= Luca contra Lenovo +++ Reinhard y la FSFE +++ Informe del IloveFS =

En nuestro Boletín de marzo lee sobre nuestro promotor Luca Bonissi
quien forzó a Lenovo a pagar un reembolso de 20.000 euros por un Windows
preinstalado, sobre nuestro promotor Reinhard Müller, voluntario de la
FSFE durante dos décadas, nuestro informe del "I Love Free Software" y
también sobre nuestras otras variadas actividades comunitarias.
== Luca Bonissi contra Lenovo: 20.000 euros de reembolso por un Windows preinstalado ==
Todos sabemos lo frustrante que es comprar un ordenador nuevo y darte
cuenta de que viene con un sistema operativo preinstalado. Después del
fastidio inicial, sin embargo, incluso los mayores seguidores del
Software Libre no llevan su queja mas allá, borran el sistema y proceden
con una instalación nueva de un sistema operativo libre de su elección.
No es el caso de Luca Bonissi, un desarrollador italiano y promotor
veterano de la FSFE . Después de comprar un nuevo Lenovo Ideapad,
contactó con Lenovo para registrar una solicitud de reembolso de
licencia y la devolución del Windows preinstalado de Microsoft. Sin
embargo, Lenovo se negó a compensar a Luca por la licencia de Windows -
valorada en 42 euros - y lo que siguió fue una verdadera peripecia legal
y burocrática que llevó muchos meses y varios procesos legales.
Finalmente, en diciembre de 2020, el Juzgado de Monza desestimó todos
los argumentos de Lenovo, confirmando que el reembolso del software
preinstalado era obligado.
En su sentencia, el Tribunal de Monza señaló también que el propio
fabricante había asumido expresamente la obligación de pagar un
reembolso en la licencia de Windows. En su histórica decisión, el
tribunal impuso además a Lenovo una indemnización punitiva de 20.000
euros [1] por abuso de los procedimientos de recurso. Lenovo obligó a su
cliente a participar en un proceso judicial desproporcionado e
innecesario. El tribunal también señaló que este caso es un ejemplo de
la arrogancia y la prevaricación de una empresa gigante contra un
consumidor modesto. Al final, el tribunal dictaminó que la suma debía
pagarse a Luca, en concepto de indemnización por los daños causados por
la responsabilidad procesal agravada.
En un acto de gran generosidad, Luca Bonissi ha donado 15.000 euros [2]
de los daños recuperados a la FSFE, animando a la gente a defender sus
derechos. Estamos muy agradecidos por esta donación de Luca y también
por haber compartido la documentación [3] y los procedimientos en la
actualizada página wiki de italia [4].

Ahora nos vamos, de Luca Bonissi en Italia a Reinhard Müller en Austria:
Reinhard es otro voluntario cuya dedicación al Software Libre y a la
FSFE es legendaria. A lo largo de las dos últimas décadas, Reinhard ha
ayudado a dar forma a la FSFE en su autocomprensión y en su organización
general, así como en nuestro quehacer diario. De hecho, Reinhard ha
asumido básicamente cualquier papel, desde el de voluntario local hasta
el de miembro del equipo nacional, desde el de voluntario de estand
hasta el de responsable financiero y desde el de simpatizante a la
Asamblea General. La mayoría de las personas se sorprenden cuando
escuchan que es un voluntario y no un empleado remunerado de la FSFE.
Enumerar todas sus contribuciones en este boletín parece básicamente
imposible, pero realizamos una entrevista a Reinhard [5] en la que
intentamos cubrir al menos algunas de las partes más esenciales de su
vida dentro de la FSFE. Lee sobre lo que le mantiene motivado, sus
fuentes de energía, sus actividades favoritas de la FSFE y sus deseos
para la FSFE para los próximos 20 años.
== Día de Amo el Software Libre ==
De Reinhard Müller al "I love Free Software Day", porque esta es su
campaña favorita y es la campaña favorita de mucha gente en todo el
mundo. Este año ya hemos celebrado la 11ª edición del "I Love Free
Software Day" y acabamos de publicar nuestro informe de la actividad
[6]. En números contamos 411 tweets en Twitter y 210 toots e
innumerables retweets y retoots en el Fediverso usando el hashtag
#ilovefs. Personas de todo el mundo se han unido al "I Love Free
Software Day" a través de las redes sociales y tuitearon y retuitearon
desde al menos 328 lugares diferentes.
Este año hemos tenido dos novedades: junto con el voluntario de la FSFE
Florian Snow hemos creado algunas imágenes para compartir nuestro amor
por el Software Libre y ha participado mucha gente [7]. También hemos
creado un episodio especial del Software Freedom Podcast [8] que
proporciona un buen antecedente sobre los orígenes y aspectos más
destacados de los últimos once años del "I Love Free Software Day".

== ¿Qué hemos hecho? Dentro y fuera de la FSFE ==
- Como sabéis por nuestros boletines anteriores, la FSFE volvió a estar
presente en FOSDEM con un acto comunitario previo a FOSDEM, y este año
también, por primera vez, coorganizamos el Devroom (sala de
desarrollo) Legal y de Políticas. Ahora [todas las charlas están
disponibles en línea], incluyendo las charlas en el Devroom así como
el discurso de Cory Doctorow en nuestro acto comunitario.
- Johanna Pohl, Anja Höfner, Friederike Rohde y Erik Albers de la FSFE
publicaron un artículo de de Acceso Abierto sobre "Design Options for
Long-lasting, Efficient and Open Hardware and Software" (Opciones de
Diseño para la Longevidad, Hardware y Software Eficiente y Abierto)
[10] en "Ökologisches Wirtschaften: Digitalisation and
Sustainability"(Administración de la Ecología: Digitalización y
Sostenibilidad)
- Nuestro vídeo PMPC está ahora disponible en sueco [11] y por tanto ya
en nueve leguas diferentes.
- La FSFE estuvo presente en el 39 Chemnitzer Linuxtage de este año
donde Bonnie Mehring impartió una disertación sobre "Public Money?
Public Code!" [12] en la cual explicó cómo el marco de la campaña
puede ser empleada para presionar para la adopción políticas amigas
del Software Libre a un nivel local. Matthias Kirschner impartió una
disertación sobre "20 years FSFE - The long road to software
freedom"(20 años de la FSFE - El largo camino hacia la libertad del
software) [13]
- Erik Albers estuvo en el Winterkongress of the Digitale Gesellschaft
Schweiz, (Congreso de Invierno de la Sociedad Digital Suiza) donde
impartió una charla sobre la sostenibilidad del Software Libre [14].
- Una vez terminada su participación en un Panel de discusión sobre
oportunidades, obstáculos e incentivos para el Software Libre en la
administración pública, Matthias Kirschner escribió [15] sus
recomendaciones y opiniones sobre la licitación pública y el Software
Libre en su blog.
- Las regiones de Renania del Norte-Westfalia y Baden-Wurtemberg, junto
con el Ministerio del Interior Federal de Alemania, están planeando
establecer un repositorio de código de Software Libre conjunto para
administraciones públicas, que consiste en una parte central y
"satellites" descentralizados y compatibles. Esta aproximación viene a
ser cercana a nuestras demandas formuladas en la iniciativa "A Place
for Public Code"(Un lugar para el Código Público) [16]
- El 17 de marzo de 2021, en Holanda el "Bestuursafdeling" del Consejo
de Estado Holandés escuchó a nuestro miembro del equipo holandés Jos
van den Oever en un caso contra el "Tweede Kamer". Este implica a la
app 'Debat Direct'. Con esta app, pueden seguirse los debates de la
Cámara Baja. Jos pidió a la "Tweede Kamer" que revelara el código
fuente de la app 'Debat Direct'. Y todavía, Arib, el Presidente de la
Cámara, se niega a hacer esto público. [
