= FSFE zu AVM gegen Cybits: Ein kleiner Computer ist dennoch ein Computer =

Berlin, 22. Juni 2011 – Gestern fand in Berlin eine gerichtliche Anhörung zu einem Fall statt, der zu einem bedeutenden Präzedenzfall für die Embedded-Industrie werden könnte (siehe dazu [3]). In dem Rechtsstreit zwischen AVM und Cybits versucht AVM, die Position durchzusetzen, dass andere nicht das Recht haben, Freie Software auf von AVM gekauften Geräten, wie der weit verbreiteten Fritz!Box, zu verändern. Im Zentrum der Auseinandersetzung steht der Linuxkernel, der unter der GNU GPL vertrieben wird. Diese Lizenz garantiert den Benutzern genau diese Freiheit. Die Free Software Foundation Europe (FSFE) und gpl-violations.org haben heute einen detaillierten Bericht über die Anhörung veröffentlicht.
„Anwender haben das Recht, selbst zu entscheiden, welche Software auf ihren Computern läuft. Wenn AVM oder irgendeine andere Firma sich nicht an die GNU General Public License halten möchte, dann sollten sie keine GPL-lizenzierte Software verwenden“, sagt Matthias Kirschner, Deutschlandkoordinator der FSFE.
„AVM will seine monopolistische Macht über diese Geräte behalten und weiter ausbauen, sogar nachdem sie bereits verkauft worden sind. Dies widerspricht nicht nur der GNU General Public License des Linuxkernels, sondern ist auch wettbewerbsfeindlich“, sagt Harald Welte, Mitarbeiter am Linuxkernel und Gründer des gpl-violations.org-Projekts.
Das Gericht hat während der gestrigen Anhörung keine Entscheidung getroffen. Die Teilnehmer dürfen weitere schriftliche Ausführungen einreichen. Das Gericht kann dann entweder direkt entscheiden, oder in eine Beweisaufnahme eintreten. Die FSFE und gpl-violations.org werden den Fall weiter beobachten und die Freiheit von Softwareanwendern verteidigen.

The gpl-violations.org project is taking legal and other means to make sure commercial users of Free Software are adhering to the GNU General Public License. gpl-violations.org has enforced the GNU GPL in hundreds of cases, most of them amicably and out of court. However, if necessary, legal means such as warning notices, preliminary injunctions and civil copyright lawsuits are used in order to ensure companies are following-up with their obligations under the GNU GPL. gpl-violations.org was started by Free Software developer Harald Welte, who has received multiple awards in recognition of his legal efforts on enforcing the GNU GPL.
