I think it is essential that someone attend this one. Unfortunately I cannot make that date. EPO has launched a charm offensive to justify its illegal patenting activities and although this title is bizarre, to say the least, it looks like an EPO puff piece.
Bye, Barry
for people interested in this issue, the Council's proposal has been thrown
out: http://www.theregister.co.uk/2005/09/27/meps_reject_uk_proposal/
Bascially, the current proposal (a Council decision, i.e. just the national
govts, MEPs aren't involved) has been thrown out and a new one is being
written by the Commission (which will be presented to the MEPs for
amendments).
The last two paragraphs of that article describe the new proposal:
=====8<----------
The Commission proposal puts an upper limit on the time data must be stored:
one year for telecoms data and six months in the case of internet
information. It also proposes that communications companies are compensated
for the additional costs they will incur, complying with the new laws.
Yesterday, the official in charge of data protection in the EU said he was
still not convinced of the necessity of the proposals put forward in the
directive, and said further safeguards were needed to protect citizens'
privacy.
=====8<----------
Note that the new proposal puts a limit on the time data *must* be stored -
not on how long it *can* be stored.
Also, I've heard that the UK is using this issues as part of an
"anti-terrorism" package that it wants to race through before the end of
December (to leave a mark for its presidency). If if we/anyone's to have an
impact on this, they should act quickly.

+ For those who never bother looking at these '''mysterious messages''' that appear before the familiar boot-time logos and splash screens, it's time to start looking now... If your computer appears to ignore the fact that there's a bootable CD in the drive, the most likely cause is that the '''''computer is configured to look for a hard disk before looking for a CD''''' to boot from. Unless something very strange has happened, it will probably find a hard disk, and boot from that.

+
+ On one computer I use, I need to use a '''Smart Boot Manager''' floppy disk if I want to boot from CD!! This is because the laptop in question gives up looking for a bootable CD, '''before''' the CD spins up... silly manufacturer!

As I mentioned in my last post, Forfas hosted a talk about software patents,
given by an EPO attorney, in June 2005 - a month before the Big Vote.
We should have been aware of this at the time. So that we don't miss more
events like this, we should try to keep an eye on the following:
http://www.forfas.iehttp://www.patentsoffice.ie/http://www.entemp.ie
When I get time, I'm going to look for mailing lists / newsletters for these
organisations so that I (and anyone else) can sign up to to stay informed.
Does anyone else have suggestions for organisations to add to that list?
Recordings and transcripts for forfas' last series of talks (including the
above mentioned June '05 swpat talk) are available on the forfas talks page:
http://www.forfas.ie/news/intellectual_property/
(Also, I just found http://www.cai.ie/ while looking around the Net. Anyone
heard of them? "Copyright Association of Ireland")

Fergus Cassidy just pointed me to this:
http://www.forfas.ie/news/intellectual_property/
I don't see any times on the page, but it has dates and titles for upcoming
talks. (Fergus said they might be real-early-morning, like 08h30) Here's
two which would probably be worth attending, particularly the second:
> Friday 9 December
> EPO proactive in the prosecution of software
> Dr. Jörg Machek - European Patent Office
> Friday 14 October
> The Evolving International Framework for Irish IP Regulation
> Michael English, Intellectual Property Unit, Dept.of Enterprise, Trade &
> Employment.
All are welcome to attend, and they're in Wilton Place, D2.
Also on the above linked page are recordings and even transcripts of the
talks in their last session. One talk that is probably worth a listen/read
is the one titled "Patenting Software - The Current State of Play" - it's a
talk by a patent attorney (from the European Patent Office, IIRC).

Hi all.
As I mentioned last week, September's meeting will happen tomorrow,
Tuesday 27th in Mahaffey's Pub at 2000h:
http://www.ifso.ie/images/mahaffeys.png
IFSO is planning a talk which will take place in November, so the
meeting will mostly concern the planning this event. Details will
follow.
Malx.
P.S. As before, future meetings will occur on the third Tuesday of
the month.

Hi all,
as some of you already know and for the information of the others:
There is another nasty directive being brought up by the European
Commission, putting together the more contentious the remains of the
infamous "IPR Enforcement Directive" (IPRED). This new directive,
which many of us have begun referring to as IPRED II, seeks to
introduce criminal sanctions for "infringement of intellectual
property on a commercial scale."
IPRED II could get nasty for many of us and is likely to create
massive problems for professional authors, artists and programmers:
In the current legal environment, just doing their job puts all of
them in constant danger of infringement. Trying to prove that they did
not intend to infringe might be difficult -- and this directive will
largely foreclose the possibility to settle things peacefully between
parties as such settlement is unlikely in criminal court cases.
We will need to build up force against this so it does not pass as
silently as IPRED was passed.
The Free Software Foundation Europe (FSFE) has put up a web page
explaining the directive and things that we could work for at
http://fsfeurope.org/projects/ipred2/ipred2.en.html
Please check it out and let others know this is headed our way.
Regards,
Georg

The UK Patent Office are having a public consultation about IPRED2:
http://www.patent.gov.uk/about/consultations/enforcement.htm
Will Ireland have an equivalent? Ifso, we'd better not miss it!
I've emailed entemp asking if they'll be holding a public consultation, or
if they can give me any info about such, but the UKPO's consultation ends
September 26th so we should act fast in case Ireland has s consultation with
a similar deadline.
I'll pass on a reply from entemp if/when I get one, but if anyone has any
info/leads, they'd be good.

After doing a good bit of research on IPRED2 and talking with others, I made
this page:
http://fsfeurope.org/projects/ipred2/ipred2.en.html
One problem with the letter we were working on is that many EU member states
already have criminal sanctions for intentional, commercial-scale copyright
infringement. This means our SCO example will be met with: "Yeh, but that's
the USA. EU member states already have these provisions and I see no harm
done".
So we need to rethink the letter.
(I don't have a draft. Just passing on that URL and info.)
