Petition zur Rettung der Privatkopie
Unter dem Slogan "Rettet die Privatkopie!" legt eine Online-Initiative, zu der sich erstmals zahlreiche Netzorganisationen wie Bundestux, der Chaos Computer Club, Fitug, Foebud, der Virtuelle Ortsverein der SPD oder die Online-Plattform Odem zusammengeschlossen haben, Protest gegen die geplante Urheberrechtsnovelle des Bundesjustizministeriums ein. Hauptorganisator ist der Berliner Vernetzungsverein mikro, der seit Ende vergangenen Jahres an neuen Formaten für Online-Kampagnen arbeitet. Zu den renommierten Erstunterzeichnern der Petition geho"ren Abgeordnete auf Bundes- und La"nderebene genauso wie Informatikprofessoren und Netzwissenschaftler.

Ich kann mir nur schwer vorstellen, dass die FSF Europe sich für die "Rettung der Privatkopie" einsetzt. Die Überschrift ist aus Sicht der Freie Software Gemeinschaft extrem unglücklich.

Hm, warum genau? Wenn ich das richtig verstanden habe, dann geht es doch um sowas ähnliches wie DCMA, oder? Und das ist doch schon eine Bedrohung für FS, oder? Aber vielleicht hab ich auch was durcheinandergeworfen. Bitte um Aufklärung!

Nun, mein Wortlaut war zugegebenermaßen etwas ungeschickt, doch geht es uns (der Gemeinschaft der Entwickler Freier Software) doch wohl eher darum, dass _jeder_, ob Privatperson oder nicht, bestimmte Rechte hat. Hier lediglich die "Privatkopie" als einzigen Aspekt herauszugreifen, halte ich daher für weniger gut, denn wenn ich hier nicht ganz daneben liege, wäre dies alleine noch keine Bedrohung für Freie Software. Es wäre daher wünschenswert, wenn diese Petition nicht schon im Titel auf diese eine Sache festlegen würde.

Aus dem Grund, dass die Petition darauf fixiert ist und dies eigentlich außerhalb des Tätigkeitsfeldes der FSF Europe liegt, würde es mich wundern, wenn die FSF Europe hier offizielle Unterstützung bekunden würde. Ich befürchte, in meinem ursprünglichen Posting kam es so rüber, als würde ich annehmen, die FSF Europe sei gegen Privatkopien. ;-)

Also ich muss gestehen, dass ich mich mit den näheren Details des Gesetzes nicht beschäftigt habe, aber:
Sollte darin irgendetwas stehen, dass das Umgehen eines Kopierschutzes verbietet (woran ich mich zu erinnern glaube), dann ist das sehr wohl eine Gefahr für FS, weil dann z.B. neue Multimediastandards mit Kopierschutz nicht mehr mit FS abgespielt werden können. Es gab doch den Fall schonmal bei DVDs, wenn ich mich nicht irre, dass derejenige, der den DVD-Standard reverse-engeneert hatte um einen Linux-Treiber zu bauen, dafür mittels DMCA verknackt wurde, oder?

Er lebte zwar weder in den USA noch hatte er persönlich das Reverse-Engineering durchgeführt, aber das macht das ganze ja eigentlich nur um so erschreckender.
Laut dem entsprechenden Telepolis-Artikekl steht darin durchaus etwas über das Umgehen eines Kopierschutzes, aber weiterhin heißt es:
"Der vorgeschlagene Rechtsschutz, der auch die Entfernung von digitalen Wasserzeichen oder anderen Informationen über die Rechtewahrnehmung beinhaltet, bezieht sich laut Begründung allerdings nicht auf den Bereich der Computerprogramme. Denn mit dieser Ausweitung gäbe es erhebliche Probleme im Verhältnis zu § 69 des bestehenden Urheberrechtsgesetzes, der die Erstellung einer Sicherheitskopie und die Dekompilierung von Software-Code gestattet, fürchten die Verfasser des Entwurfs."

Es steht wohl ausser Frage das Gesetze wie die DMCA eine große Gefahr für Freie Software darstellen und das auch so ziemlich jeder Befürworter von Freier Software _grundsätzlich_ eine Petition die sich gegen so ein Gesetz wendet unterzeichnen würde. Dasselbe gilt denke ich mal weitestgehend ebenso für eine Petition bei der es "nur" um das Recht auf private Kopien geht.
Das Problem was ich hier sehe ist allerdings das alle Petition auch immer in einen gewissen Kontext stehen (bzw. auch selbst einen gewissen Kontext herstellen) und das dieser Kontext es machmal dem Einen oder Anderen schwer machen kann sich mit der Petition _als Ganzem_ zu identifizieren.
Als Beispiel hat mich bei der Petition um die es hier geht u.a. der folgende Satz bisher davon abgehalten die Petition zu unterschreiben (auch wenn ich das wahrscheinlich trotzdem gleich nachholen werde):
[...] Ich begrüße, dass der Entwurf an einigen Stellen über die Vorgaben der EU-Richtlinie zum Urheberrecht in der Informationsgesellschaft hinaus geht. [...]
Mal abgesehen davon das der Satz in mir ein gewisses Unbehagen auslöst kann ich nicht einmal sagen worauf er sich den eigentlich bezieht!

Wir sind tatsächlich nicht gefragt worden. Wahrscheinlich hätten wir die Initiative als Erstunterzeichner unterstützt, wenn wir gefragt worden wären.
Wie Wolfgang schon vermutete, ist es nicht der Kernbereich unserer Arbeit. Die Abschaffung der Privatkopie nimmt allerdings auch Freiheiten weg und die Verschärfung von Urheberrechtsdurchsetzung birgt weitere Gefahren für Freie Software.
Ein wenig sind wir nicht sicher, ob der gelegt Schwerpunkt auf der Rettung der Privatkopie nicht die anderen kritischen Punkte zu sehr in den Hintergrund spielt.
