Jein. Zum einen ist schon das beliebige Zerlegen des Programmes mit allen Mitteln der Kunst gemeint. Zum anderen, und ich denke, das war eher die ursprüngliche Intention hinter Freiheit zwei, ist das Studium der Quellen, ohne an ihnen etwas zu verändern, genauso wie ein Historiker oder Politikwissenschaftler eben mit Quellen umgeht; plus natürlich das Anpassen zum eigenen Zweck.
O.K. Ich verstehe das die Moeglichkeit aus den Quellen zu lernen, so wichtig genommen wird, das sie eigens erwaehnt wird, auch wenn dieses Recht formallogisch bereits in einem anderen enthalten ist.
Waeren Programme die Freiheiten Nr1 und 3 haben, wo Verbesserungen aber nur in Patchform verbreitet werden duerfen d.h. die Binaries und der urspruengliche Quelltext muessen unveraendert verbreitet werden, eigentlich frei im obigen Sinne. Ich denke ja.
Hier eine Korinthe: _*_ :-) Theoretisch stimme ich Dir zu, praktisch gesehen -- überleg mal, was passieren würde, wenn Linux (der Kernel!) in Version 0.0.1 vorliegen würde und Du Patches für die letzten 13 Jahre einspielen müsstest... okay, man könnte das automatisieren.
Praktische Erwaegungen habe ich ganz ausgeschlossen. Ich habe mich halt dumm gestellt. Das ist absolut notwendig wenn man juristische Texte verstehen will. ;-) Es ist eh klar das nicht alle freien Lizenzen gleich wuenschenswert sind. So sollten BSD Style Lizenzen ausser in Ausnahmefaellen vermieden werden oder auch das Festschreiben einer bestimmten GPL Version.
Ein Programm wo Veraenderungen nur in Patchform vertrieben koennte wohl auch nicht Teil von Debian sein, da die Debianentwickler oft Aenderungen am Quelltext vornehmen muessen damit das Programm Policy konform ist. Gentoo haette da wohl weniger Probleme, sie koennten ein Script mitliefern, dass die Patches automatisch einspielt.
Aber praktische Erwaegungen sind wie gesagt ausgeblendet. Die vier Freiheiten beschreiben m.E. auch nur Minimalbedingungen fuer Freie Software, die noch weitere Erwaegungen notwendig machen.
Hm, da faellt mir ein, was ist mit Programmen die zwar im kommerziellen Umfeld benutzt werden duerfen, die man aber nicht verkaufen darf.
Was meinst Du mit Verkaufen? Verkaufen von Datenträgern mit der Software? Rechteübertragung? Lizenzierung?
Nun vielleicht habe ich versucht ein bischen zu spitzfindig zu sein. Verkaufen macht wohl bei Freier Software wenig Sinn, wenn nicht eins der obigen Begriffe gemeint ist.

Nach formaler Logik hast Du recht. Die Studierbarkeit folgt aus der Quellenverfügbarkeit.
Allerdings, um selber spitzfindig zu werden: Kurz vor Zeiten des Dotcom-Sterbens hat ein entfernter Bekannter einen Arbeitsvertrag unterschreiben müssen, der die Klausel enthielt, dass er alle im Arbeitsverhältnis entstandenen Wissenszugewinne nach Beendigung des Arbeitsverhältnisses nicht mehr nutzen darf. Sehr lächerlich und juristisch sicher auch fragwürdig, falls aber rechtlich einwandfrei, könnte man sich genausogut eine Lizenz vorstellen, die Dir den Zugriff auf Quelltexte erlaubt, nicht jedoch das "Studieren".

Diese Leute haben eine merkwürdige Logik, schlimmerweise funktioniert sie auch noch für viele praktische Fälle. Ein Mathematiker würde deswegen töten.

Ja. Die Debian Free Software Guidelines könnte man zum Beispiel als ausformulierte Variante der vier Grundfreiheiten betrachten. Wobei: Je länger der Text, desto mehr Zank um Auslegungsfragen. Vergleiche Bibel.

Freie Software können die Rechteinhaber selbstverständlich "verkaufen". Ich weiß nicht genau, wie das im kontinentaleuropäischen Recht genau geht -- aber drehen kann man da was. Nur nützt es halt wenig - die Community macht nen Fork und es wird frei weiterentwickelt.

Eine spätere Änderung ist dann zwar vermutlich nur mit dem Einverständnis aller Beitragenden möglich, aber das erscheint mir im Moment das kleinere Risiko.
Wobei das hierzulande vermutlich egal ist, weil die "or any later version"-Klausel wohl eh unwirksam ist (sagt z.B. Georg Greve in http://lists.gnu.org/archive/html/fsfe-de/2001-10/msg00036.html).

Gerade Debian verteilt doch i.a. Originalpaket + Patch. Ein Problem sehe ich nur, wenn das Originalpaket Teile enthält, die gegen die DFSG verstoßen und deshalb vorher entfernt werden müssen *und* die Lizenz das verbietet (z.B. eben Änderungen nur in Patchform) *und* die zu entfernenden Teile nicht eigene Werke (unter der selben oder einer anderen Lizenz) bilden, z.B. Dokumentation oder klar abgegrenzte Add-Ons, die dann komplett entfernt werden könnten.

Aber anscheinend ist ja noch nicht mal klar, wo und wie Kommentare überhaupt sinnvoll geäußert werden können. Dort war die Rede von irgendeinem Web-System, das nicht mal browserunabhängig ist. Das ist für mich inakzeptabel (egal, ob meine Browser nun zufällig zu den unterstützten gehören oder nicht), und deswegen habe ich bisher nicht mal einen Blick darauf geworfen.

Wenn mir gesagt wir, wo und wie. Wenn ich nichts übersehen habe, wurde dieser Frage in der englischen Liste bisher immer ausgewichen (und stattdessen z.B. argumentiert, dass Browserabhängigkeit kein Problem und unvermeidbar wäre und so ein Quatsch, einmal wurden sogar Browser-Statistiken angeführt, was doch sehr wie anderswo oft gehörte Argumente klang: "Wir unterstützen nur Betriebssystem XYZ, weil das auf 80% aller PCs läuft."). Ich hatte mich in der englischen Liste zu diesen Punkten nicht geäußert, weil ich eigentlich dachte, die Probleme wären klar genug dargestellt worden. Aber wenn es hilft, kann ich dort auch noch mein "me too" ablassen.
Ich werde mir aber nicht die Mühe machen, die Punkte, die ich für wichtig halte, vernünftig aufzuschreiben, wenn die Chance, dass das überhaupt berücksichtigt wird, gleich Null ist. Bisher sieht es leider danach aus.
I.ü. ändert das alles nichts an meinem Argument, dass man zu einer neuen GPL-Version erst wechseln sollte (und in Europa rein rechtlich vermutlich überhaupt erst kann), wenn diese feststeht. Selbst wenn der Entwurf perfekt wäre, könnte er ja noch zum Schlechteren verändert werden.

Es mag Gründe geben, warum man das web-interface nicht verwenden will oder kann, aber ich denke mit dem email-interface als Alternative sollte jeder die Möglichkeit haben seine Kommentare abzugeben.

Es mag Gründe geben, warum man das web-interface nicht verwenden will oder kann, aber ich denke mit dem email-interface als Alternative sollte jeder die Möglichkeit haben seine Kommentare abzugeben.
Meiner Ansicht nach ist es schon eine Schwäche, dass die Webschnitt-Stelle nicht alle Browser gleich unterstützt, allerdings kein wirklicher Hinderungsgrund.
Wie ich auch im Englischen schon schrieb: Richard Stallman ist bekannt dafür, alle guten Argument mit einzubeziehen, sogar, wenn andere Wissenschaftler das nicht mehr tun würden. Und er ist der Hauptautor der GPLv3.
Frank, die Chance, dass Deine Rückmeldung berücksichtigt wird ist aus meiner Sicht sehr gut.
