München, 6. Dezember 2007, Am Freitag, dem 7.12. 2007, wird im Europäischen Patentamt (EPA) in München über den Einspruch des FFII (und anderer) [1] gegen Amazons "Geschenk-Patent" (einen Abkömmling des berüchtigten One-Click-Patents [2]) verhandelt. Dabei handelt es sich um ein klassisches Softwarepatent, dass es gemäß dem Europäischen Patentübereinkommen in Europa gar nicht geben sollte, das aber (wie tausende anderer [3]) dennoch vom EPA erteilt wurde. Laut vorläufiger Entscheidung [4] wird das EPA dieses Patent erfreulicherweise für ungültig erklären -- allerdings nicht, weil es sich um einen nicht patentfähigen Gegenstand (eben reine Software) handelt, sondern bloß mangels fehlender erfinderischer Tätigkeit, während die angebliche Patentierbarkeit derartiger "Erfindungen" sogar explizit bekräftigt wird.
Softwarepatente sind schädlich für Wirtschaft und Gesellschaft [5], denn sie
* behindern Innovation und Wettbewerb, * gefährden die freie informationelle Infrastruktur, * sind vom Staat verschenkte Monopole, * nützen nur Patentanwälten und Patenttrollen.
Wir wehren uns gegen die Praxis des EPA, Softwarepatente zu erteilen, und gegen die Bemühungen von Bundesregierung und Europäischer Kommission, Softwarepatente nun durch institutionelle Reformen und die Entmachtung nationaler Gerichte [6] durchzusetzen.
Daher rufen wir auf zur
