Und ein Actionfilm kostet schlciht und ergreifend mehrere Millionen Euro in der Produktion.

Was ist daran schlimm dass die Filmindustrie profitiert? Last that i heard war profitorientiertes Streben nicht illegal/unmoralisch.

Wenn ich an meinem Computer Musik höre, dann ist es schwieriger. Ich muss schauen, ob die Band eine Webseite mit Kontoverbindung hat. Dann zur Bank laufen und eine Überweisung machen. Das mach ich nicht für 10 Cent, auch nicht für eine Euro. Da bin ich zu faul dazu.
Also ist es im Moment meist so, dass ich weniger Geld für Musik ausgebe, als ich eigentlich bereit bin.
Am liebsten wäre es mir, wenn ich das direkt aus meiner Software, welche ich zum Abspielen von Musik verwenden machen kann.

Bis hierhin finde ich die Idee sehr gut. Richard Stallman hatte ja eine anonyme Zahlungsmethode und Buttons in Programmen und Playern zum Überweisen vorgeschlagen, aber deine Idee finde ich fast noch besser (wenn das Programm vorher fragt).

Ja, es gibt doch diese Metainformationen in den Dateien, in denen stehen Künstler, Titel, ... Dann muss das Programm nur noch nachschlagen wohin das Geld gehen soll, vielleicht kann man dafür einen Treuhänder beauftragen, der dann gesammelt das Geld der Benutzer überweist. Und wenn die Gruppe nicht gefunden werden kann, überweist er es halt zurück. Ob das dann wirklich anonym ist, ist die Frage, aber ich finde die Idee eigentlich schon gut.
Einziges Problem bleibt hier der Datenschutz und die Vorratsdatenspeicherung. Dem Musiker auf der Straße gibts du das Geld direkt und anonym, der Treuhänder kennt dann Personendaten und Vorlieben.

So geht mir das mit Software auch. Ich halte das übrigens für eine "Bezahlung" und keine "Spende". Softwareunterstützung dafür, rumort mir shcon viel im Kopf rum. Ich denke, dass für Webanwendungen ein eigener Proxy schon viel helfen könnte.

Muss ich wenn ich Geld überweisen will, für jedes Lied, dass ich gut finde herausbekommen, wer der Künstler ist um ihm Geld zukommen zu lassen?
Es ergibt sich hier ein weiteres Problem: Wer hat überhaupt Anteil an der Erstellung der schönen Musik, der Komponist der Musik, der Texter, der Mischpultbediener, der Tontechniker im Studio, die Models im Video, die Designer der Werbeplakate, die Investoren der "Kennenlern-Tour"?
Letztenendes denke ich, dass wir das pro Band oder Stück gar nicht entscheiden können, wir bräuchten einen Anbieter, welcher das für uns macht und das Geld entsprechend verteilt. Vermutlich gibt es dann das einzelne Musikstück als gebündeltes Anggebot für 29 Cent oder so.

Bitte nicht die GEMA! Das ist doch kein Vergleich! Und Datenschutz gibt es bei denen auch nicht. Ich denke die GEMA ist nicht die Lösung, die Bernhard wirklich meinte. Die GEMA treibt Geld ein und verteilt keine Spenden/Bezahlungen! Oder gibst du der GEMA freiwillig Geld, damit sie das gerecht unter deinen Lieblingsmusikern und deren "Helfern" verteilt?

Warum?
Wenn du zum Beispiel ein Restaurant oder ein Fitnessstudio betreibst und dort im Hintergrund Musik läuft dann zahlst du dafuer derzeit eine mittlere dreistellige Summe im Jahr an die GEMA, darfst dafuer aber praktisches alles an Musik spielen.
Wenn es 5 Verwertungsgesellschaften gäbe und jeder Urheber bei einer anderen wäre dann muesstest du entweder an 5 verschiedene Gesellschaften zahlen oder ganz genau darauf achten welche Stuecke du abspielen darfst und welche nicht.
Das ist der Grund fuer die Monopolstellung der Verwertungsgesellschaften in Deutschland.

Oh ja, sehr peinlich. Das schematische Vorgehen ist aber (denke ich) gleich. Die GEMA hat aber schon im Jahre 1964 versucht an unsere Daten zu kommen. Wäre interessant mal etwas über Datenschutz von den zu erfahren, denn auf ihrer Webseite gibt es nicht einmal eine Datenschutzerklärung. Das ist doch verdächtig ...

Bei der GEMA kann ich als "Nutz-ender" nicht entscheiden, welche Musik mir besser gefallen hat, oder wie oft ich sie gehört habe und wie viel ich dafür geben möchte. Der Verteilungsschlüssel ist zudem noch ein Flaschenhals. Die GEMA hat ausserdem eine starke Monopolstellung.

Ah, die bekommen doch Daten darüber, was ich höre? :) Da die GEMA ein Monopol hat, finde ich das vom Datenschutz her bedenklich, besonders wenn das auf die Ebene des Nutzers ausgeweitet werden würde.

Wegen Deines Kommentar oben, habe ich die Vermutung, dass Du meine Idee noch anders verstanden hattest. Ich möchte, dass die Musik-Stücke umsonst weitergegeben werden können, auch kommerziell. Der Nutzer dieser Stücke hat allerdings ein Interesse daran, etwas für die Stücke zu bezahlen. Für die Abwicklung dieser Zahlungen bräuchte er verschiedenen Anbieter.

Ich denke, diese Entwicklung ist sicher nicht zum Vorteil unserer Gesellschaft. Ich hätte nicht gedacht, dass das so schnell Realität werden kann und auch schon ist.
