Interessant wird der Fall, wenn ich ein freies CMS verteilen möchte, welches von vornherein den Stempel mitliefern soll und als Online-Hilfe dazu deine politischen Ansichten. Dieses CMS wäre dann sofort unfrei und dürfte den Stempel selbst nicht mehr verwenden.
Das gleiche kann man mit einem freien music player konstruieren, der auch Musikdateien mitliefert usw.

Die Frage ist ob andere Werke gleich genutzt werden wie Software. Wenn eine Software mir eine bestimmte Tätigkeit verbietet, schränkt mich das sehr in meinem Handeln ein und ein Software-Autor kann dudurch viel Macht auf die Benutzer ausüben.
Wenn ich ein Musikstück nicht ändern darf, dann schränkt mich das primär ein, wenn ich selbst Musiker bin. Nachgeordnet ist es natürlich für die Gesellschaft besser, wenn Musikstücke einfach verändert werden können, weil es eine größere Auswahl an Kultur gibt. Aber primär für mich wichtig ist, dass ich die Musik anhören kann und sie mit anderen teilen kann.
Ich denke aber nicht, dass ein Musiker oder ein Maler durch ein Verbot von Änderungen an seinem Werk dieselbe Macht ausüben kann.

Eine Dokumentation (online Hilfe) sollte meiner Ansicht nach unter einer Lizenz stehen, welche Änderungen erlaubt. Dies hilft anderen Menschen. Sie können die Dokumentation verbessern und daher z.B. ein Programm besser verstehen.
Wenn ich z.B. einen politischen Aufsatz schreibe, dann ist dies nicht notwendig. Wenn jemand eine andere Meinung verbreiten will, dann kann er dies mit den Möglichkeiten die ihm vom Urheberrecht gegeben werden, wie zitieren, machen. Hierbei entsteht meiner Ansicht nach kein Schaden für die Gesellschaft.
Das gleiche kann man mit einem freien music player konstruieren, der auch Musikdateien mitliefert usw.
Ja, wenn ich als Autor Musik unter eine CC-By-NC stelle, dann muss ich damit leben, dass die Musik nicht so stark verbreitet wird (weil GNU/Linux Distributionen dies nicht draufmachen, weil man die CDs dann nicht mehr verkaufen kann), wie wenn ich Sie z.B. unter CC-By-Sa stelle. Allerdings schadet ein NC Zusatz meiner Ansicht nach primär dem Autor und weniger der Gesellschaft.
Versteh mich nicht falsch, Software muss um Frei zu sein die vier Freiheiten geben. Für andere Werke mag ich die -NC Lizenzen jedoch auch nicht. Und ich denke die meisten Ziele die damit verfolgt werden sind besser mit CC-By-Sa zu ermöglichen. Manchmal finde es zwar schade, wenn ich Musik nicht ändern kann. Allerdings denke ich nicht, dass dadurch jemand Macht über mich ausüben kann. Ich sehe kein Problem darin, wenn Meinungsäußerungen unter einer Lizenz stehen, welche keine Änderungen zulässt.

Als Autor eines solchen politischen Aufsatz hätte aber _ich_ zumindest ein Interesse daran, die sachlichen Bestandteile von politischen Überzeugungen weitestgehend zu trennen. Denn erstere machen hoffentlich den größten Anteil des Aufsatzes aus, und finden als freie und "unpolitisierte" Texte vielleicht größere Verbreitung.
Als Positiv-Beispiel fallen mir spontan die CCC-Stellungnahmen ein, bzw. deren Gutachten, die sie hin und wieder für verschiedenste Insti- tutionen erstellen. Natürlich liest man eine gewisse Grundstimmung heraus, aber alle wichtigen Punkte werden belegt, es ist ein Sachtext. Und darauf setzen dann die Homepage und diverse Blogs auf, die den Sachtext als Grundlage für eine politische Meinungsäußerung nutzen.
Und die FSF / FSFE fahren oftmals auch diese Strategie, wenn ich das richtig in Erinnerung habe.
Ich finde das auch ganz sinnvoll, denn wenn ich Leute nicht von meinen persönlichen Ansichten überzeugen kann, dann doch zumindest von den Fakten, die diesen Ansichten zugrunde liegen.
Mein Anspruch bezieht sich dabei nur auf den Sachteil. Reine (politische) Meinungsäußerungen benötigen in der Tat keine freie Lizenz, das würde ich eher wie Echtzeit-Kommunikation handhaben, also komplett ohne (CC-)Lizenz.
Vielleicht wird das mit folgendem Schema klarer.
A) Folgendes halte ich für eien faulen Kompromiss:
Politischer Aufsatz, Meinung und Fakten gemischt (CC-BY-ND)
B) Für die Gemeinschaft wertvoller fände ich:
Politische Meinungsäußerung ("all rights reserved")
&
Sachtext (CC-BY-SA)
Natürlich ist B) schwieriger, und bei den meisten Autoren geht B) wohl nachträglich aus A) hervorvor. Aber andererseits muss der Sachtext auch keinen wissenschaftlichen Ansprüchen geügen (falls doch, umso besser).
Nein, der Sachtext braucht lediglich so weit aufbereitet zu sein, dass der Autor keine so tiefe emotionale / persönliche Bindung mehr zu dem Geschriebenen hat (dafür ist der Meinungsäußerungs- Teil dann da). Nur so entsteht eine Grundlage für die weitere Zusammenarbeit, und damit einen "höheren" Wert für die Gemeinschaft, den man durch eine freie (also _wirklich_ freie) Lizenz unterstützen sollte.

Ein Blog-Eintrag mit bloßer Meinungsäußerung zählt für mich nicht als aufhebenswertes Kunstwerk, und kann meinetwegen sogar "All Rights Reserved" sein. Solch ein Eintrag verliert seinen Wert meist wenige Tage nach seiner Entstehung.
Aber ein langer, gut ausformulierter Blog-Eintrag, der fast an ein Tutorial, eine Howto oder eine journalistische Publikation herankommt - nun, dieser sollte von anderen verwendet und weiter ausgebaut werden können. Im einfachsten Fall zu einem Wikipedia-Artikel, im besten Fall zu einem ganzen Buch.
Das geht nicht gut mit NC, und erst recht nicht mit ND.
Was für ein Problem ist es für die Gesellschaft, wenn ein Künstler seine Musik unter CC-BY-NC stellt?
Gerade bei Musik und Animationen (Videos) sind die vier Freiheiten äußerst nützlich. Insbesondere da sie implizieren, dass man wirklich an den "Quellcode" heran kommt.
Sonst kann man das Zeug lediglich remixen, aber nicht wirklich weiterentwickeln oder Fehler korrigieren. Das Problem ist hier sicher nicht so groß wie bei Software, doch ich finde es immer jammerschade, wenn solche Werke nicht weiterentwickeln werden, weil sie der Allgemeinheit nur nur als Blackbox (gemastertes OGG bzw. gerendertes OGV) vorgesetzt bekommt.
Was für ein Problem ist es für unsere Gesellschaft, wenn ein Bild unter CC-BY-ND steht?
Ich kann es nicht als Icon in meiner GPL-Software verwenden. Ich kann es nicht in eine freie Collage, eine freie Präsentation oder ein freies Videos / eine freie Animation integrieren.
Ja, ich kann es nichtmal mit Gimp in die Mangel nehmen, um einen gutaussehenden Ausdruck davon zu erzeugen. (Farben anpassen, zurecht- schneiden, retouchieren, Rahmen hinzufügen, Symbole bzw. Worte mit einbringen, ...)
Auch hier also kein allzu großes Problem, aber irgendwie Zeit- verschwendung. Ich kann dieser Geisteshaltung einfach nichts abgewinnen. Da investiert jemand viel Freizeit in etwas, und sorgt dann durch die Lizenz dafür, dass andere so wenig wie möglich damit anfangen können.
Ich meine, was soll das? Wenn man seine Freizeit in etwas steckt, und dabei vielleicht sogar auf Vorhandenem aufbaut, dann sollte man doch ein großes Interesse daran haben, dass andere möglichst viel damit anfangen können.
Wie in der Freien Software sollte hier Kooperation die Regel sein, nicht gegenseitige Abschottung.

Ich würde sogar davon ausgehen, dass dies die seltenere "Nutzungsform" selbst von freier Musik ist.
Was die Freiheit angeht: Man wird den vier Freiheiten nicht gerecht, wenn man sie 1:1 auf andere Inhalte als Software überträgt und entsprechende Forderungen stellt. Bei Software (und Hardware) geht es um die materiellen Grundbedingungen unserer Kommunikation sowie vieler kultureller und sozialer Praktiken, die durch proprietäre Software in diffuse Abhängigkeit von diffusen Kräften geraten. Bei Inhalten geht es - den Zugang mal vorausgesetzt - schlimmstenfalls um Einschränkungen unserer Kreativität oder (wie im Fall des Stempels) um etwas Mühe für jemanden, der zusätzliche Arbeit hat, weil er einen Text neu formulieren muss. Das ist zwar lästig und schränkt ihn in seiner Handlungsfreiheit ein, es kann ihn jedoch nicht desubjektivieren. Bei proprietärer Software ist das anders: Sie hat das Potenzial, uns zu einem Spielball zu machen, von dem wir nicht mal wissen, wer ihn spielt.
Kurz: Für mich geht es hier um Freie Software, nicht aber um Freie Inhalte um jeden Preis.

Wenn wir mal politische Bekundungen und andere sehr persönliche Texte außen vor lassen ... Wieso nicht?
Ein bisschen Druck in Richtung freier Lizenzen und Nachhaltigkeit wäre gar nicht verkehrt. Viele Autoren würden es sich vielleicht überlegen, ihre Text doch unter eine freie Lizenz zu stellen, wenn man ihnen aufzeigt, dass Restriktionen wie NC und ND völlig überzogen sind.
Mag sein, dass man einige Autoren damit verschrecken würde, aber so viele wären das gar nicht. Und selbst wenn: Dann gäbe es womöglich weniger Texte, aber dafür wären mehr von ihnen frei. Nutzbarkeit vor Quantität - denn Quantität haben wir im Internet genug.
Dafür kann es viele Gründe geben - angefangen vom Wunsch, den Text noch erfolgreich verkaufen zu wollen, bis hin zur Angst vor Entstellung.
Ja, aber genau das meine ich! Die Leute tun es aus völlig irrationalen Gründen.
Hat irgendein Verlag jemals einen bereits veröffentlichten Internet- Artikel gekauft? Darauf lässt sich doch keiner ein - entweder Exklusiv- Rechte oder freie Lizenz. Oder der Autor trägt das Risiko selbst, d.h. Print-on-Demand, aber dann ist die Lizenz wurst.
Und wie kann man etwas entstellen, wenn es keine politische Meinungsbekundung ist, und das Original immer noch an alter Stelle für jedermann einsehbar ist? Wenn irgendwo eine Variante auftaucht, wird damit doch nicht das ursprüngliche Blog entstellt.
Oder wollen wir jetzt Karrikaturen und Satire verbieten? _Diese_ künstlerischen Freiheiten gibt es nämlich nach wie vor, völlig unabhängig von irgendwelchen Lizenzen.
Nein, solche Begründungen denken sich die Leute als Rechtfertigung im Nachhinein aus. Die eigentliche Motivation ist doch, das Gefühl der Kontrolle über das "eigene geistige Eigentum" zu behalten, selbst wenn es sich um ehrenamtliche Arbeit handelt!
Das kann natürlich jeder handhaben wie er will, aber es bringt niemandem Vorteile, weder dem Autor noch der Allgemeinheit. Es ist ein Verhaltensmuster aus den Zeiten vor dem Internet, das viele Menschen noch nicht abgelegt haben. Mag sein, dass das früher sinnvoll gewesen ist - doch womöglich nicht einmal das.
Wer jedoch an freier Software arbeitet, sollte _eigentlich_ dieses Verhaltensmuster durchschauen - schließlich hat er es stellenweise schon durchbrochen.
Ich verstehe, dass das in vielen Köpfen von Leuten herumgeistert, die noch nie aktiv mit einem Freien-Software-Projekt zu tun hatten: Etwa, wenn ein Autor seine ersten Artikel ins Netz packt, oder ein Musiker seinen ersten Song online stellt. Oder ein Software-Entwickler, der nur das proprietäre Zeug kannte, und bislang nur auf diese Weise entwickelte.
Aber dass Leute aus der Freien-Software-Welt an dieser unsäglichen Tradition festhalten, das finde ich sehr bedauerlich. Kein Sinn für Nachhaltigkeit. Ehrenamtliche Arbeit mit ausgefahrenen Ellenbogen ...
Außerdem hat er Zeit und Mühe investiert und folgt ja vielleicht noch anderen Interessen als dem sehr altruistischen Ziel eines Zuflusses zur "geistigen Allmende"

Wieso nicht stattdessen diese eifrigen Menschen unterstützen? Schaffe 1 Werk, erhalte 5 Variationen für Lau. Wenn das kein Geschäft ist ...
"5 Variationen? Pah, wahrscheinlich wird es nichtmal eine geben!" Nun, dann kann man sein Werk doch erst recht freigeben.

Klar, jeder konsumiert mehr als er modifiziert. Das ist ja das tolle an der digitalen Welt: Sie funktioniert auch, wenn nur eine Minderheit mitwirkt.
Dann ist es aber umso wichtiger, dass sich diese Minderheit gegenseitig unterstützt, und zwar so gut wie möglich! Und das geht nur mit freien Lizenzen.

(von Tim Pritlove, glaube ich). Das war seine Antwort auf einen Anrufer in der Sendung, der wissen wollte, ob er auf seiner Homepage technisch verhindern könne, dass andere seinen Text kopieren. Das heißt, man sollte den Text "nur lesen" können. Begründung war, dass in dem Text eine gewisse Arbeit und Recherche drin stecke.
Die darauf erfolgte, an alle Hörer gerichtete, Antwort "Habt keine Angst!" traf den Nagel genau auf den Kopf.

Ein bisschen Druck in Richtung freier Lizenzen und Nachhaltigkeit wäre gar nicht verkehrt. Viele Autoren würden es sich vielleicht überlegen, ihre Text doch unter eine freie Lizenz zu stellen, wenn man ihnen aufzeigt, dass Restriktionen wie NC und ND völlig überzogen sind.
Immer im vernueftigem Ton und keinen Druck machen. Wenn das bei mir einer mit Druck versuchen wuerde, wuerde ich alles wie es ist hinschmeissen, sprich loeschen vom Server. Denn ich wuerde mich nicht unter Druck setzen lassen. Aber in Ruhe in einem vernuenftigen Art und Weise - sachlich und gut erklaerend - wuerde immer gehen und damit kommt man auch eher an.

Meinst du das ernst? Da machst du es irgendwelchen Internet-Trollen aber ziemlich leicht. Vorallem schädigst du damit alle anderen, aber nicht den Troll. Der wird es sich schon runtergeladen haben.
Ich würde das eher wie im Usenet handhaben: Trolle auf die Filterliste, und all ihre zukünftigen Beiträge (E-Mails) ungelesen löschen.
Daher argumentiere ich genau anders herum: Dass ich für solche Spinner irgendwas von meiner Homepage nehme, soweit kommt's wohl noch ...

Nein, das haben sie natürlich nicht gesagt. :-) Schließlich ging es darum, den Leuten die Angst vorm Veröffentlichen ihrer Werke zu nehmen.
Allerdings taucht das Motto "Dann veroeffentliche nicht!" in späteren Chaosradio-Sendungen auf, im Zusammenhang mit persönlichen Texten und Bildern.
Die meisten haben kein "technisches" Know-How. Siehe der "Kuenstler", der Google verklagt hatte, weil seine Bilder bei der Google-Bildersuche zu sehen waren, aber von einer robots.txt nie was hoeren wollte... Das war fuer mich eine klare Lachnummer. ;-)

Auch Lawrence Lessig beispielsweise teilt durchaus die Kritik an den unfreien CC-Lizenzen und sieht sie als Zwischenlösung, damit möglichst viele Leute sich überhaupt erst einmal mit der Idee freien Inhalts beschäftigen.

Und das musst du sogar, selbst wenn es "nur" um Software geht. Denn gerade Software ist ein komplexer Verbund von vielen Arten von Daten. Jede GUI hat Grafiken und Textbeschriftungen, und jedes gut geschriebene Programm enthält Teile, die eher an Prosa in einer Fremdsprache erinnern, als an abstrakte Rechenschritte.
Bei Computerspielen wird es noch extremer, da kannst du zwischen der Software und dem künstlicherischen Aspekt gar keine Trennung mehr ziehen. Und dass du 3D-Modelle, Musik, etc. aus einem Spiel auch einzeln verwenden kannst, liegt eher an sauberer Programmierung, und weniger in der Natur der Sache.
Spätestens, wenn die Daten allesamt echtzeitberechnet sind (wie etwa in Demos / Intros), kannst du überhaupt keinen Trennung mehr von Code und Daten vornehmen. Was macht eine bestimmte Teilszene aus? Die Generatorfunktionen? Die Anfangsparameter?
Das heißt, eine Lizenz, die für Software geeignet ist, ist _erst recht_ auch für alle anderen Arten von Daten geeignet. Nur dass dann z.B. in der GPL etliche Passagen irrelevant werden.
Wie wäre es damit: Unter einer Freien Lizenz versteht man alle Freie- Software-Lizenzen, sowieso sämtliche andere Lizenzen, die zu ihnen kompatibel sind.
Oder anders: Ein Freies Werk ist ein Werk, dass man problemlos in einem Freien Software-Projekt verwenden kann.
Was ist daran unklar?

Ja, man kann ich die Kriterien auf andere Daten anlegen. Mein Punkt war, dass diese vier Punkt für die Freiheit einer Gesellschaft bei Software wichtig sind. Bei anderen Werken finde ich sie zwar gut, ich finde aber nicht, dass sie für die _Freiheit_ wichtig sind. Sie sind für kulturelle Vielfalt wichtig, ohne Frage. Aber kein Autor von anderen Werken kann auf dich diese Macht wie bei Software ausüben, wenn er dir die vier Freiheiten nicht gewährt.

Ein Blog-Eintrag mit bloßer Meinungsäußerung zählt für mich nicht als aufhebenswertes Kunstwerk, und kann meinetwegen sogar "All Rights Reserved" sein. Solch ein Eintrag verliert seinen Wert meist wenige Tage nach seiner Entstehung.
Blog-Einträge sind genauso wie Zeitungsartikel ganz normale Artikel. Manche sind gut geschrieben und manche nicht so gut. Manche von Leuten, die dafür bezahlt werden und manchmal von Leuten in ihrer Freizeit.
Ich stimme dir auch nicht zu, dass diese Informationen meist nur wenige Tage relevant sind. Die Verbindungen zwischn verschiedenen Informationen hilft auch später noch.
"All rights reserved" finde ich nicht gut. Dann kann ich nicht mal den Artikel ganz bei mir auf die Webseite packen oder auf Papier drucken und weiterverteilen. Ich finde mindestens das wörtliche Kopieren sollte bei allen Texten erlaubt sein.
Aber ein langer, gut ausformulierter Blog-Eintrag, der fast an ein Tutorial, eine Howto oder eine journalistische Publikation herankommt
- nun, dieser sollte von anderen verwendet und weiter ausgebaut werden
können. Im einfachsten Fall zu einem Wikipedia-Artikel, im besten Fall zu einem ganzen Buch.
Willst du als Künstler, dass dein schönes Kinderlied an zwei Stellen umgeändert wird und es nachher zur Verbreitung von rechtsradikalem Meinungen dient? Dann denkst du dir als Autor doch auch, sollen sie wenigstens ihr eigenes Lied draus machen. (Bei Bushido haben sich ja auch einige gerade geärgert.)
Ich finde es gut, wenn man Musik mixen kann und dadurch neue Dinge entstehen. Ich habe aber überhaupt kein Problem damit, wenn es manche Künstler nicht wollen.
ND hilft mir bei der kulturellen Vielfalt, weil sie nützlich für andere Kulturschaffende sind. Es können sehr schöne Werke entstehen. Hat aber bei anderen Werken meiner Ansicht nach keinen negativen Einfluss auf die Freiheit einer Gesellschaft. Was ich hier hinderlich finde ist, wenn die Lizenz es Nutzern verbieten will die Werke mit anderen auszutauschen. Das führt meiner Ansicht nach zu einer assozialen Gesellschaft.
Wenn jemand bei der Software nicht erlaubt, dass ich diese verändere hat dies einen negativen Einfluss auf die Freiheit der Gesellschaft.

Stimmt, daran habe ich nicht gedacht. Dann ist CC-BY-ND für reine Meinungsäußerungen und andere sehr persönliche Texte wohl ganz sinnvoll.
Dennoch wirkt CC-BY-ND vielleicht nicht so, wie man es gern hätte, siehe Punkt (3) weiter unten. Ein Jurist mag mich korrigieren, falls ich da falsch liegen sollte.

Lassen wir mal die Kirche im Dorf. Diese heftige Übertreibung passt gleich an mehreren Stellen nicht:

Volksverhetzung und Fremdenhass werden bereits in anderen Gesetzen behandelt. Das ist eine völlig andere Baustelle als das Urheberrecht.
Dann denkst du dir als Autor doch auch, sollen sie wenigstens ihr eigenes Lied draus machen. (Bei Bushido haben sich ja auch einige gerade geärgert.)
Wenn menschenverachtene Töne angeschlagen werden, dann macht es in meinen Augen keinen Unterschied, ob das Lied "geklaut" oder selbst- komponiert ist.
Wer sich gegen Rechtsextremismus einsetzen möchte, sollte das nicht durch Verwendung einer CC-BY-ND-Lizenz tun. Das ist lächerlich, und schlimmstenfalls eine Ersatzhandlung für richtiges Engagement.

Das Problem mit den unerwünschten Änderungen hast du bei Software auch. Und noch schlimmer: Die meiste Software ist anpassbar! Jeder Anwender kann in seinem KDE die voreingestellten Symbole und Farben gegen irgendeinen Dreck ersetzen.
Wenn jemand bei der Software nicht erlaubt, dass ich diese verändere hat dies einen negativen Einfluss auf die Freiheit der Gesellschaft.
Würde man in der KDE-Lizenz nur noch die Verwendung der Standard- Themes erlauben, würde das ebenfalls niemanden in seiner Arbeit ernsthaft eingeschränken.
Eine Freie-Software-Lizenz wäre das aber nicht mehr. Irgendwie erwarten wir von Freier Software ein bisschen mehr - und das finde ich gut so. Es geht nicht nur um die Freiheit der "Gesellschaft", sondern auch um die individuellen Freiheiten des Einzelnen.

Verballhornung, Karrikaturen, Parodien und Satire kann man hingegen nicht verbieten. Die sind nämlich in sehr großem Umfang erlaubt.
Pech gehabt. Wir leben nunmal in einer Gesellschaft, die ihren Bürgern künstlerische Freiheiten zugesteht, auch was die Verwendung fremder Werke angeht. Niemand ist der alleinige Herr über Variationen des "eigenen" Werkes. Und das finde ich gut so, denn _das_ fördert kulturelle Vielfalt.
Wer ein persönliches Problem damit hat, seinen Mitmenschen diese Freiheiten zuzugestehen, wer das "nicht will", dem hilft keine ND-Lizenz, sondern der muss seine Werke unter Verschluss halten.

Es bleiben also nur noch Verunstaltungen zu diskutieren, die schlimmer als (3) sind, aber nicht so extrem wie (1). Was haben wir da?
Beleidigung, Beschimpfung, Verunglimpfung, Rufmord - das steht alles sowieso unter Strafe, unabhängig vom Urheberrecht.
Eine Variation als eigenes Werk auszugeben ist ebenfalls bereits verboten, direkt im Urheberrecht.
Und eine Variation nicht als solche erkennbar zu machen, das wird vielleicht schon im Urheberrecht geregelt, steht aber auf jeden Fall in CC-BY nochmal explizit drin.
Auch hier also kein Grund für überzogene Restriktionen wie ND.

Ja, da hab ich ein zu krasses Beispiel gewählt. Außerdem habe ich nicht berücksichtigt, dass man bei CC-By immer noch Persönlichkeitsrechte hat. Wenn jemand also meinen Text über Freie Software unter CC-By nimmt und alle Vorkommen von Freier Software durch Open Source ersetzt, dann kann ich gerichtlich dagegen vorgehen. Ich kann dem Gericht dann zeigen, dass ich immer dafür argumentiert habe, dass Open Source ein schlechter Begriff ist und meiner Überzeugung wiederspricht.

Die Urheber-Persönlichkeitsrechte hast du immer, egal was du in deine Lizenz schreibst. Soweit ich weiß, kann man die gar nicht ablegen. :-)

Jetzt schreibst du selbst, dass sehr viel auch mit einer ND Lizenz möglich ist. Das wollte ich die ganze Zeit verständlich machen :) Was ich aber dennoch mit der ND verhindern kann (oder zumindest danach klagen) ist, dass jemand mein Werk abändert...
Karrikaturen, Parodien und Satire sind ja neue Werke. Ob diese von anderen inspiriert wurden oder nicht.

Wie schon gesagt, finde ich die NC nicht gut (z.B. weil man sich nicht in Freie Software integrieren kann). Allerdings arguemntiere ich mit dem oben nicht gegen NC. Deswegen hatte ich _Nutzer_ geschrieben. Wenn jemand etwas kommerziell weiterverbreitet ist er nicht mehr ein reiner Nutzer.
Bei Freier Software haben wir viele Möglichkeiten Geld zu verdienen. Bei anderen Werken kann es schwieriger sein damit Geld zu verdienen, wenn du sie auch kommerziell weitergeben darfst.
NC vschränkt eine weite Verbreitung ein. Sie hindert mich aber nicht, dass ich den Film, Bild, Musik, ... allen Leuten weitergebe, die ich kenne.

Wer ein persönliches Problem damit hat, seinen Mitmenschen diese Freiheiten zuzugestehen, wer das "nicht will", dem hilft keine ND-Lizenz, sondern der muss seine Werke unter Verschluss halten.
Jetzt schreibst du selbst, dass sehr viel auch mit einer ND Lizenz möglich ist. Das wollte ich die ganze Zeit verständlich machen :) Was ich aber dennoch mit der ND verhindern kann (oder zumindest danach klagen) ist, dass jemand mein Werk abändert...
Karrikaturen, Parodien und Satire sind ja neue Werke. Ob diese von anderen inspiriert wurden oder nicht.
Mir ist immer noch nicht klar, was du mit "nicht abändern" meinst. Eine Abänderung ist auch nichts weiter als ein neues Werk. Schließlich ist die ursprüngliche Version nach wie vor verfügbar.
Es ist ja kein Gemälde, in das jemand hineingemalt hat, oder eine Statue, von der jemand ein Stück abgeschlagen (oder hinzugefügt) hat. Wir reden schließlich von der Informationswelt, nicht von der materiellen Welt.
Nun könnte man sagen, "Abänderungen" erkennt man daran, dass sie dem "Original" sehr ähnlich sind. Allerdings gibt es Abänderungen, die nach einer gewissen Zeit kein Wort mit dem Original gemeinsam haben, obwohl sie durch viele kleine Überarbeitungen aus diesem hervorgegangen sind. Zudem gibt es Satire, die dem Original erschreckend ähnlich ist. Und manche Originale können sogar _unverändert_ als Satire durchgehen. ;-)
Diese Trennung in "abgeänderte Werke" und "neue, davon inspririerte Werke" kann ich daher in der Informationswelt nicht nachvollziehen.
Was ich hier hinderlich finde ist, wenn die Lizenz es Nutzern verbieten will die Werke mit anderen auszutauschen. Das führt meiner Ansicht nach zu einer assozialen Gesellschaft.

Man sollte meinen, beides läge noch im Interesse des Autoren, aber NC in all seiner Strenge dürfte das wohl verbieten.
Diese Grundhaltung des Kommerziellen als Feindbild finde ich sehr bedenklich. Richard Stallman hat schon sehr früh die Weichen dafür gestellt, dass Freie Software auf keinen Fall diese Richtung einschlägt. Und die Geschichte hat gezeigt, dass diese Strategie verdammt geschickt war.
Bei Freier Software haben wir viele Möglichkeiten Geld zu verdienen. Bei anderen Werken kann es schwieriger sein damit Geld zu verdienen, wenn du sie auch kommerziell weitergeben darfst.
Das stimmt, aber andererseits ist der Verkauf von Einzelnutzungs- Lizenzen bei anderen Werken _noch_ schwieriger als bei Software.
In Software kann man seinen Kopierschutz direkt einbauen - zur Not in jedes Produkt einen neuen Kopierschutz. Bei anderen Werken geht das nicht, da musst du erstmal eine DRM-Platform etablieren.
Ich würde sogar so weit gehen und behaupten, dass die Ziele, die ein Künstler bei NC im Auge hat, mit NC kaum zu erreichen sind - wohl aber mit BY-SA. Die "bösen Kommerz-Firmen" haben dann die Wahl, ob sie etwas der Gemeinschaft zurückgeben und mit dem Autor anderen Konditionen (i.d.R. gegen Geld) vereinbaren. Das heißt, die gleiche Fairness, aber bessere Verbreitungsmöglichkeiten um bekannt zu werden.
NC vschränkt eine weite Verbreitung ein. Sie hindert mich aber nicht, dass ich den Film, Bild, Musik, ... allen Leuten weitergebe, die ich kenne.
Ja, aber auch hier gibt es mit NC wieder unschöne Fragen: Wenn ich es meinen Freunden auf DVD brenne, und die mir im Gegenzug den aufgerunderen Rohling-Preis zahlen, oder ein paar leere Rohlinge geben ... was dann? Und selbst wenn ich den exakten Rohlingpreis erhalte bzw. die exakte Zahl an leeren Rohlingen zurückbekomme, könnte man das immer noch als wirtschaftliche Tätigkeit ansehen, oder?
Der Jurist mag hier vielleicht die genauen Trennlinien kennen, sofern das Gesetz bzw. die Formulierungen in den CC-Lizenzen eindeutig sind. Für den normalen Nutzer aber ist das auf jeden Fall eine lästige Grauzone, und er wird damit kaum anders umgehen als mit einem proprietären Werk - d.h. er wird das Werk nur unter der Hand weitergeben, unter dem Radar.
Das heißt, die Aufmerksamkeit auf das Werk wird nicht größer, und somit hat der Künstler gar nichts von der CC-Lizenz.

Ganz so einfach ist es nicht. Was ein Werk ist, darüber gibt es nicht erst seit gestern sehr differenzierte Meinungen und Debatten. Diese verlieren mit dem medialen Umbruch nicht automatisch an Gültigkeit, im Gegenteil. (Wo sie das tun, müsste man schon sehr im Einzelnen begründen.)
Eine davon ist, dass ein Text / Bild / Musikstück etc. eine gewisse Schöpfungshöhe haben muss, ein Maß an Individualität also, damit es z.B. als Werk gelten kann. Das lässt sich, bezogen auf Derivate, freilich nicht gut am Umfang der Änderungen festmachen. Kopiere ich einen langen theoretischen CC-BY Text aus deinem in mein Blog, füge einen recht nebensächlichen oder sogar unpassenden Gedanken und ein paar Füllwoerter hinzu, schreibe meinen Namen gleichberechtigt neben deinen und verstecke den Link zum Original weit unten auf der Seite, so ist gewiss kein neues Werk entstanden, der Leser wird im Regelfall aber denken, er habe es da mit zwei gleichermaßen tollen Hechten zu tun. Vielleicht bekomme ich es sogar hin, den Text in einer Fachzeitschrift unterzubringen und damit Prestige zu ernten.
Stellst du hingegen die Verse eines bekannten Gedichtes ein wenig um, so dass sich ein neuer, möglicherweise kritischer oder lustiger neuer Sinn ergibt, ohne dass du nur ein Wort hinzugefügt hättest, wird dir wohl einjeder die nötige Schöpfungshöhe bestätigen. Natürlich ist es nicht immer so eindeutig, klar. Festzuhalten ist aber, dass CC-BY zu beidem taugt: dazu, Werke zu plagiieren, zu entstellen, fremde Lorbeeren zu ernten; aber eben auch dazu, einen ästhetischen Mehrwert zu schaffen. Wer das erste Risiko zu tragen bereit ist, um anderen die zweite Möglichkeit offen zu halten, der ist bei CC-BY genau richtig. Wer das nicht möchte, mag sich der weniger "freien" CC-Lizenzen bedienen oder auf einen Beitrag zur digitalen Allmende in Form von CC auch ganz verzichten.
Wie auch immer gearteter Druck in die eine oder andere Richtung wird aber stets ideologisch motiviert und deswegen destruktiv sein: Denn die Einschätzung, ob die Menschen eher verantwortungsbewusst oder eher verantwortungslos zu handeln neigen, kann jeder nur für sich selbst treffen.

Okay, hier ist mein erster Versuch.
Ich dachte zunächst an eine Stichpunktliste, aber Prosa erschien mir angebrachter.
Die Zusammenfassung ist wahrscheinlich durch meine Sicht gefärbt. Bitte ergänzt, korrigiert oder "entfärbt" einfach alle Stellen, die euch unangenehm auffallen. Auch wäre es gut, wenn sich unter den Korrekturlesern wenigstens eine Frau befindet, denn das Gendering ist bestimmt noch verbesserungswürdig. Auch ein juristischer Blick könnte nicht schaden.
Vielleicht gibt es dafür einen guten Ort im Wiki? Oder sollte ich das besser auf meine Homepage packen über planet.fsfe.org veröffentlichen?

Freie Lizenzen bei Nicht-Software =================================

Die 4 Grundfreiheiten für Software lassen sich auf andere Werke übertragen, aber ihre gesellschaftliche Bedeutung ist dort geringer. Dennoch ist die Wahrung dieser Freiheiten auch bei Nicht-Software stets _anzuraten_.
In _Ausnahmefällen_ ist eine Nicht-Änderungsklausel anzuraten, aber nur dann, wenn das Werk _inhaltlich_ mit dem schöpfenden Individuum bzw. der schöpfenden Organisation stark verbunden ist.
Weitere Einschränkungen wie "Keine kommerzielle Nutzung" sind jedoch _niemals anzuraten_.
Technische Aspekte ------------------
Die problemlose Übertragbarkeit der 4 Grundfreiheiten auf andere Werke ist nicht überraschend, wenn man bedenkt, dass sich jede Freie-Software-Lizenz direkt auch für andere Werke verwenden lässt. Denn jede Software kann ein Verbund von Texten, Grafiken, 3D-Modellen und Musik sein. Wenn eine Lizenz diesen komplexen Verbund handhaben kann, dann erst recht auch einen einzelnes Foto oder ein Musikstück.
Jedoch kann eine Software-Lizenz zu viel des Guten sein. Zum Beispiel sind viele Passagen der GPL wirklich nur für Software interessant. Daher gibt es vereinfachte Lizenzen wie die FDL oder die CC-Lizenzen, die gezielt für Nicht-Software geschaffen wurden.
Bei diesen ist aber zu beachten, dass nicht alle unter ihnen die 4 Grundfreiheiten garantieren. So sind unter den CC-Lizenzen _nur die Varianten "BY" und "BY-SA"_ frei. Die FDL ist nur dann frei, wenn man _keinen Gebrauch von "Invariant Sections"_ macht.
Gesellschaftliche Aspekte -------------------------
Die 4 Grundfreiheiten haben jedoch bei Nicht-Software eine viel geringere Bedeutung. Wer die Software-Werkzeuge anderer Menschen kontrolliert, hat Macht über ihre Handlungsmöglichkeiten. Das ist bei anderen Werken nicht der Fall. Daher werden die 4 Grundfreiheiten nur für Software wirklich _gefordert_, während sie für Kunstwerke lediglich _anzuraten_ sind.
Eine interessante Grauzone sind Computerspiele und Intros/Demos. Diese sind zwar technisch gesehen Software, allerdings sind es keine Werkzeuge, sondern eher Kunstwerke. Die 4 Grundfreiheiten brauchen für diese Art von Software daher nicht gefordert werden, sondern sind lediglich _anzuraten_. Ein Computerspiel kann jedoch auch mehr als ein bloßer Zeitvertreib sein. Inzwischen sind viele Spiele professionelle Simulationswerkzeuge, die sogar in der Erziehung, Bildung und Ausbildung sinnvoll eingesetzt werden können. Für diese wichtigen Werkzeuge sind die 4 Grundfreiheiten daher wieder zu _fordern_, nicht nur anzuraten.
Auch bei Nicht-Software ist es schwer, eine klare Grenzen zu ziehen zwischen Werkzeug und Kunst, zwischen Nützlichem und Spielerei. So gibt es Spielfilme und -Serien, die nicht nur der Unterhaltung dienen, sondern extrem gut recherchiertes Hintergrundwissen transportieren. Sie können zu einem unerlässlichen Werkzeug im Schulunterricht und in der Ausbildung werden. Es ist nicht klar, wieviel Macht ein Film- Produzent oder ein Schulbuch-Verlag über das Bildungswesen hat, doch diese Macht wird im digitalen Zeitalter sicher steigen. Daher könnte man auch in diesem Bereich darüber nachdenken, die 4 Grundfreiheiten zu _fordern_ statt sie nur anzuraten.
Persönliche Aspekte -------------------
Es kann sehr im persönlichen Interesse der Autoren und Autorinnen liegen, die 4 Grundfreiheiten auch bei Nicht-Software zu wahren, selbst wenn hierzu keine gesellschaftliche Notwendigkeit besteht. Das gilt ganz besonders für Werke, die ehrenamtlich bzw. in der Freizeit entstehen.
Wer sich einmal im Bereich der Freien Software engagiert hat, weiß, dass die 4 Freiheiten nicht nur politische Forderungen sind. Sie sind ein Erfolgsrezept, eine solide Basis für dezentrale Kooperation. Jede Künstlerin und jeder Künstler sieht es gern, wenn das eigene Werk von vielen gelesen, gehört oder angeschaut wird. Doch es ist noch viel schöner, wenn sich dabei Gleichgesinnte finden, die das Werk nicht nur konsumieren, sondern es weiterentwickeln, oder sich auf andere Weise kreativ damit auseinander setzen.
Zudem steuert man immer gern etwas zu einem Pool bei, aus dem man sich auch selbst frei bedienen kann. Zumindest, solange es fair zugeht. Die Hauptsorge und der Motivationskiller schlechthin ist die Angst, andere könnten sich an den eigenen Werken materiell bereichern, ohne etwas zurückzugeben. Dies führt bei vielen zu überempfindlichen Reaktionen wie dem Verwenden einer CC-Lizenz mit NC-Klausel (keine kommerzielle Nutzung), die natürlich nicht mehr frei ist.
Vergleicht man diese Einstellung mit dem Erfolgsmodell der Freien Software, erkennt man schnell das Problem. Denn ein wichtiger Teil dieses Erfolges geht darauf zurück, dass sich die Freie-Software- Gemeinschaft eben _nicht_ von Software-Firmen abkapselte und alles Kommerzielle verteufelte. Es wurde stets klargestellt, dass es um Freiheit und nicht um Freibier geht. Jeder kommerzielle Mitspieler ist herzlich willkommen, solange er Freie Software produziert.
Wer mit einer NC-Klausel liebäugelt, sollte stattdessen lieber die SA-Klausel (Weitergabe unter gleichen Bedingungen) verwenden. Die FDL enthält solch einen Passus von Hause aus. Er sorgt dafür, dass jede Abwandlung des Werkes, auch jede kommerzielle, wieder in den Pool gelangt und von jedem frei weiterverwendet werden kann - ganz nach dem Vorbild der Freien Software. Die "bösen Firmen" haben dann die Wahl, ob sie ihr Werk der Gemeinschaft zurückgeben, oder mit dem Autoren andere Konditionen (z.B. finanzielle Vergütung) vereinbaren.
Das heißt, eine freie Lizenz schafft hier die gleiche Fairness, aber bietet mehr Verbreitungsmöglichkeiten um bekannt zu werden. Eine NC-Klausel hingegen bringt all diejenigen in Probleme, die das Werk in einem Blog mit Werbebannern zeigen, oder die eine große Sammlung freier Werke gegen einen aufgerundeten Rohlingpreis auf DVD vertreiben. Es dürfte kaum Interesse der Künstler sein, diese Art von "kommerzieller Nutzung" zu verbieten. Und dennoch tun es die meisten, obwohl sie diese Probleme mit einer freien Lizenz (CC-BY-SA oder FDL) elegant umgehen könnten.
Unveränderliche Werke ---------------------
Die Wahrung der 4 Grundfreiheiten ist bei fast allen Werke äußerst wünschenswert, sowohl für die Gesellschaft als auch für die Autorinnen und Autoren selbst. Mit einer Ausnahme: Es gibt Werke, die mit dem schöpfenden Individuum bzw. der schöpfenden Organisation besonders stark verbunden sind.
Dabei geht nicht um die natürliche Bindung, die jeder zu seinen Werken hat, sondern um eine besondere inhaltliche Bindung: eine Autorin, die ihre politischen Ansichten formuliert, ein Autor, der ein persönliches Erlebnis schildert, oder eine Organisation, die eine offizielle Erklärung herausgibt.
In solchen Fällen ist es notwendig, eine unfreie Lizenz zu verwenden, die Abänderungen des Werkes verbietet. Dennoch sollten alle übrigen Freiheiten gewahrt bleiben, um eine weite Verbreitung des Werkes zu ermöglichen. Insbesondere ist auch hier eine NC-Klausel äußerst kontraproduktiv. Stattdessen sollte einfach die CC-Lizenz "BY-ND" verwendet werden, oder die FDL mit einer das ganze Werk umspannenden "Invariant Section".
Ist die inhaltliche Bindung hingegen _nicht_ gegeben, so ist die bloße Sorge um "Verunstaltung" des Werkes _kein_ guter Grund für eine Unveränderlichkeits-Klausel. Denn es gibt künstlerische Freiheiten, die niemand seinen Mitmenschen verwehren darf: Karrikaturen, Parodien, Satire, und so weiter. Wer das nicht möchte, darf sein Werk nicht veröffentlichen. Und wer das nicht so eng sieht, benötigt auch keine Unveränderlichkeits-Klausel, und ist daher einer freien Lizenz besser beraten.
Das Versuch, Plagiate zu verhindern, ist eine weitere Fehlanwendung dieser Klausel. Denn Plagiate sind ohnehin verboten. Niemand darf ein abgeändertes Werk als das eigene ausgeben. Auch hier spricht nichts gegen eine freie Lizenz.

Ist nicht pauschal von der Hand zu weisen. Wir haben eine Menge professioneller Schreiber auf der Welt und wenig funktionierende Modelle für Qualitätstexte im CC-BY, CC-0 oder CC-BY-SA Bereich. Das ist ein großer Unterschied zu Software.
Es fehlt auch der Aspekt, dass einige Werke nicht in kleinen Schritten, sondern als großer Entwurf aus einem Kopf zu einem bedeutendem Werk wurden. Die großen Medien haben eine Tendenz weniger konforme Werke einzudampfen und sie sind Portale der Aufmerksamkeit. Die Erlaubniss hier kürzen oder Ändern zu dürfen, ist für mich schädlich für die Gesellschaft. Für mich ist noch völlig offen, wie Nicht-Software-Werke kategorisiert werden sollten und welche Bedingungen diese dann jeweils haben sollten, um der Gesellschaft maximal zu nutzen. Mein Verdacht ist, dass wir in den folgenden Kriterien suchen sollten: * Grade der Funktionalität * Nützlichkeit der Wiederverwendung in Teilen * Wie kann die Qualität vernünftig erhalten werden.

Mit deinen Anmerkungen, Bernhard, stimme ich weitgehend überein. Ergänzen will ich einen Punkt, den ich in dieser Diskussion für konstitutiv halte. Wir haben versucht, zwischen Freier Software und sonstigen Freien Inhalten anhand der gesellschaftlichen Relevanz ihrer Freiheit zu differenzieren. Ein weiteres Kriterium ist, dass es sich hier zum Teil um eine kategorial unterschiedliche Art von "Inhalten" handeln kann: Bei Nicht-Software werden wir es sehr oft mit "Werken" zu tun haben, bei denen Ästhetisches im Vordergrund steht, nicht Funktionales, Informatives oder Deskriptives; mit Kunst im weitesten Sinne also.
Kunst widerstrebt aber ihrer Funktionalisierung und lässt sich nicht anhand des gesellschaftlichen Nutzwerts ihrer Verfügbarkeit auf die eine oder andere Weise beurteilen. Kunst vermag Vergangenheit, Gegenwart und Zukunft in kritischer Distanz zu reflektieren - solange ihr eine völlig andere Freiheit zugestanden wird, die sich nicht durch die Prädikate "CC-BY" oder "CC-BY-NC" beschreiben lässt. Druck oder Zwang in Richtung diesen oder jenen Publikationsmodells schränken die Kunstfreiheit ein. Nartürlich können wir ein paar Aspekte der Debatte hier ansprechen und auch selbst etwas daran arbeiten, wichtig ist aber, dass wir uns der Grenzen unserer Ergebnisse bewusst sind.

Ein weiteres Kriterium ist, dass es sich hier zum Teil um eine kategorial unterschiedliche Art von "Inhalten" handeln kann: Bei Nicht-Software werden wir es sehr oft mit "Werken" zu tun haben, bei denen Ästhetisches im Vordergrund steht, nicht Funktionales, Informatives oder Deskriptives; mit Kunst im weitesten Sinne also.
Mit böser Zunge würde ich behaupten, dass dies auch bei vielen Softwareprojekten der Fall ist. ;-)
Und damit meine ich nicht nur Demos oder IOCCC-Beiträge, sondern auch übermäßig komplexe Software, die konzeptuell auf dem Stand von vor zwei Jahrzehnten ist.
Kunst widerstrebt aber ihrer Funktionalisierung und lässt sich nicht anhand des gesellschaftlichen Nutzwerts ihrer Verfügbarkeit auf die eine oder andere Weise beurteilen. Kunst vermag Vergangenheit, Gegenwart und Zukunft in kritischer Distanz zu reflektieren - solange ihr eine völlig andere Freiheit zugestanden wird, die sich nicht durch die Prädikate "CC-BY" oder "CC-BY-NC" beschreiben lässt. Nunja, bei Nicht-Software scheint die Frage der bezahlten Arbeit das einzige große Problem zu sein. Auf diesem Gebiet sind wir bei Freier Software zwar weiter, aber wirklich fundiert argumentieren können wir auch bei Software noch nicht.
Ich meine, weder die FSF noch die FSFE können konkrete Listen von erprobten, bewährten Geschäftsmodellen mit Freier Software vorweisen. Die allermeisten Unternehmen, die sich im Bereich der Freien Software engagieren, haben ihr Haupt-Einkommen immer noch im proprietären Bereich.
Das beste Geschäftsmodellen, was wir kennen, ist das Doppellizensierungs- Modell, und selbst das ist noch lange nicht perfektioniert, wie z.B. die Probleme der ExtJS-Bibliothek oder die der MySQL-Datenbank zeigen.

Unter allen Gruppierungen, die ich so kenne, ist die FSF/FSFE noch am besten aufgestellt, weil hier Expertise über die Lizenzen vorhanden ist, und weil das Wissen über den Freie-Software-Bereich ein sehr guter Indikator ist für das, was in den anderen Bereichen kommen wird.
Der Großteil der Leute im Creative-Commons-Umfeld hat keine Ahnung von Software, und ist sich der enormen Möglichkeiten der Kooperation gar nicht bewusst. Die meisten können sich unter Wiederverwendung nur Remixes vorstellen, und entsprechende Diskussionen laufen in völlig falsche Richtungen. Das ist auch klar, weil die entsprechden Werkzeuge entweder noch nicht geschaffen wurden, sauteuer sind, oder noch nicht benutzerfreundlich genug. Doch wer sich mit Software beschäftigt, der kennt die große Vielfalt an Möglichkeiten oder Inspiration, Kooperation und Wiederverwendung auf allen Ebenen.
Daher denke ich, dass die FSFE und nahe Organisationen die Lage immer noch am besten beurteilen können, und somit einer der besten Orte für eine solche Zukunftsdebatte ist.

Oder die Lizenz verlangt direkt einen seinen Verweis. BTW, ich dachte, sowas in der Art wäre eh in den freien Lizenzen verlangt, immerhin soll das abgewandelte Werk ja deutlich als Variation gekennzeichnet werden.

Es gibt sicher genug Leute, die bei diesem Versuch auf die Nase gefallen sind. Es ist deutlich schwieriger umzusetzen als beispiels- weise das Doppellizensierungs-Modell.
Damit will ich nicht sagen, dass diese Methode schlecht ist, sondern lediglich, dass sie noch niemand in Form eines ausgefertigten Konzeptes hingeschrieben hat. Was für Arten Dienstleistungen sind sinnvoll? Welche sollte man sich verkneifen? Wieviel sollte man "für lau" in die Software stecken, für welche Verbesserungen sollte man auf eine Finanzierung durch die Kunden warten?
Ich bin mir ziemlich sicher, dass erfahrene Leute darüber sowas wie ein "Best Practices" verfassen könnten. Aber hat das schonmal jemand getan?

Kommt drauf an. Handelt es sich um Spezialanfertigungen, so verlangen die Kunden nicht selten die gesamten Verwertungsrechte an der Software, oder zumindest ein sehr umfassendes Nutzungsrecht. In dem Fall hat der Kunde sogar deutlich mehr Rechte, als sie ihm beispielsweise die GPL verleihen würde.

Gibt es eine ähnliche kurze, akkurate Beschreibung des Dienstleistungs- Modells? Ich glaube, das ist gar nicht möglich. Fasst man sich kurz, wir die Beschreibung schwammig, macht man sie akkurat, wird sie lang. Wenn zwei Unternehmer sagen, sie operieren nach dem Dienstleistungs- Modell, kann es gut sein, dass sie völlig unterschiedliche Dinge damit meinen.
Wenn zudem die Verbreitung des Doppellizensierungs-Modells unerwünscht ist, dann sollten wir erst recht darauf hinarbeiten, dass die anderen Geschäftsmodelle allgemein besser verstanden werden.

Ich meine, weder die FSF noch die FSFE können konkrete Listen von erprobten, bewährten Geschäftsmodellen mit Freier Software vorweisen.
Ähm doch (sagt der Geschäftsführer eines 10 jährigen Unternehmens, welches sein ausschliesslich Geld mit Freier Software verdient hat.) Das Haupt-Geschäftsmodell heisst: Dienstleistung in verschiedenen Varianten.
Okay, das gibt es auch noch. Aber das ist sehr schwammig. Man baut irgendwie an einer Software und bietet irgendwelche Dienstleistungen an. Es gibt sicher genug Leute, die bei diesem Versuch auf die Nase gefallen sind. Es ist deutlich schwieriger umzusetzen als beispiels- weise das Doppellizensierungs-Modell.
Natürlich fallen viele Leute auf die Nase, wenn sie ein Unternehmen aufbauen wollen. Das kann Pech sein. Es kann sein, dass sie einen Fehler gemacht habe. Oder sie sind vielleicht sind sie vom Typ nicht so sehr Unternehmer wie Programmierer.
Freie Software ist kein Garant für ein erfolgreiches Unternehmen. Schau dir mal "What makes a Free Software company?" von Georg http://blogs.fsfe.org/greve/?p=260 an. Es hilft bei dieser Diskussion sehr zwischen Software-Model, Entwicklungs-Model und Geschäftsmodel zu unterscheiden.
Damit will ich nicht sagen, dass diese Methode schlecht ist, sondern lediglich, dass sie noch niemand in Form eines ausgefertigten Konzeptes hingeschrieben hat. Was für Arten Dienstleistungen sind sinnvoll? Welche sollte man sich verkneifen? Wieviel sollte man "für lau" in die Software stecken, für welche Verbesserungen sollte man auf eine Finanzierung durch die Kunden warten?
Man sollte den Kunden nicht unterschätzen. Auch der Kunde kann fordern, dass sein Ergebnis unter einer freien Lizenz steht. Ich kenne kenne ein (großes) Projekt wo viele verschieden (prop.) Lizenzen benutzt wurden. Dann sollte das Projekt weiter gegeben werden und ... da endete die Sache, da man festgestellt hatte, dass die verwendeten Lizenzen dieses z.T. nicht erlauben (und das war schon ein langwieriger Vorgang). Ergebnis: Im Vertrag steht beim naechsten Projekt: GPL (o.ae.) muss moeglich sein. Das ganze ist sicherlich kein "klassisches freies Projekt" noch ein typisches aber es zeigt, dass Kunden sich mehr Gedanken zu so einem Thema machen.

Dem stimme ich zu. Wenn Auftraggeber erst einmal verstanden haben, welche strategischen Vorteile Freie Software für sie hat, werden sie nicht freiwillig auf diese Vorteile verzichten.

Mir fehlt zum Beispiel die Abwägung der Nachteile für die Gesellschaft durch geringere Qualität, falls Journalisten immer weniger Zeit für die Recherche haben.

Es fehlt auch der Aspekt, dass einige Werke nicht in kleinen Schritten, sondern als großer Entwurf aus einem Kopf zu einem bedeutendem Werk wurden. Die großen Medien haben eine Tendenz weniger konforme Werke einzudampfen und sie sind Portale der Aufmerksamkeit. Die Erlaubniss hier kürzen oder Ändern zu dürfen, ist für mich schädlich für die Gesellschaft.
Bleiben wir doch mal realistisch: Die allermeisten Texte können eine Überarbeitung gut gebrauchen. Nicht umsonst gibt es im professionellen Bereich eine Trennung zwischen Autor und Lektor.
Kürzungen mit dem Ziel von "Konformität" oder "Harmonisierung" sind natürlich immer kritisch zu sehen. Ditto für die grotesken Auswüchse in der de-Wikipedia. Aber deshalb würde ich nicht das Kürzen an sich verteufeln oder gar in der Lizenz verbieten.
Außerdem sind es doch _gerade_ die "in einem Rutsch heruntergeschriebenen" Texte, die eine Kürzung am nötigsten haben! ... auch wenn man das als Autor nicht gern zugibt. Ich stolpere oft über Texte, die man um mindestens 50% kürzen könnte, ohne dass etwas fehlen würde - ja, die meisten Texte würden durch Kürzen sogar an Qualität _gewinnen_.
Das denke ich übrigens auch oft über eigene Texte von mir, wenn ich Wochen später noch einmal über sie stolpere.
Das Kürzen ist eines der wichtigsten Werkzeuge zur Steigerung der Qualität. Es zwingt einen, die Gedanken klarer zu fassen, auf den Punkt zu bringen und das Wesentliche herauszuarbeiten. Ein zu langer Text ist ein Text, der noch nicht ordentlich überarbeitet wurde.
Wenn ich eine zu lange E-Mail schreibe, entschuldige ich mich i.d.R. dafür, dass ich in Zeitnot war und daher keine Zeit zum Kürzen hatte. Gelaber ist manchmal nervender als heftige Tipp- und Rechtschreibfehler.

Hätten wir es mit freien Lizenzen zu tun, würden einfach beide Versionen im Netz kursieren, und zudem wäre die geänderte, weiter verbreitete Version gezwungen, auf die Änderungen hinzuweisen.
Will sagen, in einer "Freie-Software"-artigen Kultur wäre das kein Problem.
Für mich ist noch völlig offen, wie Nicht-Software-Werke kategorisiert werden sollten und welche Bedingungen diese dann jeweils haben sollten, um der Gesellschaft maximal zu nutzen.
Ist diese Kategorisierung wirklich wichtig? In der Software-Welt kommen wir doch auch gut ohne aus. Ich würde höchstens zwei grobe Unterteilungen vornehmen (bezahlt/ehrenamtlich und neutral/tiefpersönlich), wie bereits in meinem Text erläutert. Weitere Unterteilungen erscheinen mir nicht zielführend.
Mein Verdacht ist, dass wir in den folgenden Kriterien suchen sollten:
- Grade der Funktionalität
- Nützlichkeit der Wiederverwendung in Teilen
- Wie kann die Qualität vernünftig erhalten werden.
Ich persönlich finde alle 3 Punkte irrelevant.
* Funktionalität hängt von der Verwendung ab. Was für die einen eine nette Unterhaltung ist, kann für andere ein wichtiges Lehrmittel sein.
* Wiederverwendbarkeit in Teilen hängt davon ab, in welcher Form das Werk bereitgestellt wird. Ist es die originale Vektorgrafik oder nur eine gerasterte Version in niedriger Auflösung? Ist es ein gerendertes 3D-Video oder kommt man auch an 3D-Modelle heran? Ist es ein OGG, oder eine Menge von Samples mit Kompositions- Schema?
* Qualität ist zum Teil subjektiv.
Nimm zum Beispiel das Untermixen eines Beats in ein Musikstück. Für die einen ist es dadurch wertvoller geworden, da leichter tanzbar. Für die anderen ist es eine Verhunzung.
Oder nehmen wir Humor: Eine Satire kann das Original durchaus übertreffen, aber wer diese Art von Humor nicht mag, der wird dennoch das Original vorziehen.
Und was ist mit Übersetzungen? Die kommen nur selten an das Original heran, aber wer die Originalsprache nicht beherrscht, für den ist die Übersetzung unendlich viel mehr wert als das Original.
Außerdem: Wenn ein Werk unter freier Lizenz steht, dann bleibt die Qualität stets erhalten. Eine Variation kann besser oder schlechter sein. Doch ist sie tatsächlich schlechter, dann lässt man sie einfach links liegen und nimmt das Original.

Da du das schon mehrfach erwähnt hast: Kannst du das an einem konkreten Beispiel illustrieren?
Ich kann mir darunter immer noch nicht viel vorstellen.
Vielleicht hat das damit zu tun, dass ich Freie-Software-Projekte von klein auf gewohnt bin, und selbsterstellte Grafiken, Plakate, Texte etc. daher aus Gewohnheit genauso "frei" behandele. Ich stoße immer wieder mit Leuten zusammen, denen die Vorstellung unangenehm ist, ein kreatives Werk könnte woanders (und mit Anpassungen) wiederverwendet werden.
Ich habe zu dieser Denke überhaupt keinen Zugang. Mir erscheint das völlig abgedreht. Ich dachte immer, die Leute haben einfach noch keine gute Kooperation erlebt und sind daher in einer Art Einsiedler-Denkweise festgefahren.
Aber da du diesen Standpunkt verteidigt, obwohl du offenbar viel praktische Erfahrung mit der Kultur der Freien Software hast, würde mich einmal wirklich am konkreten Beispiel interessieren, woher dieses Unbehagen der Leute kommt.

Wir leben zumindest im Westen in einer Kultur des Geldverdienens und des Eigentums. Patente und Copyright usw. sind positiv besetzte Begriffe. Zudem haben auch Leute, die *nicht* mit etwas Geld verdienen wollen, eine panische Angst davor, übervorteilt zu werden oder vor Kontrollverlust am eigenen Werk (Beispiel von Bernhard).
Deshalb sind Werke unter CC-BY-SA, was etwa der freien SW entspricht, eher selten, meistens sind es CC-BY-NC-SA oder CC-BY-ND. ("non-commercial" und "no derivitives")
Für Leute, die nicht mit Freier SW oder etwas wie Wikipedia zu tun haben, sind Freie Inhalte eben eine suspekte Idee. Man kann versuchen, sie behutsam daran zu gewöhnen und dazu dienen diejenigen CC-Lizenzen, die nicht frei sind. Und wir müssen den Widerspruch leben, dass die freisten Lizenzen in einem gewissen Sinn auch unfrei sind, weil sie ja etwas vorschreiben. Wirklich frei ist nur Public Domain, aber das ist eigentlich "vogelfrei". weil solche Werke durch kleine Änderungen leicht re-proprietarisiert werden können.

So ein richtig gutes konkretes Beispiel müsste ich länger suchen gehen, um das aber nicht kalt werden zu lassen:
Die werbefinanzierten großen Portale verdienen aber jetzt schon an den Umsonstbeiträgen, z.B: der Blogger oder mir hier in der Liste. Das ist zum Beispiel irgendwie nicht ganz fair. (Ich muss mal nach dem Artikel suchen, in welchem das genauer beschrieben wurde. Der widerlegte auch das Argument die Aggregatoren seien auch für den kleinen Schreibenden gut, weil der doch Aufmerksamkeit bekäme oder gefunden würde. )

Die Intention des Schreiber, Ken Starks, wird durch selektive Wahrnehmung der Medien so verfälscht, dass er sie nicht mehr richtigstellen kann. In den Suchmaschinen kommt auch nur der erste Blogeintrag vorn vor, was zeigt, dass Kens Blog dadurch nicht plötzlich viel mehr gelesen wurde, sonst hätten deutlich mehr Schreiber bei den wütenden Kommentaren überall den neuen Eintrag vorgezeigt. Die richtige Geschichte, dass es sich hier wohl um eine Lehrerin handelte, welche vermutlich sogar richtig und engagiert gehandelt hat, scheint weitesgehend unbekannt.

Viele große Portal-Unternehmen wollen Geld verdienen und sind nicht auf mittelfristige Kooperation aus. Das gilt leider auch für viele Privatpersonen. Ich selbst glaube an das Gute im Menschen, aber ich muss anerkennen, dass nicht alle immer aus ehrbaren Motiven handeln. Manche handeln sogar trotz ehrbarer Motive schlecht.
Aber da du diesen Standpunkt verteidigt, obwohl du offenbar viel praktische Erfahrung mit der Kultur der Freien Software hast, würde mich einmal wirklich am konkreten Beispiel interessieren, woher dieses Unbehagen der Leute kommt.
Die Gefahr ist real dass die eigene Arbeit geschluckt wird, von jemanden der viel mehr Mittel und Aufmerksamkeit hat und sich die Arbeit einverleibt.
Das gibt es in der Software häufig, genau wie in anderen Lebensbereichen; in der Wissenschaft nennt sich das sogar Stiglers Gesetz (Stigler selbst sagt, das Gesetz käme von Herrn Robert Merton.) (http://de.wikipedia.org/wiki/Stiglers_Gesetz)

Vielen Dank, das ist ein sehr schönes Beispiel, und ich sehe nun die grundsätzliche Problematik.
Im konkreten Fall kann ich dir aber nicht zustimmen. Die "Medien" haben zwar versäumt, an der Fortsetzung der Geschichte dran zu bleiben, doch dafür haben sie etwas viel wichtigeres richtig gemacht:

Diese Tatsache macht einen fundamentalen Unterschied. Es ist eine große Errungenschaft des Webs, dass sich eine Kultur gebildet hat, in der Quellenangaben endlich zur Normalität gehören. So etwas erlebt man bei den Printmedien höchstens im wissenschaftlichen Bereich.
Das Verlinken löst zwar nicht alle Probleme, aber schwächt sie gravierend ab. In dem konkreten Fall war es der Original-Artikel des Autors, der in Google ganz vorn landete - das ist doch richtig und fair! Unfair wäre es, wenn irgendein Aggregator stattdessen an diese Position gekommen wäre.
Viel wichtiger ist aber die Tatsache, dass er dadurch die _Kontrolle_ über diesen meistverlinkten Artikel hat. Es wäre ein Leichtes gewesen, dem Artikel einen kurzen "Update"-Abschnitt voranzustellen, wo er die Sache mit wenigen Worten richtig stellt und auf seinen zweiten Artikel verlinkt.
Hätte er das noch am gleichen Tag getan (die Reaktionen auf seinen Artikel kamen ja sehr schnell), dann hätte er damit noch sehr viele Leute erreichen können. Und als netter Nebeneffekt hätte das seinen zweiten Artikel in Google auch weiter nach oben gepusht. Sein zweiter Artikel wäre dadurch sicher auch vielen Bloggern aufgefallen, die es dann weiter verbreitet hätten.
Doch von dieser großartigen Möglichkeit, die es im Web im Gegensatz zum Print gottseidank gibt, hat er leider keinen Gebrauch gemacht.
Ich will damit nicht die Medien in Schutz nehmen. "Große Geschichten und kleine Dementi", das ist in der Tat eine Schweinerei. Doch solange sie gut sichtbar auf die Quellen verlinken, hält sich das alles in Grenzen.
Genau das lässt mich übrigens auch die vielen, vielen Fehler in Fefes Blog verzeihen: Er gibt stets seine Quellen an.

Stimmt schon.
Aber die Änderungen und Kürzungen - besonders im Fall Fahrenheit 451 - waren teilweise politisch oder religiös motiviert. Und so mancher Lektor hat auch ein wichtiges Werk erst garnicht als solches erkannt oder es kaputtredigiert. Na klar, ich weiss nicht, welches Werk sich als ein solches erweisen wird, mir ging es darum das Problem zu erläutern, dass ein großer Wurf eben manchmal aus einem einzigen Kopf kommt und hier der remixende Schwarm alles verderben würde.

Ja ich denke das Einordnung und sprechen über die Details ist wichtig. Das ist mir aufgegangen, als ich den Schaden des Zusammenziehens der Konzepte verstanden habe. Gegen die Gehirnwäsche eines politischen Kampbegriffes wie "geistiges Eigentum" hilft aus meiner Sicht nur das Gegenteil.
Mein Verdacht ist, dass wir in den folgenden Kriterien suchen sollten:

- Nützlichkeit der Wiederverwendung in Teilen
- Wie kann die Qualität vernünftig erhalten werden.
Ich persönlich finde alle 3 Punkte irrelevant.
- Funktionalität hängt von der Verwendung ab. Was für die einen
eine nette Unterhaltung ist, kann für andere ein wichtiges Lehrmittel sein.
Wenn es um die Einigung der Gesellschaft um Kriterien geht, dann brauchen wir eine Vorstellung des Gesamtnutzens für die Gesellschaft. Und da sind manche Werke einfach nützlicher als andere, denke ich. Klar es gibt Ausnahmen und individuelle Erfahrungen, aber bei einer Einigung auf der gesamten Gesellschaft können die nicht immer berücksichtigt werden.
- Wiederverwendbarkeit in Teilen hängt davon ab, in welcher Form
das Werk bereitgestellt wird. Ist es die originale Vektorgrafik oder nur eine gerasterte Version in niedriger Auflösung? Ist es ein gerendertes 3D-Video oder kommt man auch an 3D-Modelle heran? Ist es ein OGG, oder eine Menge von Samples mit Kompositions- Schema?
Manche Dinge sind aber wiederverwendbarer als andere, auch in kleinen Teilen.
- Qualität ist zum Teil subjektiv.
Nimm zum Beispiel das Untermixen eines Beats in ein Musikstück. Für die einen ist es dadurch wertvoller geworden, da leichter tanzbar. Für die anderen ist es eine Verhunzung. Oder nehmen wir Humor: Eine Satire kann das Original durchaus übertreffen, aber wer diese Art von Humor nicht mag, der wird dennoch das Original vorziehen.
Und was ist mit Übersetzungen? Die kommen nur selten an das Original heran, aber wer die Originalsprache nicht beherrscht, für den ist die Übersetzung unendlich viel mehr wert als das Original.
Mit dem Punkt meinte ich, dass das ganze System so gestaltet werden muss, dass die durchschnittliche Chance auf Werke mit hoher Qualität gleich bleibt oder steigt. Qualität zu messen ist da natürlich eine zentrale Frage.
Außerdem: Wenn ein Werk unter freier Lizenz steht, dann bleibt die Qualität stets erhalten. Eine Variation kann besser oder schlechter sein. Doch ist sie tatsächlich schlechter, dann lässt man sie einfach links liegen und nimmt das Original.
Das bezweifele ich, da viele bessere Originale einfach im Meer nicht gefunden werden. Da nützt die prinzipielle Erreichbarkeit wenig.

Das hinzufügen von irrelevanten Details kann die Begriffe aber genauso verwaschen.
Zum Beispiel würde es der allgemeinen Diskussion sehr schaden, wenn wir beispielsweise Software nicht in frei/proprietär unterteilen würden, sondern in 'zig Abstufungen frei / halbfrei / wenigfrei / nurnocheinbisschenfrei / fastproprietär / kostenlosproprietär / richtigproprietär.
Und genauso denke ich auch über die unnötig vielen Abstufungen in den CC-Lizenzen.

Das ist klar. Aber dennoch werden die Möglichkeiten bei weitem nicht ausgeschöpft.
Außer vielleicht bei Software, doch womöglich nicht einmal da aufgrund des NIH-Syndroms.

Das sehe ich mehr als Problem der Suchmaschinen und der Archivierung an, nicht als Lizenzproblem.
