Mir stach beim Lesen ein Formulierungsproblem ins Auge, auf das ich gern hinweisen möchte, sodass auch andere in ihren Blogs darauf achten:
Der Artikel ist voll von "Hier"-Links. Die waren schon vor 15 Jahren nicht angebracht, und sind es heute umso weniger. Kurz und bündig erklärt es das W3C:
Don't use "click here" as link text http://www.w3.org/QA/Tips/noClickHere
Weiterhin gibt es einen alten (aber keineswegs veralteten!) Style-Guide von Tim Berners-Lee, in welchem er die Problematik genauer erläutert:
"Make your (hyper)text readable" http://www.w3.org/Provider/Style/ReadableText.html
In die gleiche Kerbe schlägt auch der nächste Abschnitt des Style-Guides:
"Avoid talking about mechanics" http://www.w3.org/Provider/Style/NoMechanics.html
Überhaupt ist der gesamte Style-Guide sehr lesenswert. (http://www.w3.org/Provider/Style)

Das widerspricht sowohl dem Grundsatz, sprechende Links zu verwenden, als auf dem Grundsatz, nicht über bloße Mechaniken zu reden. Besser wäre:

Wäre super, wenn das jemand mit entsprechenden Zugriffsrechten verbessern könnte. Vielen Dank.

Der Artikel ist insgesamt eine schöne Zusammenfassung der Problematik, jedoch ist mir eine Stelle ziemlich übel aufgestoßen. Und das, obwohl ich wahrlich kein Fan der US-amerikanischen Rechtssprechung bin, was IT-Dinge angeht:
| Eine solche Drittparteienhaftung gibt es in Deutschland bisher nicht, | jedoch in den USA. Daher stellt sich zusätzlich die Frage, ob durch | ACTA die US-amerikanische Rechtslage weltweit durchgesetzt werden soll.
Diese Argumentationslinie ist vollkommen neben der Spur. Wenn die USA ihren "Freedom Of Information Act" weltweit durchsetzen wollten, wäre das verkehrt? Wenn Deutschland seine Rechtssprechung bzgl. der Todesstrafe weltweit durchsetzen wollte (ergo: Abschaffung!), wäre das verkehrt?
Diese Formulierung erweckt den Eindruck, als ob dies das größte Problem der Drittparteienhaftung wäre. Dadurch, dass es als "böses USA-Recht" abgetan wurde, wurde im Artikel die Chance verpasst, es _inhaltlich_ anzugreifen:
In welchen Ländern gibt es ebenfalls die Drittparteienhaftung? Wie sieht das in der Rechts-Plaxis aus? Gab es zum Beispiel ISPs, die durch die Drittparteienhaftung moralisch fragwürdigen Rechtsansprüchen ausgesetzt wurden?
Die Drittparteienhaftung hätte man inhaltlich auf so vielen Ebenen angreifen können, doch stattdessen kam nur ein plumpes: "Das wollen uns die Amis aufzwingen, also ist es Mist."
