ich habe in meiner Freizeit ein freies Softwareprodukt entwickelt und stelle es der kommerziellen Nutzung in einem Unternehmen, in dem ich auch beschäftigt bin, zur Verfügung. Daraufhin entschied sich dieses Unternehmen mich in der Entwicklung dieser Software zu unterstützen, indem wir einen Teil unserer bezahlten Arbeitszeit für die Entwicklung dieser Software verwenden dürfen.
Jetzt stellt sich für mich die Frage, ob es nicht sinnvoll wäre sich rechtlich dahingehend abzusichern, dass die Verwertungsrechte am geschriebenen Code dahingehend eingeschränkt werden, dass dieser wieder unter den Bedingungen der GPLv3 veröffentlicht werden muss. Denn rein theoretisch treten wir laut Vertrag unsere Verwertungsrechte an das Unternehmen ab. Gibt es dazu Empfehlungen/Musterformulare?

Hallo, wir haben hier Rechtsanwälte auf der Liste und die sind sicher kompetenter als ich auf diesem Gebiet aber generell kann man nur sagen:
Bitte last euch alles schriftlich geben, auch wenn ihr ein tolles Verhältnis zum Chef habt. Es muss klar sein, *wer* das Programm "erfunden" hat und unter welcher Lizenz es an die Firma weitergegeben wurde, schreibt hin welche Gegenleistung ihr bekommt etc.
Das ganze dient zur Klärung der Situation, denn wenn der Chef wechselt, oder Dinge anders verstanden hat oder ..... hat man etwas aus was man sich beziehen kann.

Ja, ich denke auch, dass ausdrücklich etwas vereinbart werden sollte. Erst müßt Ihr Euch sachlich einigen und dass dann schriftlich festhalten, wenn es Klärungsbedarf gibt wird die juristische Beratung des Unternehmens sicherlich helfen.
