Datenschutzprobleme im elektronischen Gesundheitssystem - ein neues Beispiel
für Deutsches Verdrängungsphänomen?
"Wir Deutsche neigen offenbar dazu, akute Probleme solange zu verdrängen,
bis sie über uns hereinbrechen. Das sehen wir etwa beim Umgang mit der
Vogelgrippe auf der Insel Rügen. Bei der elektronischen Gesundheitskarte
haben wir ein ähnliches Phänomen: Hier ist der Datenschutz von 80 Millionen
Versicherten bedroht, sobald das System mit Daten gefüttert wird", hielt
IT - Berater Thomas Maus Journalisten, Politikern und Wirtschaftsvertretern
bei einem Vortrag am Donnerstag in Mannheim entgegen, die meinen, die Sorgen
um den Datenschutz bei der elektronischen Gesundheitskarte seien "zu wenig
konkret".
Als Beispiel führt Maus die das "e-Rezept" an: Aus den Verordnungsdaten
lassen sich Diagnosen rückschließen. Diese Daten sind beispielsweise für die
Kassen sichtbar und lassen sich dem Patienten zuordnen."
Auf diese Weise drohe das "weltweit größte IT Projekt aller Zeiten" zur
Blamage werden, so Maus. Nach der Schmach mit der LKW Maut fürchtet Maus,
könne der IT Standort Deutschland "irreparablen Schaden" nehmen.
Die in Deutschland geplante Gesundheitstelematik gefährdet nach Maus'
Analyse die Privatsphäre der Versicherten in Deutschland, "weil die
ärztliche Schweigepflicht de facto ausgehebelt wird": Krankenkassen oder
Lebensversicherer könnten die Daten benutzen, um Gesundheitsrisiken aus der
Versicherung auszuschließen. Banken könnten Kreditausfallrisiken
entsprechend der Lebenserwartung der Kreditnehmer berechnen und Arbeitgeber
könnten die Einstellung von Mitarbeitern von der erblichen Disposition
abhängig machen. Dazu müsste nur einer von "'zigtausenden von
Sachbearbeitern" bestochen werden, um diesen 'Schatz' zu heben. Die
Gesundheitskarte und die elektronische Rahmenarchitektur soll ab April in
Bochum-Essen, Bremen, Flensburg, Heilbronn, Ingolstadt, Löbau-Zittau, Trier
und Wolfsburg getestet werden.
"Die Analyse von Herrn Maus ist plausibel und überzeugend. Die Free Software
Foundation Europe ist erstaunt, wie leichtfertig und unprofessionell mit
derart persönlichen Daten umgegangen wird", kommentiert Joachim Jakobs,
Medienkoordinator der FSFE und ergänzt : "Diese Karte weiß mehr über den
Gesundheitszustand als der Betroffene selbst. Insofern muß das Vertrauen der
Versicherten erst einmal gewonnen werden. Mit der aktuellen Geheimniskrämerei
wird dieses Vertrauen aber bereits im Keim erstickt: So wissen wir
beispielsweise, daß Herr Maus wegen der Verletzung von Softwarepatenten und
des Urheberrechts verklagt werden sollte."
Stattdessen empfiehlt die FSFE, das Gesamtsystem der Gesundheitstelematik von
der Architektur bis zum Quellcode offen zu legen. Die Software sollte unter
einer Freien Softwarelizenz publiziert werden: "Warum sollten denn
Steuerzahler und Versicherte für ein System zahlen, was sich der öffentlichen
Kontrolle komplett zu entziehen versucht", so Jakobs.
Den Einwand, daß die Sicherheit gerade dann gefährdet sei, wenn der Quellcode
veröffentlicht würde, läßt Informatiker Maus nicht gelten: "Wenn ich den
Schließmechanismus von einem Türschloß veröffentliche, gebe ich auch nicht
jedem einen Schlüssel in die Hand", und Joachim Jakobs ergänzt:
"In der Praxis erweist sich zum Beispiel GNU/Linux im Vergleich zu Windows
als sicherheitstechnisch wesentlich ausgereiftere Plattform."

FSFE an Microsoft: das Jammern einstellen und die Entscheidung respektieren!
"Nach mehreren Jahren der Untersuchung, der ursprünglichen
Entscheidung in 2004 und einem Fall am Europäischen Gerichtshof, der
nun beinahe zwei Jahre dauerte, kommen wir zum Schluss, dass Microsoft
niemals beabsichtigte, die Auflagen und Regeln aus dem
Kartellrechtsverfahren zu erfüllen", kommentiert Georg Greve,
Präsident der Free Software Foundation Europe (FSFE). "Jahrelang waren
wir gezwungen, Verzögerungen, Behinderungen und ein Spiel auf Zeit mit
anzusehen, während Microsoft keinerlei Versuch unternommen hat,
Interoperabilität und Wettbewerb mit Wettbewerbern zuzulassen,
einschließlich Freier Software wie Samba."
"Wenn Microsoft tatsächlich über keine vernünftige Spezifikation ihrer
Schnittstellen und Dokumentation ihrer beträchtlich komplexen und
organisch gewachsenen Systeme hat, wie sie mehrfach behauptet haben,
kommt dies einer sehr traurigen Aussage über die Qualität und
Verläßlichkeit der Softwaretechnik bei Microsoft gleich", erklärt
Jonas Öberg, der Vizepräsident der FSFE. "Dass 'Hunderte von
Microsofts Angestellten und Vertragsfirmen' [1] offenbar nicht in der
Lage gewesen sind, innerhalb von zwei Jahren die Dokumentation zu
erzeugen, untergräbt das Vertrauen in Microsofts technische
Leistungsfähigkeit weiter."
"Dass Microsoft nun die Kompetenz und die Integrität eines Treuhänders
in Frage stellt, den sie selbst benannt haben, ist skandalös. Alle am
Fall beteiligten Parteien haben dem Treuhänder tiefgehende Kompetenz
und Verständnis bescheinigt," meint dazu Carlo Piana, der Anwalt, der
die FSFE bei diesem Fall vertritt: "Wie können sie sich jetzt erlauben
diesem Treuhänder wiederholt Befangenheit vorzuwerfen? Weil er nicht
Lügen will entgegen aller Beweise? Wir unterstützen die Kommission auf
dem ganzen Weg und noch weiter. Und wenn Microsoft hätte wissen
wollen, wie sie den Auflagen hätten folgen können, so hätten sie nur
Volker Lendecke, Mitglied des Samba-Teams und technischer Experte,
anrufen brauchen. So wie wir das vorgeschlagen hatten."
"Microsoft hat sich benommen, als stünden sie ihrer Meinung nach über
dem Gesetz und jeglicher Entscheidung der Europäischen Kommission. Die
aggressive Haltung, die sie jetzt gegenüber der Kommission einnehmen,
welche unglaublich viel Geduld mit Microsoft aufgebracht hat,
bekräftigt diesen Eindruck.", schlussfolgert Georg Greve. "Microsoft
drängt offensichtlich darauf, die erste Firma in der Geschichte der
Kartellrechtsgeschichte zu sein, die der Europäischen Kommission keine
andere Wahl liess, als tägliche Strafzahlungen zu erheben. Microsoft
verdient zu erhalten, worauf sie sie so hart hingearbeitet haben und
auf die harte Tour zur Einhaltung der Auflagen gebracht zu werden."

1. Fellowship-Treffen in Wien und Berlin
Matthias Kirschner organisierte das erste Fellowship-Treffen in Berlin.
Dort informierte Bernhard Reiter, der FSFE-Koordinator für Deutschland,
über die Arbeit der FSFE. Es entwickelte sich eine angeregte Diskussion.
Außerdem wurde deutliches Interesse an weiteren regelmäßigen Treffen
geäußert.
In Wien hatten Karin Kosina und Reinhard Müller zum zweiten
österreichischen Fellowship-Stammtisch eingeladen. Es entstand eine
angeregte Diskussion über Freie Software in österreichischen Schulen.
Während in Wien entschieden wurde, sich auch weiterhin alle zwei Monate
zu treffen, könnten in Berlin bald sogar monatliche Treffen stattfinden,
falls sich genug Freiwillige finden, die bei der Organisation mithelfen.
Kommende Fellowship-Treffen werden wie üblich über die Veranstaltungs-

2. Beginn der Diskussion über Freie Software an österreichischen Schulen
Die meisten österreichischen Schulen benutzen immer noch größtenteils
proprietäre Software und lehren den Umgang mit ihr. Auch wenn an vielen
Schulen vielversprechende Ansätze bei der Einführung Freier Software zu
beobachten sind, liegt immer noch ein langer Weg vor uns. Die FSFE hat
jetzt einen E-Mail-Verteiler eingerichtet, der für die allgemeine
Diskussion über Freie Software im Unterricht in Österreich gedacht ist,
ohne sich dabei auf ein bestimmtes Projekt oder einen Schultyp zu
konzentrieren.

3. Erster Entwurf der GPLv3 vorgestellt
Das MIT in Boston (USA) war Gastgeber der ersten internationalen
Konferenz zur GPLv3. Georg Greve, Stefano Maffulli und Ciaran O'Riordan
repräsentierten die FSFE bei diesem Ereignis, das den ersten Meilenstein
auf dem Weg zu einer neuen Version der weltweit erfolgreichsten Lizenz
für Freie Software darstellt.
4. Microsoft versucht nach wie vor, fairen Wettbewerb zu verhindern
In einer Pressemeldung kündigte Microsoft an, an Stelle von
Spezifikationen den Quellcode von Windows Server zu lizenzieren. Der
Konzern behauptet, damit die Anforderungen der Europäischen Kommission
zu erfüllen. Die FSFE war dazu in der Lage, schnell darzustellen, dass
diese Ankündigung lediglich ein weiterer Versuch ist, von Microsofts
Nichteinhaltung der Anordnung des Europäischen Gerichtshofs abzulenken.
Sie stellt außerdem eine taktische List dar, um Entwickler Freier
Software in Gefahr zu bringen: Nachdem ein Entwickler diesen Quellcode
gesehen hat und dazu vollständig kompatible Software schreibt, könnte er
von Microsoft wegen Urheberrechtsverletzungen vor Gericht gebracht
werden.
Einige Medien, darunter das Wall Street Journal und die International
Herald Tribune, folgten in diesem Fall den Erklärungen der FSFE.

FSFE: "Microsoft reicht vergifteten Apfel" - "Lob war verfrüht"
Die Free Software Foundation Europe (FSFE) beurteilt Angebot kritisch,
Quellcode anstelle von Protokollen zu veröffentlichen.
Der Präsident der FSFE, Georg Greve, erklärt dazu: "Die Europäische
Kommission hat Microsoft aufgefordert, ihre Protokolle zu
veröffentlichen, um damit anderen zu ermöglichen, kompatible Software
zu schreiben und um den Wettbewerb wiederherzustellen. Dies
scheint nicht so umgesetzt worden zu sein. Zumindest sind die
Konditionen, unter denen die Protokolle angeblich verfügbar sind,
unklar. Was Microsoft stattdessen getan hat, ist die Veröffentlichung
von Quellcode. Dies wurde ihnen aber nicht auferlegt."
In einer Pressemitteilung [1] hat Microsoft gestern angekündigt, "den
gesamten Windows-Server-Quellcode zu lizensieren". Dies soll Microsofts
"Engagement bezüglich der Einhaltung der Auflagen" unterstreichen.
Der FSFE zufolge würde dies keinen Deut nützen, stattdessen nur
zusätzliche Schwierigkeiten schaffen. Der Rechtsberater der FSFE, Carlo
Piana, beschreibt die Situation so: "Dieses 'Engagement' ist vergiftet,
denn Microsoft führt es auf eine Art und Weise durch, die die Situation
für Freie Software verschärft: Weil der Quellcode urheberrechtlich von
Microsoft geschützt ist, können Entwickler, die den Quellcode
eingesehen haben, diesen nicht in Freier Software reimplementieren.
Dies könnte dann eine Urheberrechtsverletzung darstellen."
"Microsoft könnte versuchen, den Wettbewerb damit abzuwürgen, indem es
behauptet, sein Urheberrecht sei verletzt worden - mit Hinweis darauf, dass
der Entwickler ja den Quellcode eingesehen haben 'könnte'", lautet die
Vorhersage von Piana.
Dem fügt Georg Greve hinzu: "In der Tat kann dies geschehen. Wie sollen
Entwickler interoperable Software schreiben, ohne den Quellcode
anschauen zu können, weil die Spezifikationen nicht öffentlich sind?
Wenn man von diesem Apfel isst, so wird man vergiftet von Microsofts
Copyright."
Nachdem die FSFE die neuen "Shared Source" Lizenzen [2] der Redmonder
Firma, die sich gegenüber den ersten Angeboten substantiell verbessert
haben, begrüßt hat, wollte sie Microsoft eine Chance geben.
"Nun scheint es offensichtlich, dass dies nur einen weiteren
Marktstreich darstellte: Gestern hat Microsoft wie ein Räuber
reagiert, der nachdem er aufgefordert wurde, das Gewehr wegzulegen,
einfach eine Handgranate auf dich warf. Unser Lob war verfrüht",
sagt Greve abschließend.
