Leider geht dieser verdienstvolle Artikel, der ein Problem anreißt, das zukünftig an Bedeutung gewinnen kann, auf eine wesentliche Norm nicht ein: § 1641 des Bürgerlichen Gesetzbuches: Schenkungsverbot
"Die Eltern können nicht in Vertretung des Kindes Schenkungen machen. Ausgenommen sind Schenkungen, durch die einer sittlichen Pflicht oder einer auf den Anstand zu nehmenden Rücksicht entsprochen wird."
Bei einer unentgeltlichen Einräumung eines einfaches Nutzungsrecht für jedermann dürfte es sich um eine Schenkung handeln. In diese können die Eltern nach dieser Norm aber nicht einwilligen, sofern mit dieser Schenkung nicht "einer sittlichen Pflicht oder einer auf den Anstand zu nehmenden Rücksicht entsprochen wird".
Zu bedenken ist dabei auch, dass es nach deutschen Recht durchaus eine (wenn auch eingeschränkte) Haftung des Lizenzgebers für Fehler im Code gibt:

Möglicherweise stellt sich das Problem bei Beiträgen zu Werken, die unter einer Copyleft-Lizenz stehen anders, als bei Werken unter einer copyleftlosen Lizenz.
Auch stellt sich das Problem anders, wenn die Tätigkeit des Minderjährigen unter § 69b des Gesetzes über Urheberrecht und verwandte Schutzrechte (Urheber in Arbeits- und Dienstverhältnissen) fällt (s.a. § 113 des Bürgerlichen Gesetzbuches). Dann ist allerdings an den Minderjährigen eine Vergütung zu zahlen, die nicht nur "pro forma"-Charakter hat.
Das Ganze bedarf also weiterer juristischer Ausarbeitung.

Ich bin davon überzeugt, dass es eine sittlich Pflicht ist, Software grundsätzlich unter freien Lizenzen zu veröffentlichen. Es dürfte allerdings schwer sein, ein Gericht zu finden, das das genauso sieht ;-)

Ich würde diese Sache etwas differenzierter sehen. Wenn man Beiträge zu einer Software beisteuert, die man selbst kostenfrei erhalten hatt, kann man durchaus von einer sittlichen Verpflichtung ausgehen, diese Änderungen ebenfalls kostenfrei zur Verfügung zu stellen.
Bei der GPL hingegen gibt es den viralen Grundsatz, nachdem auch eigene Programme, die Bibliotheken benutzen, die unter der GPL lizenziert wurden, ebenfalls unter der GPL lizensiert sein müssen.
In diesen Falls sieht die Sache aus meiner Sicht wieder ganz anders aus und die GPL verbietet es ja nicht für Software einen beliegiben Geldbetrag zu verlangen solange dem Käufer der Software die in der GPL beschriebenen Rechte eingeräumt werden.

Bei der Frage, ob einer sittlichen Pflicht entsprochen wird, kommt es auf die Interessen des Minderjährigen an.
Es geht darum, ob die Schenkung unter Berücksichtigung der gesamten Vermögenslage letztlich im Interesse des Minderjährigen selbst liegt (OLG Hamm, FamRZ 1987,751).
Dies erlaubt eine "zielführende" Argumentation, die ich allerdings noch nicht ausgearbeitet gefunden habe.

Was mich an diesem Artikel stört, ist die Tatsache, dass von einer Verpflichtung zur Weitergabe im Bezug zur GPL gesprochen wird. Eine sochen Verpflichtung gibt es in der GPL nicht. Vielmehr räumt die GPL den Lienznehmer das Recht aber nicht die Pflicht zur Weitergabe ein. Nur wenn der Lizenznehmer von diesem Recht gebrauch machen möchte, treten die entsprechenden Bestimmung der GPL im Kraft, die u. a. Auswirkungen auf die Lizenzierung abgeleitete Werke und der Bereitstellung von Quelltexten beinhaltet.
Genaugenommen würde ein Minderjährigen für jeden Download einer Software eine Einwillung der gesetzlichen Vertreter benötigen, da ein solchen Download nur durch die Anerkennung einer entsprechenden Lizenz möglich ist. Das Erstellen einer Kopie ist halt nun eine nach dem Urheberrecht eine zustimmungspflichtige Handlung, die einer Lizenz bedarf.
Aber mein Hauptanliegen ist es, auf diese falsche Behauptung der Verpflichtung zur Weitergabe hinzuweisen, da gerade diese Fehlinforation dazu führt, dass in vielen Unternehmen Vorbehalte gegen den Einsatz freier Software existieren.
In diesem Zzsammenhang möchte ich darauf hinweisen, dass beim Fedora Project schon einmal eine Lizenz als unzulässig erachtet wurde, da diese eine Verpflichtung erhielt Programmänderungen an den Lizenzgeber weiterzugeben.

Ich hatte nicht den Eindruck, dass der Autor eine generelle Verpflichtung zur Weitergabe unterstellt, sondern sich lediglich auf die bei einer freiwilligen Weitergabe greifenden Restriktionen bezieht. Der Text scheint beide Interpretationen zuzulassen.
Merkwürdig fand ich allerdings die Aussage:

Die mir bekannten "BSD-artigen Lizenzen" verpflichten bei einer Weitergabe zumindest zum Erhalten des Lizenz-Textes inklusive der Copyright-Zeile. Für den Lizenz-Nehmer sehe ich darin keinen rechtlichen Vorteil.

Selbst bei der vergleichsweise restriktiven GPLv2 muss die Lizenz für die rein private Nutzung nicht anerkannt werden (Term 5).
