Mal sem razmišlju o DRM, pa me zanima kakšno je vaše mnenje;
1. Ideja DRM Omogočiti lastnikom avtorskih pravic nadzor nad digitalnimi vsebinami. S tem se mi ne zdi nič narobe. Sicer ne vidim smisla v tem, ampak razumem, zakaj bi kdo to hotel.
2. Implementacija Tu je sicer cel kup problemov, ampak bi se usmeril na to, da DRM s sabo potegne kup lastniških strojnih in programskih tehnologij.
Zanima me, ali bi podpirali DRM, če bi bil implementiran na način, ki nikakor ne bi omejeval razvijalcev strojne in programske opreme, torej da bi bil nepatentiran, brezplačen, odprt standard? Ali je takšna zasnova sploh možna?

DRM (digital rights management software), oz. širše "učinkoviti" tehnični ukrepi, temeljijo na ideji, da je mogoče dosedanja prizadevanja za preprečitev kopiranja z (dragim) tožarjenjem preprosto zamenjati s programsko in strojno opremo. Zabavna elektronika (flat screen tv, ipodo, računalo in HDMI kablovje med temi) naj bi omogočalo predvajanje samo tistih vsebin, ki imajo priložen "štempelj". Oz. vsaj taka je teorija.
Praksa je neverjetno morje šlamparije, površnosti, polresnic, kraje odprtokodne programske opreme, lobiranja in drugih zakonodajnih pritiskov, ki te prisilijo v ne nakup, ampak licenciranje avtorskega dela skupaj s gmoto napihnjenega, napol delujočega softwera, ki ti nabija račun za štrom, pošilja tvoje osebne podatke nevem-komu-vse, hkrati pa grozi z visoko zaporno kaznijo vsakomur, ki želi izpostaviti te napake.
Razmišljanje, da je založniška industrija pripravljena opustiti sedanjo prakso in iti na odprt kodo, nima osnove. Prav nasprotno, želijo si še več obstoječega [1]. -i

Stališča so tukaj bila dokaj jasna, ko je SUN objavil open source DRM rešitev:

Dejstvo je, da prva točka ni kompatibilna s svobodo. Če kupim danes knjigo, jo lahko počečkam, prepišem, preberem, posodim, citiram, prodam ali prekopiram.
Torej - DRM bi mi naj, tako ali drugače, preprečeval tole. Zakaj? Zadevo sem legalno kupil. DRM je samo super kratica za kratenje pravic uporabnikov.
Zatorej se razume, da koncept DRM ni kompatibilen z konceptom svoboe in če nadaljujemo ni kompatibilen z idejo FSF.
Kaj pa FSFE pravi na tole?

Yup.
Gre se za to, da je že v osnovi koncept „intelektualne lastnine” kot lastnine napačen, ker ne gre niti za potrošno (t.j. se uniči ob uporabi) niti za rivalno (t.j. če jo uporabljam jaz, je ti ne moreš) stvar. DRM pa poskuša to ne le nadomestiti, ampak tudi nadgraditi.
Damjan je dal precej dober primer, ampak so še veliko hujši: npr. slep/slaboviden/dislektičen niti tehnično ne more (DRM) poslušati eBook, ki ga je kupil, niti ne sme (pravo, ki ščiti DRM) zaobiti te tehnične ovire.
Torej kot je Igor že namignil, velik problem je, da tehnična omejitev nima istih varovalk kot pravo — presumpcija nedolžnosti, kazen šele po pravičnemu sojenju, možnost pritožbe, možnost predstavitve svoje plati, upoštevanje okoliščin … — in da je stvar še bolj perverzna se potem sprejema še zakone (praviloma kar kazenske!), da je kakršen koli način izogiba takega enostranskega omejevanja uporabe preprečen.
Zatorej se razume, da koncept DRM ni kompatibilen z konceptom svoboe in če nadaljujemo ni kompatibilen z idejo FSF.
Kaj pa FSFE pravi na tole?

DRM ne spreminja tvojega pravnega položaja, le dejanskega (ne moreš narediti delujoče kopije).
Da ilustriram. Kupil si izvod igre Assasin's Creed in prišla je z mega super DRM-jem, ki ti požre ves disk, cpu in net, tako da v bistvu igraš potezno igro pri 1fps. Narediš kopijo in jo daš meni. Meni kopija ne dela. Jok.
Ti nisi izgubil ničesar, še najmanj procesne pravice. Jaz nisem pridobil ničesar. Založniška industrija je pridobila, točneje ni ji nastala škoda.
-- in da je stvar še bolj perverzna se potem sprejema še zakone (praviloma kar kazenske!), da je kakršen koli način izogiba takega enostranskega omejevanja uporabe preprečen.
Evo srčike problema. Založniki si kazenskih sankcij želijo iz dveh razlogov: 1) stroške pregona bremenijo državo 2) preventivni efekt: "People will stop this once they start going to jail".
Ampak kazensko pravo ne sme temejliti na interesih manjšine. Kaznive morajo biti samo hude kršitve pravil (kriminalna količina), kazni pa morajo biti najmanjše možne, da še dosežejo namen. Dokazni standardi morajo biti visoki. Začasne uredbe morajo biti dobro premišljene.
Veš, kaj moti RIAA-o v Španiji? Za pridobitev začasne odredbe rabijo položiti varščino, in to ne nizko. Kdaj vse: - ko hočejo identificirati IP naslove osumljenih p2p uporabnikov, za primer, da kakemu ne-krivemu posežejo v zasebnost - ko hočejo prevednivno zaseči domeno (torej pred dokončno sodbo) - ko hočejo imeti kakšnokoli predčasno sodbo (sumarno / zamudno), za primer, da bo v pritožbi ugotovljeno drugače. - ..
Na domači celini rabijo le najti enega prijaznega sodnika, pa ICE že veselo zapira domene.

V tem oziru smo torej malce bolj napredni. Tudi to se zgodi ;)
…je pa tudi res, da v tem primeru, je po zakonu napisano kako naj bo. Kar pomeni, da mora uporabnik najprej a) poznati to izjemo, b) začeti tožbo in c) jo dobiti. Torej ima tisti, ki je postavil DRM veliko prednost. Zanimivo, da kolikor vem, ni kazni za omejevanje z DRM kar po zakonu ne bi smel ;)

Ti govoriš o zelo prvinskem DRM. Če gremo že eno generacijo novejše, postane butasto:
DVD in njegov CSS — razdeli se trg DVD filmov na različne regije sveta. Če povsem legalno kupiš DVD v Aziji in ga hočeš predvajat doma, ker si npr. Bollywood ali anime fan, in pri nas pač teh filmov ni. → ne moreš.
Kupiš glasbo z DRM in jo daš na svoj prenosni predvajalnik. Nato hočeš še kopijo za v avto in na računalniku. In še varnostno kopijo, za v arhiv, če gre kaj narobe. → ne moreš.
Kupiš glasbo/film/karkoli in je v nekem čudnem formatu, hočeš pa imeti shranjeno v formatu, ki deluje na tvojem hardveru. → ne moreš.
…ja, ja, vem, da boš rekel, da ZASP 166.c dopušča nekaj tega, ampak glej argument zgoraj.
Je treba tudi reči, da je 166.c tudi samo izjema od 166.a, ki pa opravičuje točno ta „ne moreš“ in dodaja še „ne smeš se temu izogniti“ (razen v izjemnih primerih iz 166.c).
