Für meist DRM freie CDs gilt der Erschöpfungsgrundsatz, es ist also nicht möglich den Weiterverkauf des Datenträgers einzuschränken. Für Download-Musik gilt der Erschöpfungsgrundsatz meines Wissens nicht da eine Datei unkörperlich ist.

Meiner Meinung nach sollten die vier Freiheiten auch für Musik (insbesondere computergenerierte Musik) gelten.
1. Die Freiheit, das Musikstück für jeden Zweck abzuspielen. 2. Die Freiheit, es an seine Bedürfnisse anzupassen oder Remixe/Edits zu erstellen. 3. Die Freiheit, Kopien weiterzugeben und damit seinen Mitmenschen zu helfen. 4. Die Freiheit, veränderte Kopien weiterzugeben, sodass die gesamte Gesellschaft profitiert.
Insbesonder muss für freie computergenerierte Musik der Quellcode (beispielsweise der Lilypond-Quellcode) mitgeliefert werden. Auch die benötigte Software muss frei sein. Leider sind viele Programme wie VOCALOID unfrei. Deren Datenformate haben den selben Nachteil wie das Word Format.
Fazit: Es ist nicht das gute Recht von Herstellern, uns einzuschränken. Auch wenn kein DRM verwendet wird, gibt es oft weitere Einschränkungen die nicht akzeptabel sind.

Obwohl Computerprogramme nach deutschem Recht "Sprachwerke" sind, weisen sie gewisse Eigentümlichkeiten gegenüber Musik, Film, Bildern und Literatur (einschließlich Sachliteratur) auf.
Im Bemühen, Lizenzen etwas zu standardisieren, hat CC eine gewisse Anzahl von Lizenzen entwickelt. Nur CC-BY und CC-BY-SA (als Copyleft-Lizenz) entsprechen den o.a. Freiheitsforderungen. Nicht einmal die GNU-Lizenz für freie Dokumentation (GNU FDL) entspricht diesen Bedingungen, denn sie erlaubt dem Urheber, für bestimmte Abschnitte die Modifikation zu untersagen (weshalb sie Debian nicht frei genug ist, sofern von der Urheber von dieser Möglichkeit Gebrauch gemacht hat).
Die philosophische und politische Frage ist, ob wir die oben angegebenen Bedingungen außerhalb des Softwarebereiches für maßgeblich erklären sollten.
Eine praktische Frage ist, wie "Artwork" (Musik, Bilder, Texte, Bewegtbilder) lizenziert sein muss, um in Freier Software Verwendung finden zu können.
Insbesonder muss für freie computergenerierte Musik der Quellcode (beispielsweise der Lilypond-Quellcode) mitgeliefert werden.
Das ist eine Forderung, deren Berechtigung mir nachvollziehbar erscheint (unter dem Aspekt des "study").

Nun, wenn ich den Vorposter richtig verstanden habe, will er die vier Freiheiten auch auf andere Werke als Software angewandt wissen. Dies entspricht auch in etwa der Policy von Debian für Main, wonach auch Dokumentation, Artwork, Töne und Musik etc. frei sein müssen (dafür mussten sie dann konsequenterweise sogar ihren Swirl (Logo) freigeben).
Die FSF unterscheidet zwischen Software und Dokumentation und will nicht alle vier Freiheiten auch auf letztere notwendigerweise angewandt wissen, indem sie dem Autor erlaubt, Teile seines Werkes von der Veränderbarkeit auszunehmen.
Beide Standpunkte sind IMO gut vertretbar. Wer die Anwendbarkeit aller vier Freiheiten auch für andere Werke fordert, liegt damit eher auf der Linie von Debian als der der FSF.
Dies wollte ich nur klarstellen und darauf hinweisen, dass sowohl CC als auch FSF bereit sind, dem Bedürfnis von Künstlern und Autoren nach gewissen Beschränkungen der Freiheit der Nutzer (Konsumenten) nachzukommen, sodass die Frage zu prüfen ist, ob sich Software und andere Werke nicht wesentlich unterscheiden und gegebenenfalls wodurch und welche Konsequenzen dies haben sollte.

Ich stimme zu, das Software und andere Werke sich unterscheiden. Ich persönlich nehme für eigenständige Dokumentationen (Installationsanleitung, Handbuch etc.) CC-BY-SA, weil diese Lizenz der GPL "am ähnlichsten" ist. Sie ist für den Lizenznehmer auch transparenter als die GNU FDL, weil er dort nicht jedesmal nachsehen muss, auf die Veränderbarkeit einzelner Teile und gegebenenfalls welcher Teile vom Autor ausgeschlossen wurde.

Zum Beispiel könnte jemand daher kommen, und einenen technischen Standard wie die HTML-Spezifikation automatisiert zu interpretieren. Dann könnte man zwar argumentieren, dieser Interpreter sei ja die eigentliche Software, aber mit dieser Argumentation wäre auch jedes Perl-Script keine Software mehr, denn die "eigentliche Software" wäre ja dann der Perl-Interpreter.
Weitere Beispiele finden sich in der Demo-Szene, wo in Echtzeit hohe Kunst errechnet wird. Wo endet die Abspiel-Software, wo beginnt die Musik- und Bildgestaltung?
Zudem wird in der Software-Entwicklung doch immer viel Wert darauf gelegt, dass Code sich selbst gut dokumentieren soll. Das geht bis hin zum Literate Programming, wo das Handbuch nicht neben der Software existiert - nein, das Handbuch _ist_ die Software.
Ich sehe daher Software eher als Mischform an, die sehr viele Charakteristika von Dokumenten, Kunstwerken, Anleitungen, etc. miteinander vereint.
Daher lassen sich in meinen Augen sehr viele Argumentationen aus der Softwarewelt auch auf Musik, etc. übertragen.
Nur als Beispiel: Warum ist eine "Non-Commercial"-Lizenz wie CC-BY-NC im Software-Bereich verpönt? Weil es viel geschickter ist, die Industrie mit ins Boot zu holen. Nun könnte man entgegnen, dass die Musik-Industrie eine viel "feindlichere" Umgebung ist als die Software-Industrie, zumindest was freie Werke angeht. Aber als Freie Software entstanden ist, war die Software-Industrie genauso "feindlich" wie die heutige Musik- und Filmindustrie. Dennoch hat es sich als sehr geschickt herausgestellt, ihnen die Hand zu reichen und sie Teil der Bewegung werden zu lassen - solange sie sich an die Spielregeln halten. Das heißt, auch strategisch gesehen ist sinnvoll, Künstlern für ihre freien Werke eher CC-*-SA statt CC-*-NC anzuraten. Solange der CC-Pool aber voller NC-Werke ist, wird sich keine neue Musik/Film/Buch-Industrie herausbilden, die freien Werken wohlgesonnen ist.
In diesem Zusammenhang bin ich auch echt froh, dass Wikipedia und ähnliche Projekte sich nicht zur generellen NC-Lizensierung hinreißen ließen.
Ich denke daher, dass es verkehrt ist, Software gegenüber allen anderen Arten von Werken scharf abzugrenzen. Stattdessen sollte man viel eher die Gemeinsamkeiten betonen - vorallem, was andere Industrien von dem Erfolgsmodell der Freien Software lernen können.
Dennoch verstehe ich, dass man manchmal eine Abgrenzung machen will - etwa für politische Forderungen, dass bestimmte Dinge _immer_ frei sein sollen.

Sehe ich auch so. Oft bringt es nichts in einem Kinofilm Minute 3 bis 6 zu verändern. Besonders nicht ohne die gleichen Schauspieler, Kameras, usw. Der Funktionalitätswert ist auch Gering.

Weniger harte Forderungen würde ich an Unterhaltung stellen, aber hierzu zählen für mich nicht nur die neusten Kinofilme, sondern auch die meisten Computerspiele, obwohl diese ganz klar Software sind.
Sehe ich auch so. Oft bringt es nichts in einem Kinofilm Minute 3 bis 6 zu verändern. Besonders nicht ohne die gleichen Schauspieler, Kameras, usw. Der Funktionalitätswert ist auch Gering.

Vor einigen Monaten habe ich mir einen PC mit vorinstallierten Trisquel GNU/Linux gekauft. Das Spiel Battle for Wesnoth ist Trisquel enthalten. Die Musik von Wesnoth steht unter der GNU GPL, der selben Lizenz unter der auch die Software verfügbar ist. Die FSF verlangt jedoch nicht dass der Quellcode von Musik (sofern vorhanden) einer freien Distribution enthalten ist. Dagegen ist die Definition von Free Cultural Works(http://freedomdefined.org/Definition) strenger.
