Wir kennen die abscheulichen Lizenzbedingungen von Microsoft, Adobe, Macromedia etc. So schlecht diese Lizenzen sein mögen, so wissen wir doch wenigstens, wo wir dran sind.
Schlimm ist es jedoch, wenn Software kostenlos im Internet zur Verfügung gestellt wird und keine Lizenzbestimmung angegeben ist. Noch schlimmer ist dies, wenn die Software von einer von unseren Steuergeldern finanzierten Universität kommt.
Ich spreche hier von einer nicht mal so weit von mir entfernten Universität: Bayreuth. Am Lehrstuhl für Mathematik und ihre Didaktik entwickelt ein Team von Profs, Doktoren und ein paar anderen eine Software namens Geonext (http://www.geonext.de/). Die Software ist leider in Java geschrieben, und wie wir wissen, gibt es noch kein wirklich freies Java. Nichtsdestotrotz: Hier entwickelt eine Uni offensichtlich proprietäre Software. Derzeit ist es noch kostenlos, aber vielleicht gibt's ja demnächst ein Spin-off, und die vielen Schulen, die die Software einsetzen, dürfen kräftig Gebühren blechen.
Ich habe eine Anfrage bezüglich der Lizenz an info@geonext.de gestellt. Ich habe seit einer Woche keine Antwort erhalten. Anscheinend ist hier was im Busch.

Das ist sicher nicht der erste Fall. Leider annoncieren manche Universitaeten ihre Produkte eventuell als frei, auch wenn sie es in keinster Weise sind.

Was macht GeoNext? Freie Software der Geometrie-Didaktik existieren ja bereits. Wenn sie in einem identischen Terrain operieren, kann man durch Propagation der freien Alternative eventuell praeventiv zuschlagen.

eigentlich Lügen die Leute doch nicht. Man kann etwas runterladen. Sie haben auch nicht "Open Source" oder gar Freie Software draufgeschrieben. Zumindest soweit ich das auf den grottenschlechten Webseiten sehen konnte.

Nein. Aber der (wirklich grottenschlechte) Web-Auftritt vermittelt den Eindruck eines freien Projekts, bis auf den Lizenzhinweis und den Source-Download. Insofern ist das eine legale, aber nicht gerade politisch korrekte Projektdarstellung. Es ist m.E. auf Täuschung angelegt.

IIRC Automatischer "Schutz". Die Downloadmöglichkeit gilt als "mutmaßliches Einverständnis" (oder wie das im Juristendeutsch heißt). Allerdings bin ich in tiefer rechtlicher Grauzone, wenn ich es meinen Schülern kopiere und muss mit juristischen Repressalien rechnen, wenn ich es a) in großem Stile mache b) es rauskommt. Die Tatsache, dass man im Dunkeln über die Lizenz gelassen wird, bereitet mir am meisten Sorgen.
