qui di seguito le mie risposte ai quesiti posti dalla review dopo
rilettura del testo della delibera scaricabile in [1].
Viene utilizzata la numerazione del documento Dx x|{1-19}.
Di seguito la mie risposte (che voi a vostra volta commentate), seguita
opzionalmente da un testo in parentesi che contiene le motivazioni delle
mia risposte (e che quindi non verrà incluso nella risposta ad AGCOM). Se
necessario, ho una casella PEC per mandare una volta approvata la risposta
che va data entro e non oltre il 6 Marzo (se bene ho inteso).
La ciccia è nei punti D9-D16, aiutatemi specie verso il fondo vista l'ora e
la stanchezza.
Per favore, quando commentate usate lo stesso standard (citare il numero Dx
ed il punto che voi non ritenete corretto, fate una lista se più d'uno) in
modo da facilitare la review per tutti. Buona review a tutti!

D3 Sì
(Le definizioni sono corrette. La delimitazione del perimetro (forzatamente
arbitraria) è comprensibile e cercare di smantellare alla base normativa
tutto l'impianto è del tutto inutile e velleitario. Quel che c'è scritto va
bene, è quello che manca che appunto, manca. Non è un caso che la telefonia
mobile sia stata messa da parte ;-))
D4 Sì
D5 Scarsa.
L'offerta nei canali di distribuzione e vendita delle CPE in Italia, per
quanto numericamente e qualitativamente ampia, NON offre in modo chiaro per
l'utente medio linee guida, garanzie, informazioni e suggerimenti validi
per utilizzare l'apparato in connessione ad un fornitore di accesso ad
Internet. Il risultato finale è che spesso sono necessarie da parte
dell'utente molte modifiche sulla configurazione della CPE per renderla
funzionale ed in alcuni casi documentati sia impossibile connettersi ad un
fornitore di accesso Internet con una CPE scelta dall'utente finale. E'
quindi vitale per tutelare le garanzie ed i diritti dell'utente che il
fornitore di accesso ad Internet espliciti i criteri di accesso alla sua
rete ed utile pubblicare gli elenchi di CPE su cui vi è un riscontro
positivo di funzionalità con la rete di accesso target.
D6 Assolutamente sì per i motivi spiegati in D5
D7 Assolutamente sì
(la logica dietro queste domande è chiara, "indirizzare" i commenti là dove
il dente duole e dove è stra arci noto il problema. Tutti problemi
sacrosanti! Sarà giorno benedetto quando spariranno questi problemi. Ce ne
sono pure altri però...ma non mettiamo troppa carne al fuoco)
D8 Sì
D9 Esistono molti vincoli che limitano la libertà di scelta dell'utente che
possiamo dividere in due categorie: di connettività pura e per servizi
addizionali.
Gli operatori di accesso alla rete internet hanno la facoltà di introdurre
limitazioni di connettività purché non in contrasto con le norme vigenti ma
non le pubblicizzano, privando l'utente di parametri di una scelta
consapevole. Esempi non esaustivi di queste pratiche: bloccare alcune porte
IP, filtrare a livello DNS od IP alcuni host, rendere impossibile l'accesso
del PC casalingo connesso alla CPE da un altro computer connesso ad un
altro provider.
Frequentemente gli operatori di accesso ad Internet offrono servizi
addizionali alla pura connettività che non sono fruibili, in tutto od in
parte, utilizzando CPE scelte dall'utente finale in luogo di quella offerta
in bundle. Queste limitazioni d'uso non sono trasparenti alla lettura
dell'offerta di sottoscrizione dell'abbonamento di accesso ad Internet e
limitano la libertà di scelta dell'utente. Elenco non esaustivo di
limitazioni non trasparenti:
- impossibilità di usare operatori VoIP differenti da quello offerto dal
fornitore di accesso Internet
D10 No. Nella comunicazione pubblicitaria, nelle sedi commerciali preposte
e nei siti internet dei fornitori di accesso ad internet viene sempre reso
implicitamente obbligatorio l'uso di un modem router in comodato d'uso,
scoraggiando attivamente l'utente ad acquistarne uno di sua scelta.
D11 Il fornitore di accesso ad internet dovrebbe essere obbligato a
pubblicizzare almeno un modem router commercialmente disponibile al di
fuori dei propri canali commerciali che sia utilizzabile sulla sua rete pur
non garantendo alcuni parametri di qualità (esplicitando quali).
D12 Sì. Per facilitare l'utente occorrono delle linee guida che descrivano,
chiariscano e rendano espliciti i caso d'uso più frequenti e le soluzioni
d'uso adottate. Queste linee guida dovrebbero essere aggiornate
periodicamente e pubblicate su un sito disponibile al pubblico.
D13 Tipicamente un utente non percepisce l'obsolescenza di un apparato come
una CPE e non ne valuta quindi l'incidenza sul prezzo. Tipicamente un
fabbricante di CPE per aumentare i guadagni non supporta le CPE ed
attivamente ne aumenta l'obsolescenza. L'unica strada percorribile per
rallentare l'obsolescenza di una CPE è fare sì che il supporto del software
presente sulla stessa sia scritto, manutenuto da terzi e preferibilmente
Free Software: esempi validi sono OpenWRT e DD-WRT.
D14 Fondamentale: oltre a quanto scritto in D13, ne beneficerebbero la
security dell'apparato oltre che ad essere un fattore abilitante per
l'introduzione e la diffusione di nuove tecnologie ancora allo stadio di
ricerca o prototipale, con beneficio di tutta la comunità creando anche
nuove opportunità lavorative.
D15 Sia i fornitori di accesso ad Internet o soggetti terzi, a scelta
dell'utente, dovrebbero essere utlizzabili dall'utente finale per le
riparazioni ed i servizi di assistenza.
D16

D17 le stesse di D16
D18 I costi e la loro ricorrenza (singola o periodica) per una CPE in
bundle, dato che molto spesso il comodato d'uso inizia dopo un contributo
iniziale. I costi ed i tempi di recesso inoltre non sono chiaramente
espressi, oltre che essere inutilmente vessatori (preavvisi obbligatori da
parte dell'utente lunghissimi e per contro tempi indefiniti di risposta da
parte del fornitore di accesso). Inoltre le modalità ed i costi accessori
per restituire la CPE al fornitore di accesso in caso di recesso non sono
sempre chiari.
D19 come già detto in D13, un fattore chiave è la possibilità di aggiornare
il software a bordo della CPE in modo autonomo e svincolato dal produttore
della CPE o dal fornitore di accesso alla rete.
Questa premessa è uno dei fattori abilitanti per facilitare la migrazione
degli utenti verso tipologie di reti e servizi di nuova generazione.

Ciao, a valle della riunione di ieri due parole sul metodo usato da AGCOM per la consultazione.
Come dicevo a voce la mia critica è metodologica (per approfondimenti si vedano gli ottimi lavori
della Regonini, ad es. http://www.pubblica.org/consulta/metodo.html):
- in primis il processo NON è trasparente, infatti bisogna mandare mail, quindi nessun cittadino ha
modo di sapere chi ha partecipato alla consultazione e cosa ha detto (anche solo per evitare di
ripetere cose già sottolineate). Molto meglio sarebbe stato utilizzare un sistema dedicato ai
processi di consultazione (sono molto simili a dei forum con upvote/downvote, tipo Reddit per
intenderci) in modo da vedere subito le varie proposte e commentarle/votarle. Inoltre con quei
sistemi, dato che è tutto pubblico, è facilissimo analizzare eventuali "scalate" da parte di gruppi
di utenti prezzolati.
- il "contratto sociale" è molto debole, si chiede un'opinione tout court e non si dichiarano
(correggetemi se sbaglio) gli outcome del processo (verranno divulgati, quando, come, quanto, con
che valore "impegnativo"?)
- la "raggiungibilità" è molto bassa (pattern "beware of the leopard", cfr. HHGTTG, incollo in
fondo), la consultazione non è in homepage AGCOM, bisogna cercarla (ci sto provando e non riesco se
non googlandola! provate anche voi), una volta "trovata" bisogna leggersi due allegati per capire
come si può rispondere! L'URL https://www.agcom.it/consultazioni-pubbliche non è direttamente
raggiungibile dalla homepage (almeno io non lo trovo).

Ciao a tutti,
in vista delle incombenti elezioni politiche 2018 in Italia, dalla
"regia" ci chiedono se possiamo creare la campagna Ask your Candidates
[1] anche qui, si tratta di una campagna promossa da FSFE volta a
"sondare" il grado di propensione dei partiti e dei loro esponenti
verso il software libero.
Partendo da buone basi [2], sappiamo già che queste domande saranno
alla fine molto fine a se stesse e poco incisive, tuttavia è bene che
formalmente mostriamo questa attitudine o meno dei partiti nei
confronti di software libero, net neutrality, privacy.
Ho aggiornato il nostro Pad [3] su Sandstorm e ne ho creato uno nuovo
dove raccogliere le proposte di domande da inviare ai partiti [4]
Mi date un feedback a caldo sull'iniziativa e se vi va anche una mano
con le domande? :)
