Der Artikel scheint aus einer nicht-freien Quelle zu stammen. Den hier auf einer öffentlichen Liste zu posten, halte ich für gefährlich. - Und wie gefährlich das ist, habe ich auch erst durch meine tägliche Beschäftigung mit dem Thema gelernt.
Ich hielte es für besser, einen entsprechenden Link zu schicken.
Aber nochmal: die Information ist gut und wichtig.

ja, es wäre aber auch in einer internen Liste nicht in Ordnung gewesen. Es ist stark zu vermuten, dass Spiegel Online diese Nutzungen nicht erlaubt.
Da diese Liste öffentlich archiviert wird, müssen wir die Email auch aus dem Archiv streichen, ich habe eine Email an webmasters a-t gnu geschickt. Ingmar, Du bist in Kopie.

Schulterschluss von Automatisierern und Softwareschmieden gegen Softwarepatentierung
Hamburg / Brüssel, 15. Februar 2007 Mit den Vereinigungen OSADL und patentverein.de stärken zwei Interessengemeinschaften der Automationsbranche die Initiative der Unternehmer gegen Softwarepatentierung "patentfrei.de". Die Unternehmerinitiative fordert Bundesjustizministerin Zypries auf, dem kontrovers diskutierten europäischen Patent-Streitregelungssystem EPLA (European Patent Litigation Agreement) die Unterstützung zu entziehen. Das EPLA weist massive Mängel zum Schaden kleiner und mittelständischer Unternehmen auf und führt insbesondere zur Legitimierung der umstrittenen Softwarepatente.
Mit ihrer Forderung nach patentfreier Software erhält die Unternehmerinitiative patentfrei.de, die über 650 kleine und mittelständische Unternehmen (KMU) zu ihren Unterstützern zählt, ausdrückliche Unterstützung aus der Automationsbranche. So verstärkt das Open Source Automation Development Lab (OSADL) die Allianz von patentfrei.de gegen Softwarepatentierung. OSADL ist eine Vereinigung von Unternehmen zur Förderung und Unterstützung des Einsatzes von quelloffener Software bei der Maschinen- und Anlagensteuerung.
OSADL-Geschäftsführer Dr. Carsten Emde betont, dass Lieferanten in der Pflicht stehen, ihren Kunden für ihre Produkte die Freiheit von Schutzrechten Dritter zuzusichern. Die hierfür notwendige Patentrecherche sei im Bereich der klassischen Patente, z.B. der Fertigungstechnik, die sich im internationalen Wettbewerb auch bewährt hätten, zwar aufwendig, aber machbar. Im Gegensatz hierzu sei eine verlässliche Recherche bei Softwarepatenten in einem vertretbaren Kostenrahmen praktisch ausgeschlossen. Da ein bestimmtes Softwarekonzept unabhängig von der Branche in zahlreichen Programmen vorkommen kann, hätten Softwarepatente das Potenzial, die gesamte Menschheit an der effektiven Nutzung des Computers zu hindern. Das OSADL fordert daher die vollständige Patentfreiheit im Softwarebereich. Nur so kann die freie Entwicklung von Software und speziell von Open-Source-Software in der Zukunft erfolgreich fortgesetzt werden", so Emde.
Auch der Industriefachverband patentverein.de, dessen Mitglieder in den Bereichen Motor/Sensor/Automation tätig sind, bekräftigt die Forderungen von patentfrei.de nach dem effektiven Ausschluss der Patentierbarkeit für Software . Als mittelständische Initiative setzt sich patentverein.de für Patentqualität und die Gestaltung eines mittelstandsfreundlichen Patentwesens ein. Dr. Heiner Flocke, Vorsitzender von patentverein.de, beklagt dass 90% der Patente auf 10% der Anmelder entfallen. Dies sei ein Missstand, den auch das Patentamt erkenne, aber nicht verhindere. Der innovative Mittelstand sei darüber hinaus durch einen bereits für klassische Technikpatente möglichen Missbrauch des Patentwesens bedroht. Eine Legitimierung von Softwarepatenten, zudem abstrakt und von überlasteten Prüfern locker erteilt, würde diese Angriffsflächen schnell duplizieren", erläutert Flocke. Der Mittelstand hat das Recht in diesen zentralen Fragen gehört zu werden und er muss sich auf eine unabhängige Rechtsprechung verlassen können, die dann auch die Maßstäbe für Erfindungshöhe gemäß dem Patentgesetz zurecht rückt."
Die Unternehmerinitiative patentfrei.de sieht genau diese Grundsätze durch die Schaffung der neuen EPLA-Gerichtsbarkeit in Gefahr. Johannes Sommer, Hamburger Vertreter der Initiative: Nach unserer Auffassung sind die von der Bundesregierung propagierten Pläne für das zentrale Streitregelungssystem EPLA einseitig auf die Interessen der Großindustrie ausgerichtet." Der aktuelle Entwurf missachte durch die Verflechtung mit der Europäischen Patentorganisation (EPO) zudem grundlegende demokratische Prinzipien wie der Gewaltenteilung und Unabhängigkeit der Richter. Nicht nur durch die Erhöhung der Kosten für Rechtsstreitigkeiten sind KMU benachteiligt. Durch die abzusehenden Legitimierung von Softwarepatenten im EPLA-Szenario erwarten wir existenzbedrohende Auswirkungen für kleine und mittelständische Unternehmen", warnt Sommer. Auch stehe nach einer aktuellen Einschätzung des juristischen Dienstes des EU-Parlaments das EPLA in mehrfacher Hinsicht mit dem EU-Gemeinschaftsrecht in Konflikt.
Anlässlich des nächsten EU-Wettbewerbsrates am kommenden Montag fordert die Initiative Bundesjustizministerin Zypries daher auf, die Unterstützung des EPLA aufzugeben. Ein europaweites Rechtsprechungsorgan dürfe nur im EU-Rechtsrahmen ausserhalb des Einflussbereiches der EPO errichtet werden. Zur Sicherstellung der Rechtssicherheit für alle Unternehmen, die Software entwickeln oder einsetzen, sei zuallererst die Schaffung einer europaweiten Regelung notwendig, die Softwarepatente unmissverständlich untersagt.

Rechtlich schon, da die Pressemitteilungen ja gerade mit der Berechtigung herausgegeben werden, sie weitergeben zu dürfen. :)
Inhaltlich empfehle ich immer einen Kommentar dazu zu schreiben, damit wir hier nicht reinen Nachrichtenverteiler werden. Viele unserer Leser sind ja schon auf vielen verschiedenen Tickern und bekommen deshalb die meisten Nachrichten schon irgendwie mit.
Die Meinungen und Kommentar, warum dies also wichtig ist und welchen Bezug da zu Freier Software und FSFE hat, ist also das wirklich Interessante. ;)

Widerstand gegen Software-Patente ist gut für die gesamte Software, und damit ist es auch gut für Freie Software. Wenn andere Medien das bringen, ist es immer gut diesen mitzuteilen, dass einen das Thema interessiert und dass sie mehr über diese Gefahr berichten sollten. Dann ist ein Verweis auf die Pressemitteilungen von Patenfrei natürlich manchmal sehr nützlich.
