in unserer letzten Pressemitteilung zur EU Copyright Directive sagt Alexander Sander in unser aller Namen:
"Die Ausnahme von Entwicklungsplattformen für quelloffene Software in dieser Richtlinie ist entscheidend, um die Entwicklung Freier Software in Europa gesund, stabil und lebendig zu halten."
Wie kommen wir denn zu dem Schluss? Wir können uns wohl eher bei Microsoft für die gute Lobby-Arbeit bedanken, dass sie eine Ausnahme für GitHub erwirkt haben und der Kauf von GitHub dann wohl doch etwas Gutes hatte:
"Open source software developing and sharing platforms like GitHub should remain out of scope." [1]
Letztendlich hilft uns das gar nichts, da andere Open-Source-Plattformen, wie z.B. Mastodon-Instanzen, dann Uploadfilter installieren dürfen, um nicht vor Gericht zu landen. Ich bin kein Jurist und kann in der Directive keinen Abschnitt finden, der das Gegenteil beinhaltet. Kann unser Legal Team uns darüber aufklären, was
"Providers of services such as open source software development and sharing platforms,[...] are also excluded from this definition" [2]
in der "EU Copyright Directive" für Freie und Open Source-Software Projekte genau bedeutet, die keine "software development and sharing platform" sind?
Weiter sagt Alexander in unser aller Namen:
"Wir fordern die Europäische Kommission daher auf, die Verbreitung von Uploadfiltern unter freien Software Lizenzen zu fördern, auch durch finanzielle Unterstützung [...]"
Nein, das tue ich nicht! Ich fordere die FSFE auf, dass wir uns *gegen* Uploadfilter und Zensur einsetzen. Denn es ist egal, ob die Zensurmaschine eine offene oder geschlossene Lizenz hat, letztendlich dient sie der Zensur und Zensur gehört abgeschafft. Und wir haben bereits genug Freie Software, die zur Unterdrückung und Ausspähung der Privatsphäre im Überwachungskapitalismus (surveillance capitalism), genutzt wird.
Ich hoffe, dass wir unsere Ziele, die wir in dieser Pressemitteilung formuliert haben, nochmals überdenken.

Das Europäische Parlament hat die umstrittene Urheberrechtsrichtlinie mit einer Mehrheit von 348 Stimmen dafür, 274 dagegen und 36 Enthaltungen angenommen. Mit dieser Abstimmung wird eine jahrelangen Debatte beendet. Angeheizte Diskussionen um die Einführung der umstrittenen Uploadfilter mündeten in Protesten, an denen sich zehntausende Menschen in ganz Europa beteiligt haben. Durch einen Änderungsantrag, der im letzten Moment vor der Abstimmung im September und den folgenden Trilogverhandlungen eingebracht wurde, konnte das EU- Parlament zumindest eine Ausnahmereglung für Freie Software einführen.
"Wir sind froh, dass wir bei vielen politischen Entscheidungsträgern das Bewusstsein und das Verständnis dafür wecken konnten, was die Softwareentwicklung in Europa heutzutage antreibt. Die Ausnahme von Entwicklungsplattformen für quelloffene Software in dieser Richtlinie ist entscheidend, um die Entwicklung Freier Software in Europa gesund, stabil und lebendig zu halten. Dennoch sind wir enttäuscht darüber, dass die EU die Gelegenheit verpasst hat, das Urheberrecht in angemessenem Umfang zu erneuern. Da Uploadfilter nun verpflichtend eingeführt werden müssen, erwarten wir von der Europäische Kommission, Monopole von Großkonzernen zu verhindern, die Anbieter solcher Filter sind. Wir fordern die Europäische Kommission daher auf, die Verbreitung von Uploadfiltern unter freien Software Lizenzen zu fördern, auch durch finanzielle Unterstützung, beispielsweise im Rahmen der Forschungsprogramme Horizon2020 und Horizon Europe.“ erklärt Alexander Sander, Policy Manager der Free Software Foundation Europe.
Die Free Software Foundation Europe und das Open Forum Europe starteten 2017 die Kampagne " Save Code Share [1] ". Mehr als 14.000 Menschen unterstützten unsere Forderung mit einem offenen Brief, in dem die EU- Gesetzgeber aufgefordert werden, die Möglichkeit zu erhalten, Software gemeinsam online zu entwickeln.

Das wäre insgesamt meine Erwartungshaltung an ein nächstes Lobbying-Ziel, falls sich dieser Irrsinn nicht verhindern läßt - Regulierung von Filtern. Mich stört an dieser Diskussion seit Wochen gewaltig, daß Leute dort auftreten, die einerseits ganz massiv gegen Uploadfilter argumentieren, andererseits aber YouTube nutzen und unterstützen (die ein sehr intransparentes und mehr als diskutables Filtering seit langer Zeit schon nutzen).
Konkret daher Regeln für Filter:
- Filter müssen Software Libre und reviewbar sein.
- Filter müssen transparent betrieben werden (anders als ContentID). Stets einsehbar, was warum geblockt wurde, klare Warteschlange, Ansprechpartner, Beschwerdeprozess bei Organisationen, die solche Werkzeuge verwenden, Beschwerdeprozess (analog Datenschutz) über Organisationen, die sich nicht an diesen Prozess halten oder nicht innerhalb der Zeit reagieren. Geblockte Elemente und alle Kommunikation an und zu Filterung müssen über einen definierten langen Zeitraum revisionssicher vorgehalten werden, damit nachvollziehbar ist, was passiert.
- DSGVO-konformer Betrieb wird vorausgesetzt, mit allem, was daran hängt.
- Extrem hohe Hürden dafür, solche Technologie (von Firmen wie YouTube als closed-source oder gar von denen betriebene Lösung) einzukaufen oder fremd hosten zu lassen.
Sprich:
- Priorität 1: Upload-Filter mit allen Kräften verhindern.
- Priorität 2: Upload-Filter (zukünftige und auch gegenwärtige) so derb und schmerzhaft regulieren, daß sie eigentlich niemand einsetzen will. Laut der RiLi-Befürworter ist das *vorrangige* Ziel ja ohnehin der Erwerb von Pauschal-Lizenzen und nicht Filterung. ;)
Möglich, daß ich damit komplett falsch liege. Kommentare gern.

Kein Widerspruch.
Meine Frage ist eher: Was tun wir, wenn wir Zensur und Uploadfilter nicht verhindern können, bzw. - siehe eben ContentID - solche Infrastruktur teilweise schon am Start haben und die nicht wegbekommen? Für mich ging es hier eher um Schadensbegrenzung bzw. Plan B.

Übrigens sind automatische Filtersystem, welche große Videoplattformen heute schon einsetzen, keine Zensur im Sinne des Grundgesetzes. Problematisch wird allerdings, wenn der Staat bestimmte Inhalte über das gleiche System anmelden kanm, um beispielsweise Schreckensvideos in der Verbreitung zu hindern. Hier gibt es Missbrauchspotential. Die Herausforderung besteht jedoch in der Geschwindigkeit der Verbreitung, insofern wird es schon irgendwelche technischen System geben müssen, um mitzuhelfen, dass Nachzensur überhaupt wirken kann.
Politisch ist das Problem der Dominianz der großen Plattformen auch nicht direkt zu lösen, es sind schließlich die Nutzenden, welche die Plattformen mit ihrer Aufmerksamkeit bezahlen (und dem anschließenden Kaufen der beworbenen Produkte auch finanzieren). Das Problem an der Form der aktuellen EU-Urheberrichtline ist, dass die Geschichte noch schwerer machen. :(

Letztlich sind freie Rede und freie Software meiner Meinung nach untrennbar miteinander verbunden. Wir können das eine nicht ohne das andere haben. Deswegen ist eine Zensurmaschine aus Freier Software ein Widerspruch in sich.

Und Michael hat parallel gut erklärt, warum Vorzensur stark problematisch und Nachzensur dageben rechtsstaatlich sogar geboten ist. (Danke für die Erklärungen, Michael!)

Wie Du an dem Verlauf der Debatte sehen kannst, verstehen viele Menschen nicht, warum die nun sehr wahrscheinlichen Filter ein großes Problem darstellen. Das Verständnis wächst erst damit, wie die Software auf die Gesellschaft einwirkt. Das zu erklären - gerade in diesem wichtigen Fall - halte ich für eine Aufgabe der FSFE, für die wir auch gut geeignet sind, weil wir lange an der Schnittstelle von Technik, Gesellschaft und Politik arbeiten.

"Zensur" im Sinne des Artikel 5 Absatz 1 des Grundgesetzes (GG) [0] ("Eine Zensur findet nicht statt.") ist die sogenannte Vorzensur, weshalb Zensur allgemein in diesem Sinne verstanden wird.
Selbstverständlich kennt das deutsche Strafrecht gleichwohl sogenannte "Äußerungsdelikte". Die in Artikel 5 Absatz 1 GG gewährte Freiheit ist eben eine beschränkte, wie sich aus Artikel 5 Absatz 2 GG ergibt.
Es kann gegen gewisse Äußerungen repressiv, allerdings mit allen rechtstaatlichen Garantien und "im Lichte der grundgesetzlich geschützten Meinungsfreiheit", vorgegangen werden.
Demgegenüber wirkt die (Vor-)Zensur präventiv. Und genau das sollte nach dem Grundgesetz mit sehr guten Gründen verhindert werden.
Die Sache wird auch nicht dadurch besser, sondern unter rechtstaatlichen Gesichtspunkten viel schlimmer, wenn der Staat die Rolle des (Vor-)Zensors nicht selbst wahrnimmt, sondern an private Dritte auslagert
Eine technische Einrichtung kann des Weiteren nicht nur nach Zweck beurteilt werden, den sie erfüllen soll, sondern es ist auch ihr (Missbrauchs-)Potential in die Folgenabschätzung einzubeziehen.

weil das die Begründung der Leute ist , welche die Richtline ausgehandelt und geschrieben haben. Das haben sie nach und in Kontakt mit Personen von der FSFE getan.

Das ist auch meine Einschätzung: Es werden nur bestimmte Ausnahmen zur Erstellung von Freier Software und Teilen von Codes gemacht. Und logischerweise im Hauptteil alle Dienste gemeint, auch diejenigen, welche mit Freier Software oder dezentral angeboten werden. Es kann nur so sein, sonst wäre es ja zu einfach die Regeln zu umgehen.
Ich fordere die FSFE auf, dass wir uns *gegen* Uploadfilter und Zensur einsetzen. Denn es ist egal, ob die Zensurmaschine eine offene oder geschlossene Lizenz hat
Wie ich bereits am 15.3. schrieb auf dieser Liste schrieb, warnen wir vor den Gefahren der Filter und einer übertriebenen oder automatischen Kontrolle. Beim Fordern müssen wir jedoch die Überlegung anstellen, was wir der jeweiligen Forderung bewirken können.
Da die Mehrheit (der Abgeordneten) in Europa nun defakto zwingend Uploadfilter beschlossen hat, ist es berechtigt und gut zu fragen, wie wir die befürchteten negativen Wirkungen teilweise oder ganz verhindern können. Die Filtersoftware zu haben und deren Trainings- und Anmeldedaten, würde eine zumindest ansatzweise Begleitung der staatlichen und privatwirtschaftlichen Filterungen ermöglichen. Die Pressemitteilung könnte an dem Punkt sicherlich ausführlicher sein. Andererseits entstehen viele Pressemitteilungen unter Zeitdruck.
Meiner Ansicht nach bietet die anstehende Europawahl eine gute Gelegenheit den MEPs zu zeigen, wie wichtig das Thema vielen ist. Denn nur durch politischen Druck auf die Parteien in ganz Europa kann hier früher wieder eine Gesetzesinitiative angestoßen werden. Wenn sich die Parteien hier wirklich verschätzt haben - wie ich vermute - dann wäre es wichtig, dass sie den politische Preis des Machtverlustes dafür bezahlen.
