FSFE für Freiheit statt Angst
Die Free Software Foundation Europe setzt sich für Freie Software ein,
damit jeder Bürger sich selbstbestimmt, aktiv und mündig in der
Informationsgesellschaft beteiligen kann. Internetzensur, Missachtung
der Netzneutralität und zunehmende Netzüberwachung lassen sich mit
diesen Zielen nicht vereinbaren. Daher ruft die FSFE zur Beteiligung am
weltweiten Aktionstag "Freiheit statt Angst" am 11. Oktober auf.
"Freie Software gewährt uns das Recht, diese Software zu jedem Zweck zu
verwenden, zu studieren, sie an unsere Zwecke anzupassen und veränderte
Versionen anderen Menschen zur Verfügung zu stellen. Wenn nun aber
unsere Rechte durch fragwürdige Gesetze wie zum Beispiel den so
genannten Hackerparagraphen immer weiter zurechtgestutzt werden, kann es
passieren, dass wir am Ende aufgrund von Gesetzen kaum noch von den vier
Freiheiten Gebrauch machen können" befürchtet Matthias Kirschner,
stellvertretender Deutschlandkoordinator der FSFE.
In Berlin startet um 14 Uhr am Alexanderplatz die Großdemonstration.
Das Ereignis wird alleine in Deutschland von über 100 Organisationen
unterstützt. Daneben sind bereits in 21 weiteren Ländern Aktionen
geplant: So werden z.B. auch in den Städten Paris, Stockholm, London,
Sofia und Luxemburg Demonstrationen stattfinden, in Rom und Zürich sind
künstlerische Aktionen angekündigt und in Washington D.C. mehrere
Diskussionveranstaltungen geplant. In den Niederlanden stehen unter dem
Titel "Volksopstand 2008" [4] ab 12 Uhr eine Kundgebung am Platz der
zweiten Kammer in Den Haag sowie im Anschluss daran vielfältige Formen
des Protests wie Workshops oder ein "privacy markt" auf dem Programm.

Nutzern die Freiheit gibt es zu verändern und modifizierte Versionen zu
veröffentlichen - individuell oder in Zusammenarbeit mit anderen. Die
Free Software Foundation Europe (FSFE) gratuliert zu den wesentlichen
Errungenschaften des ersten Vierteljahrhunderts und freut sich weiterhin
darauf, das gemeinsame Ziel, Freie Software, voranzutreiben.
27. September 2008 — Heute vor 25 Jahren gründete Richard M. Stallman
das GNU-Projekt mit dem Ziel ein vollständiges Betriebssystem zu
erschaffen, das es jedem erlaubt es zu nutzen, zu studieren, zu teilen
und zu verbessern. Diese Freiheiten garantieren allen Nutzern die
Unabhängigkeit und Flexibilität um ihren Computer für jeden Zweck zu
nutzen, ohne künstliche Beschränkungen, die proprietäre Software den
Nutzern auferlegt, wie Anbieter-Lock-in, proprietäre Dateiformate und
Digital Restrictions Management (DRM). Von seinen bescheidenen Anfängen
im Labor für künstliche Intelligenz am MIT entwickelte sich GNU zu einem
der bekanntesten Betriebssysteme der Welt und begünstigte die
Entwicklung tausender anderer Freie-Software-Anwendungen.
Die Free Software Foundation (FSFE's Schwesterorganisation mit Sitz in
Boston, MA) wurde 1985 gegründet um die Kerngedanken hinter Stallmans
GNU-Projekt bekannt zu machen: dass die Freiheiten Software zu prüfen,
zu ändern, zu kopieren und zu teilen für eine gerechte und freie
Gesellschaft entscheidend sind. Ein Großteil der Arbeit wurde in den
Jahren zwischen 1983 und 1991 erledigt und diese Arbeit legte den
Grundstein für viele weitere Projekte, die den Nutzern später ebenso
diese Freiheiten gewährten. 1992 wurde das Betriebssystem mit einer
wichtigen Komponente vervollständigt: dem Linux-Kernel. Der Erfolg des
GNU/Linux-Betriebssystems ermutigte zu der Entwicklung weiterer
Freie-Software-Projekte wie Firefox, KDE und OpenOffice.org. Heute gibt
es hunderte GNU/Linux-Distributionen auf der Welt. Sie laufen auf den
verschiedensten Geräten, vom Webserver über Küchengeräte bis zu
Mobiltelefonen und Laptops.
"Den Beitrag des GNU-Projektes in der datenverarbeitenden Welt kann man
kaum überbewerten", sagt Georg C. F. Greve, Präsident der Free Software
Foundation Europe (FSFE). "Zum ersten Mal gab es ein Bewusstsein für
Freie Software und das Konzept des Copylefts revolutionierte die Art wie
sich die Freiheit verbreitete und schützte. Beide intellektuellen
Errungenschaften legten das Fundament für den immensen Erfolg von
GNU/Linux, welches sich in der Zwischenzeit zum größten Mitbewerber
proprietärer Betriebssysteme in allen Bereichen der Datenverarbeitung
entwickelt hat. Man findet es in großangelegter Forschung ebenso wie auf
erschwinglichen Laptops für Endverbraucher. Auf diese Weise war GNU
Ursprung dafür, dass die Nutzer Kontrolle über ihre elektronische
Arbeitsumgebung und ihre Daten erhielten.
Die FSFE wurde im Jahre 2001 gegründet um die politischen und sozialen
Ziele zu verfolgen, die auch dem GNU-Projekt zugrunde liegen, und um die
florierende europäische Freie-Software-Gemeinschaft zu unterstützen.
"Die FSFE arbeitet eng mit ihren Partnern in Europa und darüber hinaus
zusammen, um den Geist von Stallmans ursprünglicher Ankündigung zu
erhalten, in der Praxis auszuüben und um ein Bewusstsein für Freie
Software zu schaffen." erklärt Shane Coughlan, Koordinator der FSFE
Freedom Task Force.
Immer mehr Länder wenden sich dem Einsatz Freier Software im
öffentlichen Sektor und im Bildungswesen zu. Während viele Unternehmen
seit langem Freie Software benutzen und an ihr mitarbeiten, um
Wettbewerbsvorteile und Kosteneinsparungen zu erzielen, erkennen
Regierungen und Behörden zunehmend die Vorteile Freier Software in
Hinblick auf Souveränität, Transparenz und Selbstbestimmung. Durch ihre
Grundeigenschaft, Teilhabe, Zusammenarbeit und Nachhaltigkeit zu
fördern, garantiert Freie Software allen Nutzern die Möglichkeit, ihre
EDV-Zukunft zu bestimmen und zu gestalten.

1. Vorträge der FSFE @ SELF, Freie Software und Lizensierung auf der FKFT
Im Juli war die FSFE auf der Free Knowledge, Free Technology Konferenz in Barcelona
vertreten um über das SELF Projekt, Freie Software und Lizensierung zu berichten.
Der Präsident der FSFE, Georg Greve, hielt am 16. Juli einen Vortrag über das SELF
Projekt, wie es dabei hilft, den aktuellen 'State of the Art' zu verbessern, und wie
die von SELF geleistete Arbeit wertvolle Beitrüge für Freie Software liefert.
Der Vortrag war mit "Wie SELF hilft, freie Infrastrukturen zu errichten"
("How SELF helped building structures for freedom") betitelt; ihm folgte ein Vortrag
von Shane Coughlan, dem Koordinator der Freedom Task Force (FTF), mit dem Titel
"Lizenzen, die Freiheit erhalten". Die Konferenz schloss mit einem gemeinsamen
Essen für Fellows der FSFE, Freunden Freier Software und den Repräsentanten
der FSFE in Barcelona, Georg Greve, Jonas Öberg und Shane Coughlan am Nachmittag
den 17. Juni.
2. Lokale Fellowship-Treffen
Lokale Fellowship-Treffen haben in letzter Zeit in Dublin, Brüssel, Zürich,
Lille und Göteborg stattgefunden. Auf jedem einzelnen Treffen haben Fellows und
Mitarbeiter der FSFE die aktuelle Lage wie auch den Handlungsbedarf bei bestimmten
Projekten diskutiert, lokale politische Angelegenheiten besprochen und sich
Gedanken gemacht, wie man die Fellowship selbst weiter verbessern könnte.
Zusätzlich zu diesen Treffen tragen Diskussionen auf den öffentlichen Mailing-
listen der FSFE dazu bei, in Zukunft größere und regelmäßigere Treffen
durchführen zu können. England/Das Vereinigte Königreich (UK), Belgien und
Irland sind nach aktuellem Stand die warscheinlichsten Orte für die ersten
regelmäßigen 'Pilot'-Treffen.
3. Die neuen Praktikanten der FSFE
Stian Rødven Eide und Johannes Tiemer sind die neuen Praktikanten der FSFE in
Göteborg. Stians Hauptaufgabe ist die Organisation der im Oktober stattfindenden
FSCONS Konferenz in Bezug auf Freie Software und die Repräsentation von Fellowship
und FSFE mit einem Informationsstand auf dem Europäischen Sozialforum im südschwedischen
Malmö, welches bereits im September stattfindet.
Johannes ist Student und studiert normalerweise VWL in Kiel. Sein Aufgabenbereich
sind Studien und Analysen, unter anderem des schwedischen Marktes für Freie Software.
Benjamin Morant ist Georg Greves Assistent in den Züricher Büros. Er organisiert
einen Stand auf dem 'Braderie de Lille' (Frankreich) im September (siehe auch 10.),
und zeichnet Comics über den 'alltäglichen Wahnsinn' im Büro.
Weiterhin bedankt sich die FSFE bei Irina, die während ihres Praktikums bei der
Organisation von Konferenzen half sowie viele administrative Aufgaben übernahm.

4. AStA der Uni Bochum veranstaltet Vorlesung über die politischen Aspekte Freier Software
Der Allgemeine Studierendenausschuss (AStA) der Uni Bochum lud am 23. Juni
zu einer Vorlesung über grundlegende Ideen und die politischen Implikationen
Freier Software ein, die von Bernhard Reiter gehalten wurde.
Die Vorlesung war Teil einer Vorlesungsreihe zum Thema IT und Datenschutz
und legte besondere Aufmerksamkeit darauf, inwiefern Entscheidungen für oder
gegen eine bestimmte Software bereits politisch sein können, welche Vorteile
die Benutzung Freier Software mit sich bringt und weshalb MS Word das falsche
Format zum Versenden von Dokumenten ist. Der Vorlesung folgte eine lebhafte
Diskussion mit dem Publikum - etwa 20 Studenten.
Der AStA, als vom Studierendenparlament gewähltes Gremium, das die Studierenden
vertritt, ist eine der besten Plattformen um Freie Software an Universitäten
zu verbreiten, insbesondere da das Ideal freier Wissensvermittlung und
Bildung an den Universitäten viel mit den Grundgedanken Freier Software
gemeinsam hat.

5. Schulungsunterlagen der FTF auf der SELF Plattform veröffentlicht
Die Freedom Task Force (FTF) der FSFE hat begonnen die aktuellen
Schulungsunterlagen für Freie Software im SCORM eLearning-Format
auf der SELF Plattform zu veröffentlichen:

Unter 'Introduction to Free Software and Open Standards' in der Navigation
(links) findet sich dann der Artikel 'The strategic implementation of
Free Software in business'. Weitere Abschnitte des Kurses werden nun
wöchentlich von der FSFE freigegeben.
6. Fellowship-Treffen in Zürich - 15.08.2008
Am Freitag, dem 15. August, fand am Abend ein Fellowship-Treffen in den
FSFE Büros in Zürich statt. Bei Freibier (as in beer ;) trafen sich etwa
zehn Fellows und FSFE Mitarbeiter in geselliger Runde um ausführlich über
den Status Quo und die Zukunft von Freier Software in der Schweiz zu
diskutieren. Shane Coughlan, Koordinator der FSFE in rechtlichen Fragen und
Gastgeber, hielt sein Versprechen, nicht über Lizenzen zu sprechen, und
erzählte stattdessen vom Fiduciary License Agreement (treuhänderische
Urheberrechtsverwaltung), das unter anderem auf der KDE Konferenz Akademy '08
einige Aufmerksamkeit bekam.
7. "Wem gehört Freie Software? Eine Debatte um Patent- und Urheberrecht" Rede auf der OSiM World, Berlin - 17.08.2008
"Wem gehört Freie Software? Eine Debatte um Patent- und Urheberrecht" war der
Titel des Vortrags, den Shane Coughlan, der Koordinator der Freedom Task Force (FTF) der FSFE,
am 17. August auf der OSiM World in Berlin hielt. Der Vortrag befasste sich hauptsächlich
mit Fragen um das Eigentum an kreativer Arbeit, den Nutzen für den Konsumenten und die Community
sowie das Verhältnis von Eigentumsrechten und Freie-Software-Lizenzen.
8. Offizieller Startschuss für die GPLv3 in den Niederlanden - 19.08.2008
Am Mittwoch hielt Shane Coughlan, der Koordinator der Freedom Task Force (FTF) der FSFE,
einen dreistündigen Workshop über "Lizensierungs- und Rechtsfragen in Bezug auf
die GPLv3" anlässlich der Freigabe der GPLv3 in den Niederlanden. Der Workshop
wurde von NLnet gesponsert und fand an der Universität Tilburg in
Amsterdam statt.

9. Erstes Fellowship-Treffen in Stuttgart - 22.08.2008
Am Freitag den 22. August um 19:00 Uhr ist Fellowship-Treffen im Unithekle
(Allmandring 17, 70596 Stuttgart). Dies ist das allererste Fellowship-Treffen
in Stuttgart, und alle Fellows und an Freier Software Interessierten aus
Stuttgart und Umgebung sind herzlich eingeladen vorbeizukommen!
Das Treffen soll die Möglichkeit bieten sich gegenseitig kennenzulernen und
vor allem auch den Grundstein für weitere Fellowship-Treffen in Stuttgart

10. Stand der Fellowship auf dem Flohmarkt in Lille (Frankreich) am 06. und 07.09.2008
Der sogenannte "Braderie de Lille" (Lille's Flohmarkt) ist eine große
Freiluftveranstaltung, die seit dem 12. Jahrhundert jedes Jahr am ersten
Septemberwochenende stattfindet. Chtinux, eine regionale Linux-User-Group,
hat der Fellowship der FSFE eine Teilnahme vorgeschlagen.
Die FSFE und speziell die Fellowship haben hier die Möglichkeit eine breite
Öffentlichkeit zu erreichen, da unzählige Menschen aus aller Welt
die "Braderie de Lille" besuchen.
Kommt und besucht das wunderschöne Lille, genießt die auf dem Flohmarkt
dargebotene kulinarische Vielfalt - zum Beispiel die Muscheln! Kommt um die
Fellowship zu unterstützen!

Die FSFE begrüßt die Einführung der 'Treuhänderischen
Lizenzvereinbarung' (FLA) durch KDE e.V.
Die Free Software Foundation Europe (FSFE) begrüßt die Einführung der
Treuhänderischen Lizenzvereinbarung (Englisch: Fiduciary Licence
Agreement, FLA) im K Desktop Environment Projekt (KDE). Die FLA ist eine
Urheberrechtsabtretung, mit deren Hilfe die Urheber Freier Software
und auch ganze Projekte ihr Urheberrecht treuhänderisch an eine
Organisation oder Person übertragen können. Dies ermöglicht es, die
rechtliche Verwaltung zu straffen und zu vereinfachen, sodass die
Fähigkeit zur Relizenzierung und zur Durchsetzung der Lizenzen - auch
vor Gericht - erhalten bleibt.
"Die Einführung der FLA durch den KDE e.V. ist für uns ein positives
Zeichen und ein wichtiger Meilenstein in der Entwicklung Freier
Software." sagt Georg Greve, der Präsident der FSFE. "Das Abkommen ist
dafür gedacht, Projekten dabei zu helfen, auf lange Sicht die Verwaltung
ihrer urheberrechtlichen Ansprüche und ihrer Rechtssicherheit zu
vereinfachen. KDE zählt zu den größten und wichtigsten Initiativen in
der Welt der Freien Software und spielt eine zentrale Rolle darin, den
Desktop zu 'befreien'. Die Entscheidung, die FLA für KDE einzuführen,
unterstreicht die Entschlossenheit des Projekts, heute schon die
Probleme von morgen zu lösen und seine Freiheit nachhaltig
sicherzustellen."
Adriaan de Groot, stellvertretender Vorsitzender des KDE e.V., der
Organisation, die hinter dem KDE Projekt steht, sagte: "Um Urheberrechte
treuhänderisch an KDE zu übertragen, befürwortet der KDE e.V. bevorzugt
den Einsatz einer bestimmten FLA, welche direkt auf der
Beispielvereinbarung der FSFE basiert. Wir finden, dass diese Abtretung
des Urheberrechts eine sinnvolle Möglichkeit für Einzelne ist; jedoch
werden wir niemanden, der an KDE mitarbeitet, dazu zwingen, von dieser
Möglichkeit Gebrauch zu machen. Es gibt andere Wege das Urheberrecht
abzutreten oder zu übertragen, jedoch sehen wir die FLA als den
unkompliziertesten Weg an. Die positiven Reaktionen ließen nicht auf
sich warten -- die Leute fragten bereits vor dem Wochenende nach
gedruckten Exemplaren des Formulars um es ausfüllen zu können."
"Die FLA ist ein vielseitiges Dokument, das so gestaltet wurde, dass es
auch in verschiedenartigen Rechtssystemen mit unterschiedlichen
Urheberrechtsbegriffen funktioniert." erklärt Shane Coughlan,
Koordinator der Freedom Task Force (FTF). "KDE, als ausgesprochen
internationales Projekt, ist ein hervorragendes Beispiel dafür, wie die
FLA für mittel- bis langfristige Rechtssicherheit sorgen kann. Es war
ein Vergnügen dem KDE e.V. bei Einführung und Umsetzung beiseite zu
stehen. Die Freedom Task Force der FSFE freut sich darauf, die gute
Zusammenarbeit mit dem KDE Projekt auch in Zukunft weiterzuführen."
Über die FLA (Fiduciary Licence Agreement):
Die Treuhänderische Lizenzvereinbarung (FLA) wurde von Dr. Axel
Metzger (Ifross) und Georg Greve (FSFE) in Rücksprache mit
international renommierten Experten aus Recht und Technik entworfen.
An unterschiedlichen Phasen des Entwicklungsprozesses waren die
folgenden Personen beteiligt: RA Dr. Till Jaeger, Carsten Schulz,

'Hausarbeit' d.h. Verwaltung gehört in jeder Organisation in der Regel zu den
eher unbeliebten Aufgaben, in Organisationen die unter Zeitdruck arbeiten
stapelt sich mit der Zeit genau diese 'Hausarbeit'.
So auch bei der FSFE, die im letzten Jahr ihre Kräfte vor allem darauf
konzentrierte, die 'Freedom Task Force' aufzubauen sowie Kartellverfahren,
'OfficeOpenXML' und weitere Themen abzudecken.
Glücklicherweise konnte das sorgfältig vorbereitete dreitägige Treffen der
Generalversammlung der FSFE im Juni diese 'Hausarbeit' auf die entsprechenden
Schultern verteilen und alle Teilnehmer mit einer langen To-Do-Liste wieder
nach Hause entlassen. Erste Ergebnisse dieses Treffens sollten im Laufe des
kommenden Jahres sichtbar werden.
Dies bedeutet selbstverständlich nicht dass die Arbeitsgruppen in der FSFE in
der Zwischenzeit untätig die Hände in den Schoß gelegt hätten! Das STACS EU
Projekt konnte gute Neuigkeiten vermelden, es wurde weiter Aufklärung zu
Freier Software und Lizensierungsfragen betrieben, und die 'Fellowship' war
aktiv wie nie mit Treffen in den Hauptstädten Berlin und Wien.
Diese Treffen sind die besten Treffpunkte um andere 'Fellows' zu treffen und
gemeinsam aktiv zu werden. Natürlich werden wir weiterhin solche Treffen
organisisieren und unterstützen - wenn wir in Deiner Gegend noch nicht aktiv
sind, ergreif die Initiative und organisier' selbst eins, wir helfen Dir
dabei!

1. Generalversammlung der FSFE in Zürich (Schweiz)
Vom 6. bis zum 8. Juni fand in Zürich das jährliche Treffen der
Generalversammlung der FSFE statt. Die Teilnehmer schlossen sich über die
gesamten drei Tage in den Züricher Büros ein um vergangene, aktuelle und
zukünftige Projekte zu besprechen. Budgetplanung und Personalpolitik wurde
bewertet und Satzungsänderungen beschlossen, die nach der Absegnung durch
alle notwendigen Ämter veröffentlicht werden. Bleibt dran, mehr Informationen

2. STACS enthüllt die 'Citizens Science' Webseite
Das STACS Projekt ist stolz, die Veröffentlichung seiner Webseite 'Citizens
Science' verkünden zu können. Das Ziel dieser Webseite ist es, eine Plattform
für Forscher und Nichtregierungsorganisationen (NGO) bereitzustellen, auf
welcher beide Parteien für gemeinsame Projekte zusammenfinden sollen.
Betrieben wird 'Citizens Science' vom STACS-Projekt, hinter dem die FSFE und
fünf weitere NGOs stehen, die alle - wie die FSFE mit freier Software - ihr
eigenes Spezialgebiet wie z.B. Förderung der Demokratie, Verbesserung des
öffentlichen Gesundheitswesens oder Biomedizin besitzen.

3. Die FSFE begrüßt das Release von WINE 1.0
Die Free Software Foundation Europe begrüßt die wichtige Arbeit der
Wine-Entwickler, Anwendern bei der Migration auf Freie Software zu
unterstützen.
Matthias Kirschner dazu: "Das ist wie mit Schwimmflügeln, sie nehmen
Kindern die Angst und helfen ihnen eigenständig schwimmen zu lernen.
Sie gleichen sozusagen den Balast aus, den unfreie Software ihnen
auferlegt hat."

4. 'Untersuchung der Bedeutung freier Softwarelizenzen' auf der IOTC 2008,
Irland
Auf der Irish Open Source Technology Conference (IOTC) in Dublin wurde die
FSFE von Shane Coughlan repräsentiert. Der von ihm am 18.6. gehaltene Beitrag
behandelte das Thema Freie Software im Geschäftsleben. Unter den Sprechern
der Konferenz befanden sich außerdem Graham Taylor vom 'Open Forum Europe',
Adam Jollans von IBM und Stephen McGibbon von Microsoft. Über die Zukunft des
Softwaremarktes in Nordwesteuropa gab es auf der Konferenz viele
unterschiedliche Meinungen und dementsprechend auch ebenso viele lebhafte
Diskussionen.
5. Fellowship-Treffen in Wien
Am 20. Juni fand in Wien das 23. Fellowship-Treffen in Österreich statt.
Inoffiziell ab 18 Uhr und ab 19 Uhr mit offiziellem Programm waren sowohl die
österreichischen Fellows als auch alle an der FSFE oder Freier Software
Interessierten zu diesem stetig populärer werdenden Treffen eingeladen.
6. Fellowship-Treffen in Berlin
Die Fellowship Gruppe in Berlin traf sich am 12. Juni im 'Newthinking Store'.
Das Treffen begann um 19:30 Uhr, wobei die Teilnahme jedem an Freier Software
Interessiertem frei stand.
7. Die FSFE begrüßt ihren neuen Systemadministrator
Der Bedarf der Systeme der FSFE ist mittlerweile so groß geworden, dass die
Administration durch freiwillige Administratoren nicht mehr ausreicht und sie
professioneller Pflege bedürfen. Nach einer europaweiten Suche fiel die Wahl
auf Emil Radulovic aus Serbien. Emil ist Mitglied des Serbischen FSFE Teams
und der Partnerorganisation FSN Serbia. Nachdem er einen Überblick über die
Systeme gewonnen hat, wird Emil mit der Generalüberholung der Infrastruktur -
beginnend beim Server der Fellowship - anfangen.

8. 'Wie SELF den Aufbau freier Strukturen unterstützt' Beitrag auf der FKFT,
16.07.2008
SELF hat bisher auf verschiedenen Ebenen dazu beigetragen, Freiheit für
Software und Lehre zu vertreten und zu verbreiten. Die Arbeit der
Rechtsexpertengruppe von SELF hat dabei sehr geholfen, ein besseres
Verständnis Offener Standards zu fördern und stellt eine Referenz für freie
Unterrichtsmaterialien bereit. Georg Greve, Präsident der FSFE und
Koordinator der SELF Rechtsexpertengruppe, wird in seinem Beitrag einen
Einblick geben, wie die Arbeit in SELF den Status Quo verbessert hat und in
Zukunft auch positive Auswirkungen auf das Ökosystem freier Software haben
wird.
9. 'Lizenzen die Freiheit fördern' Beitrag auf der FKFT, 16.07.2008
Shane Coughlan wird in diesem Beitrag Lizenzen vorstellen, die Freiheiten
sowohl bereitstellen als auch schützen. Darunter die Freiheit anzuwenden, zu
studieren, weiterzugeben, und zu verbessern; und zwar im Kontext von
Technologie und Bildung. Weiterhin wird er die maßgeblichen Herausforderungen
besprechen, vor denen Plattformen wie SELF in rechtlicher Hinsicht stehen,
und welche Vorkehrungen hier für einen stabilen rechtlichen Rahmen sorgen
können. Ebenso wird die Arbeit der Freedom Task Force der FSFE thematisiert
werden, die Schulung und Unterstützung in rechtlichen Fragen freie Software
betreffend anbietet.
10. Fellowship-Treffen in Zürich, 18.07.2008
Das nächste Fellowship-Treffen wird am 18. Juli von 18 bis 19:30 Uhr in den
Büros der FSFE in Zürich stattfinden. Alle Fellows sind eingeladen bei etwas
Freibier [sic!] am Treffen teilzunehmen. Dies stellt eine gute Gelegenheit
dar, sich gegenseitig kennenzulernen, Möglichkeiten zu diskutieren um den
Bekanntheitsgrad freier Software in der Schweiz zu erhöhen, und einen netten
Abend zu verbringen. Diese Treffen wird von Shane Coughlan organisiert, der
auch Koordinator der Rechtsabteilung der FSFE ist. Er hat jedoch versprochen,
das Thema Lizensierung nicht anzuschneiden, bevor er darauf angesprochen wird.

Schwimmflügel für die Freiheit
Viele Firmen habe bei der Umstellung auf Freie Software das Problem,
dass sie auf Spezialapplikationen angewiesen sind, welche vom Hersteller
nicht plattformunabhängig geschrieben wurden.
Diese Programme behindern die unternehmerische Freiheit, Hardware oder
das Betriebssystem frei zu wählen. Dies ist schädlich für den Wettbewerb
und schädlich für das einzelne Unternehmen, da diese Anwendungen meist
nicht von heute auf morgen durch Freie Software ersetzt werden können.
Die Free Software Foundation Europe begrüßt die wichtige Arbeit der
Wine-Entwickler, Anwendern bei der Migration auf Freie Software zu
unterstützen.

Weise hat Wine sich um die Freiheit der Nutzer verdient gemacht, dafür

Über Offene Standards
Der Einschluss von Daten ist einer der am häufigsten verwendeten
Techniken, um die Kosten eine Migration auf Freie Software künstlich
zu erhöhen. Die Sicherung der bestmöglichen Interoperabilität durch
Offene Standards trägt entscheidend dazu bei, es Nutzern zu
ermöglichen, einer Herstellerabhängigkeit zu entgehen. Die Arbeit
der FSFE an Offenen Standards zielt darauf ab, sicherzustellen, dass
man nicht seine ganzen Daten verlieren muss, wenn man auf Freie
Software migriert.

Wir entschuldigen uns für die Verzögerung in der Veröffentlichung dieser
Übersetzung und bedanken uns bei den ehrenamtlichen Helfern im deutschen
Übersetzungsteam.
Im April machten weiterhin Fragen der Standardisierung Schlagzeilen.
Aber auch andere wichtige Themen wurden rund um die Welt diskutiert.
In Amsterdam veranstaltete die Freedom Task Force der FSFE den ersten
European Legal and Licensing Workshop. Über die Methoden, um die
rechtliche Infrastruktur für Freie Software in Europa zu verbessern,
bestand ein weitgehendes Übereinkommen. In Brasilien bot die 9.
FISL-Konferenz ein Forum für verschiedene Diskussionen über die Adaption
und Weiterentwicklung freier Technologien.
Auch das Fellowship und FSFE-Freiwillige waren aktiv. Den Berliner
Fellows gehörte ein Stand auf einer Distributions-Release Party und die
italienischen Freiwilligen arbeiteten weiter daran eine nachhaltige
Organisation ihres Teams aufzubauen.

1. FTF-Workshop führt zu weitreichendem Übereinkommen über die
europäische Lizenzierungs-Infrastruktur
Der kürzlich von der FSFE veranstaltete European Legal and Licensing
Workshop führte zu produktiven Diskussionen und weitgehenden Einigungen
in wichtigen Bereichen der Lizenzierung Freier Software zwischen
kommerziellen und nicht-kommerziellen Interssenvertretern. Die
Veranstaltung fand Anfang April in Amsterdam mit der höchstmöglichen
Zahl an Teilnehmern statt. Shane Coughlan, Koordinator der FTF,
erklärte: "Dies markiert ein Beispiel für die wachsende Relevanz Freier
Software in Europa. Wir haben zwar noch viel zu tun, wenn wir eine
starke Infrastruktur zur Unterstützung der Gemeinschaft sicherstellen
wollen. Aber wie dieser Workshop gezeigt hat, sind der Wille und die
Bereitschaft zur Schaffung dieser Infrastruktur bei allen Entscheidern
vorhanden." Informationen über den Workshop werden in Kürze
veröffentlicht.
2. Qualitätsmängel bei Standardisierung ein ernstes Problem
Die FSFE veröffentlichte vor der zweiten Abstimmung im September letzten
Jahres ihre "Sechs Fragen an die nationalen Standardisierungsgremien".
Bedenkt man die Äußerungen über die hinsichtlich MS-OOXML gemachten
Fortschritte, hätte man hoffen können, dass wenigstens eine dieser
Fragen sich einer zufriedenstellenden Antwort erfreuen würde," erklärte
der Vizelandeskoordinator Deutschland der FSFE, Matthias Kirschner.
"Unglücklicherweise ist dies nicht der Fall. Themen wie der
'Konverter-Scherz' und die 'Fragen zu offenen Formaten' sind noch immer
gleichermaßen aktuell. Wie die Artikel 'Deprecated before use' und
'Interoperability woes with OOXML' demonstrieren, ist die
Interoperabilität von MS-OOXML im Vergleich zu offenen Standards stark
eingeschränkt. Zu diesen Problemen treten rechtliche Bedenken, die von
mehreren Parteien erhoben wurden."
FSFE-Vizepräsident Jonas Öberg führt aus: "Die Regierungen müssen
anfangen sich zu fragen, was das ISO-Gütesiegel in Wirklichkeit
bedeutet. Wie die MPEG-Standards zeigen, garantierte es niemals, dass
etwas tatsächlich einen aussagekräftigen 'Offenen Standard' darstellt."

3. Lizenzierung als strategischer Imperativ, Rede auf dem FISL
Shane Coughlan, Koordinator der Freedom Task Force der FSFE, hielt auf
dem diesjährigen FISL in Porte Alegre, Brasilien, eine Rede über die
strategische Relevanz der Lizenzierung von Freier Software. Das FISL ist
mittlerweile zur vielleicht weltgrößten Veranstaltung für Freie Software
gewachsen. Dieses Jahr kamen 7000 Besucher. Unter den angesehenen
Rednern waren Jon 'Maddog' Hall, Theodore Ts'o von der Linux Foundation
und Mitchell Baker von der Firma Mozilla. Auch bekannte Gesichter aus
Europa wie Kurt Yrvin von Trolltech und Bram Moolenaar, der Schöpfer von
VIM, waren unter den Teilnehmenden.
4. Fellowship-Gruppe bei Ubuntu-Release Party in Berlin
Die Fellowship-Gruppe Berlin nahm an der "Hardy Heron"-
Veröffentlichungsveranstaltung in der Berliner c-base teil. Sie bot
einen Vortrag von Fellow Torsten Grote über Gobuntu -- ein GNU/Linux-
Betriebssystem, das versucht, vollständig frei zu sein -- sowie die
Wichtigkeit Freier Software im Allgemeinen. Die Gruppe war auch mit
einem Stand vertreten, der viele interessierte Besucher anzog, die sich
über Freie Software informieren wollten. Während Ubuntu selbst nicht
vollständig Freie Software darstellt, so hat es doch sehr dazu
beigetragen sie vielen Menschen zugänglich zu machen. Das Fellowship
Berlin wollte darauf aufbauen und das Gespräch über unser Ziel -- die
100-prozentige Zurverfügungstellung Freier Software für alle -- fördern.

5. Italienisches Team: Neue Mailingliste und erneuertes Blog
Das italienische Team der FSFE hat kürzlich eine neue öffentliche
Diskussions-Mailingliste über Freie Software und Aktivitäten der FSFE in
Italien gestartet. Alle italienischen Fellows, Freiwilligen und
Interessierte sind eingeladen teilzunehmen und neue Ideen, Vorschläge
und Fragen jeder Art einzubringen. Sie können sich für die

6. Linuxwochen, Wien, Österreich (15.05.2008 bis 17.05.2008)
Im Rahmen der österreichischen Linuxwochen fand vom 15. bis zum 17. Mai
2008 eine Veranstaltung im Gewerbehaus der Wirtschaftskammer,
Rudolf-Sallinger-Platz 1 im 3. Bezirk in Wien statt. Eine Gruppe von
Fellows der FSFE betreute einen Stand, an dem sie über die FSFE, das
Fellowship und über Freie Software im allgemeinen informierte.
7. Fellowship-Stammtisch in Wien (17.05.2008)
Der zweiundzwanzigste österreichische Fellowship-Stammtisch wurde in die
Linuxwochen Wien integriert. Fellows und andere Interessierte trafen sich
während der gesamten Veranstaltung am Stand der FSFE zu interessanten
Diskussionen, und am Ende des letzten Tages nahmen sie an der
Linuxwochen-After-Show-Party teil.

8. LinuxTag 2008, Berlin, Deutschland (28.05.2008 bis 31.05.2008)
So wie in den letzten Jahren wird die FSFE mit einem Stand beim LinuxTag
2008 vertreten sein. Er findet auf dem Berliner Messegelände unter dem
Funkturm statt. Die FSFE wird Besucher über verschiedene Aspekte Freier
Software informieren, wie etwa die Freedom Task Force, Software-Patente,
das SELF-Projekt, die GPLv3, unsere Arbeit bei den Vereinten Nationen

Auswärtiges Amt für Einsatz offener Standards ausgezeichnet
Dem Auswärtigen Amt wurde heute anlässlich des Document Freedom Days
(DFD) für die Nutzung und Förderung offener Standards in- und ausserhalb
der Bundesbehörde gedankt. Vertreter der Free Software Foundation Europe
(FSFE) und des Fördervereins für eine Freie Informationelle
Infrastruktur e.V. (FFII) überreichten einen Brief an den Außenminister
und Vizekanzler Dr. Frank-Walter Steinmeier sowie ein passendes Buch und
eine große Torte mit DFD-Logo.
"Wir freuen uns, dass wir Ihnen diese Auszeichnung überreichen können",
meint Matthias Kirschner, stellvertretender Deutschlandkoordinator der
FSFE. "Auch wenn es für jede öffentliche Verwaltung aus wirtschaftlichen
und rechtsstaatlichen Prinzipien selbstverständlich sein sollte, offene
Dokumentenstandards zu unterstützen."
Das Auswärtige Amt setzt nicht nur intern langfristig auf offene
Dokumentenformate wie z.B. das Open Document Format (ODF), sondern tritt
auch innerhalb der Bundesverwaltung und auf internationaler Ebene dafür
ein. Michael Schinagl von der DFD-Gruppe German-Legal-Fellowship dazu:
"Während offene Standards hauptsächlich in Expertenkreisen außerhalb der
öffentlichen Wahrnehmung diskutiert werden, betreffen offene
Dokumentenstandards unmittelbar jeden Bürger. Das Auswärtige Amt erfüllt
als eine der wenigen Behörden die Anforderung, für jeden Bürger auch
digital erreichbar zu sein."
"Die Verwaltung hat die Pflicht dafür zu sorgen, dass ihre Vorgänge
langfristig überprüfbar sind. Dies kann bei elektronischen Daten nur
durch offene Standards gewährleistet werden", meint Matthias Kirschner.
"Wir hoffen, dass andere Verwaltungen sich in diesem Punkt am
Auswärtigen Amt ein Beispiel nehmen." Dem schließt sich Michael Schinagl
an: er verweist auf die "Aktenmäßigkeit der Verwaltung" als Kernpunkt
jedes modernen Verwaltungshandelns. Andere Behörden müssen sich die
Frage gefallen lassen, wie sie ohne offene Standards den Zugriff auf
ihre Dokumente und Register über Jahrzehnte sicherstellen wollen. Sie
sind nicht Herr über die eigenen Daten."
"Der Austausch elektronischer Dokumente zwischen Bürgern und
Verwaltungen darf nicht von einzelnen Herstellern abhängig sein", meint
Stephan Uhlmann vom FFII Deutschland. "Offene Dokumentenstandards
erlauben einen echten Wettbewerb von Softwarelösungen, mit denen die
entsprechenden Dateiformate gelesen und verarbeitet werden können.
Dadurch wird niemand durch die Verwendung eines bestimmten Produktes
ausgeschlossen. Davon profitiert gerade auch die europäische Wirtschaft,
welche durch kleine und mittelständische Unternehmen geprägt ist, die
allzu oft von großen marktbeherrschenden Unternehmen vom Markt verdrängt
werden."
= Hintergrund =
Offene Standards sind die Grundlage für Interoperabilität und
Entscheidungsfreiheit, basierend auf den Vorzügen verschiedener
Anwendungen. Sie bieten Unabhängigkeit der Daten und dadurch auch vom
(Software-) Anbieter. Dies macht Offene Standards esssentiell für
Verwaltung, Firmen, Organisationen und einzelne PC-Anwender. Während
Offene Standards generell als sehr wichtiges Thema bzw. Ziel angesehen
werden, ist die Definition von "Offenem Standard" noch immer kontrovers.
Im Zuge des DocumentFreedomDay ist das Verständnis des "Offenen
Standards":
- Voller, unbeschränkter öffentlicher Zugriff und Benutzung, in einer
für alle Beteiligten gleichermassen möglichen Form
- Kein Teil darf Abhängigkeiten von Protokollen und/oder Formaten
aufweisen, welche nicht exakt der Definition Offener Standards
entsprechen
- Frei von rechtlichen und/oder technischen Klauseln, welche die Nutzung
für irgendeinen Beteiligten oder ein Geschäftsmodell einschränken
- Verwaltet und weiterentwickelt, unabhängig von einem einzelnen
Anbieter, in einem für jeden Konkurrenten und Dritten offenen Prozess,
an dem sich jeder gleichermassen beteiligen kann
- verfügbar in verschiedenen fertigen Implementationen der
konkurrierenden Anbieter, oder als einzelne, für alle gleichermassen
verfügbare Implementation (mit einer "Schonfrist" für sich
entwickelnde Standards)

Dokumentenfreiheit. Über 200 Teams von Freiwilligen in über 60 Ländern

Frohes Neues Jahr zusammen! Der vergangene Monat war recht aufregend,
die größte Nachricht war wohl die Herausgabe der Interoperabilitäts-
Informationen im Zusammenhang mit dem europäischen Kartellverfahren
gegen Microsoft. Das SAMBA Projekt hat nun vollen Zugriff auf
Spezifikationen, die notwendig sind, damit konkurrenzfähige Alternativen
mit den proprietären Lösungen von Microsoft kommunizieren können. Das
bedeutet natürlich nicht, dass Microsofts monopolistisches Verhalten
gelöst ist. Nach Beschwerden von Opera Software, dass Microsoft
vorsätzlich den Markt für Browsersoftware verzerrt habe, könnte ein
weiteres Kartellverfahren angestrengt werden. Es ist ebenfalls wichtig
zu betonen, dass dies in keiner Weise das Problem mit Softwarepatenten
löst. Solche Patente werden noch immer trotz anders lautendem
Gesetzestext vom Europäischen Patentamt (EPO) erteilt. Die FSFE ruft die
Europäische Kommission dazu auf, Maßnahmen zu treffen, die
Softwarepatente gänzlich abschaffen, nicht nur in der Theorie sondern
auch in der Praxis.
Eine weitere Nachricht war, dass Google sich dazu entschieden hat, die
Freedom Task Force der FSFE zu unterstützen. Zu den Aufgaben der FTF
gehört es, den Menschen zu helfen, Freie Software Lizenzen zu verstehen.
Veranstaltungen zu Freier Software in Skandinavien und auf dem Balkan
zeigten, dass sich sowohl Freie-Software-Technologien als auch die
dahinter stehenden Werte in Europa weiter ausbreiten. Desweiteren wurden
Bedenken über die Vorratsdatenspeicherung in Deutschland laut. Es sieht
nach einem sehr geschäftigen Jahr 2008 aus! Sie können ein Teil davon
sein, indem Sie Ihre Zeit und Energie in Aktivitäten der FSFE stecken,
anderen Leuten über Freie Software erzählen und einige der großartigen

1. MS gegen EU - Microsoft übergibt Interoperabilitäts-Informationen dem
SAMBA Projekt
2004 befand die Europäische Kommission Microsoft des Monopolmissbrauchs
im IT-Sektor für schuldig und forderte, dass Mitbewerbern die
vollständigen Interoperabilitäts-Informationen zur Verfügung gestellt
werden. Microsoft legte Widerspruch gegen diese Entscheidung ein; dieser
wurde im September 2007 vom Europäischen Gericht in erster Instanz (EuG)
abgelehnt. Das EuG befand Microsoft der vorsätzlichen Verhinderung der
Interoperabilität für schuldig und hielt die Verpflichtung Microsofts
aufrecht, die Protokollinformationen mitzuteilen.
Das Samba Team entschied Microsofts Verpflichtung unter Europäischem
Recht zu nutzen. Durch die Protocol Freedom Information Foundatioin
(PFIF) wurden die Netzwerk-Interoperabilitäts-Informationen angefragt
und es wurde eine einmalige Zugangsgebühr von 10.000€ bezahlt, um dem
Samba Team vollen Zugang zu wichtigen Spezifikationen zu verschaffen.
"Dieser Fall ist geschlossen und die Interoperabilität hat gewonnen.
Der Europäische Gerichtshof stellte klar, dass
Interoperabilitätsinformationen nicht geheim gehalten werden sollten
und das Abkommen zeigt, dass Microsoft keinen Weg mehr sah, die
Behinderung der Interoperabilität auf diesem Gebiet aufrechtzuerhalten.
Dies setzt einen Standard, an den sich von nun an jeder halten muss",
fasst Georg Greve, Präsident der FSFE, zusammen.

2. FSFE unterstützt neues Kartellverfahren
Opera Software hat sich formell über Microsofts wettbewerbsfeindliches
Verhalten im Webbrowsermarkt beschwert, dies könnte ein weiteres
Kartellverfahren der Europäischen Kommission in Gang setzen. Die FSFE
hat einen Brief an die EU-Wettbewerbskommisarin Neelie Kroes geschickt,
in dem sie ihre Unterstützung in jeder Art von Untersuchung aufgrund
der genannten Beschwerde anbietet.
"Auch wenn Opera Software keine Freie Software produziert, so teilen wir
ihre Beurteilung und Bedenken in Bezug auf die gegenwärtige Situation im
Internetbrowsermarkt", schreibt FSFE Präsident Georg Greve in dem Brief
und fährt fort: "Einige der erfolgreichsten Browser in diesem Markt sind
Freie Software oder beinhalten große Teile Freier Software. Dies
schließt Mozilla Firefox und Konqueror, einen KDE-Browser, mit ein.
Diese Produkte sind hoch innovativ und weithin als sicherer anerkannt
als das dominierende Programm. Sie implementieren gewissenhaft
internationale Offene Standards der Browser-Technologie."

3. Google unterstützt Arbeit der FTF
Die FSFE Freedem Task Force bietet Schulung und Beratung über Freie-
Software-Lizenzen an. Wir unterhalten unter anderem ein europaweites
Netzwerk von Rechtsexperten und arbeiten mit gpl-violations.org
zusammen, um Lizenzierungsprobleme zu lösen. Im Wesentlichen hilft die
FTF, eine Infrastruktur aufzubauen, die zur Einführung Freier Software
und ihrer angemessene Verwendung führt.
Kürzlich begann Google, der FTF zu helfen, Kurse anzubieten, Konferenzen
beizuwohnen und Dokumentationen in mehr Sprachen zu übersetzen. Wie alle
NGOs haben wir begrenzte Mittel und Googles Unterstützung macht einen
spürbaren Unterschied. Wir möchten Chris und dem Rest des Teams vom
Googleplex dafür danken, dass sie an unsere Arbeit glauben und es uns
ermöglichen, sie fortzusetzen.

4. Geschichte Freier Software in Berlin
Am 13. Dezember fand ein lokales Treffen der Berliner Fellowship-Gruppe
statt. Unter den ca. 20 Teilnehmern aus dem Raum Berlin befanden sich
auch Besucher mit weiterer Anreise: Georg Greve (Präsident der FSFE) und
Bernhard Reiter (Deutschland-Koordinator der FSFE). Bei Tee, Lebkuchen
und anderen Süßigkeiten (+Bier) wurde über den Beginn der FSFE geredet,
wie die Teilnehmer zu Freier Software kamen und andere schöne, lustige
und interessante Geschichten erzählt, die nett in die vorweihnachtliche
Stimmung passten.

5. FScons
Im Dezember nahmen fast 200 Teilnehmer an der Fscons (Free Software
Conference in Skandinavien) teil. Während dieser zwei Tage konnten die
Teilnehmer verschiedene Präsentationen verfolgen, deren Themen von
Freier Software Lizenzierung bis zu Freier Software in eingebauten
Geräten reichten. FSCONS wurde von der FSFE ausgetragen und wird eine
jährliche Veranstaltung werden um Menschen aus den nordischen Ländern
zusammenzubringen.

6. Privatsphaere.org Treffen zum Thema Datenschutz
"Die Bürger sollten die Regierung kontrollieren, nicht die Regierung die
Bürger!" war ein spontaner Ausruf Teilnehmender einer Veranstaltung von
privatssphaere.org, einer Gemeinsamen Initiative von UUGRN.org, des
"Laboratory for Dependable Distributed Systems" der Universität Mannheim
und der FSFE. Nach sechs Vorträgen über die Europäische Richtlinie zur
Vorratsdatenspeicherung, der deutschen "Online-Durchsuchung" und der
elektronischen Gesundheitskarte aus verschiedenen Perspektiven waren
sich ca. 80 Teilnehmer darüber einig, dass das Anhäufen von Datenbergen
Terrorismus nicht verhindern kann, aber dafür zusätzliche Probleme für
die Gesellschaft als Ganzes schafft. Ein Besucher fragte: "Wo sind all
die Journalisten, Abgeordneten, Steuerberater und Ärzte? Sie hätten
dieser tollen Veranstaltung beiwohnen sollen!" Drei Redner wiederholten
ihre Empfehlung, Freie Software zu benutzen um ein Minimum an
Privatsphäre zu gewährleisten. Die FSFE hob hervor, dass Menschen
vorsichtiger sein sollten, wenn es darum geht, persönliche Informationen
an Datensammlungen abzugeben.
7. STACS Sitzung in Belgrad
Am 4. Dezember hielt die FSFE eine STACS-Projekt-Sitzung in Belgrad ab.
Vertreter der Zivilgesellschaft aus der Gegend und der EU nahmen an
Workshops, Diskussionen und Brainstormings über interessante Projekte
mit dem Schwerpunkt Zukunftsentwicklung teil.

8. Serbisches Ministerium für Informationsgesellschaft unternimmt
Lokalisierungsbemühungen
Laut offizieller Webseite des serbischen Ministeriums für
Informationsgesellschaft wird es in die Anpassung von Freie Software an
die lokalen Besonderheiten, wie z.B. Sprachanpassungen, investieren, um
Lösungen für den öffentlichen und den privatwirtschaftlichen Sektor
bereitzustellen. Fedora und Ubuntu GNU/Linux Distributionen werden
zusammen mit GNOME, KDE, OpenOffice.org und Mozilla Produkten (Firefox
und Thunderbird) lokalisiert. Die Arbeit wird in Kooperation mit
serbischen Universitäten unternommen. Erste Kontakte mit
Lokalisierungsteams und der Freien-Software-Gemeinschaft werden
gegenwärtig geknüpft.

EU Kartellverfahren beendet: Samba erhält Interoperabilitäts-Informationen
2004 befand die Europäische Kommission Microsoft des
Monopolmissbrauchs im IT Markt für schuldig und verlangte, dass die
vollständigen Interoperabilitäts-Informationen den Wettbewerbern
zugänglich gemacht werden. Microsoft hat Widerspruch gegen diese
Entscheidung eingelegt, was vom Europäischen Gerichtshof Erster
Instanz (EuGH) im September 2007 zurückgewiesen wurde. Der EuGH befand
Microsoft der mutwilligen Behinderung der Interoperabilität für
schuldig und hielt die Verpflichtung für Microsoft aufrecht, seinen
Wettbewerbern die betreffen den Protokollinformationen zur Verfügung
zu stellen.
Das Samba Team entschloss sich nun, von dieser Verpflichtung gegenüber
Microsoft auf der Grundlage der Europäischen Entscheidungen Gebrauch
zu machen. Über die Protocol Freedom Information Foundation (PFIF)
wurde um die Interoperabilitäts-Informationen gebeten und eine
einmalige Zugangsgebühr in Höhe von 10.000 EUR wurde bezahlt, um Samba
vollständigen Zugang zu diesen wichtigen Spezifikationen zu
verschaffen.
"Das Verfahren ist beendet und die Interoperabilität hat gewonnen. Das
Europäische Gericht machte klar, dass Informationen zur Interoperabilität
nicht geheimgehalten werden dürfen und die Vereinbarung zeigt, dass
Microsoft keine Chance mehr sah, seine Behinderung der Interoperabilität
in diesem Bereich fortzusetzen. Damit ist ein Maßstab gesetzt, an dem
sich jeder künftig wird messen lassen müssen," fasst Georg Greve, der
Präsident der Free Software Foundation Europe (FSFE) zusammen.
FSFE Vizepräsident Jonas Öberg ergänzt: "Weitere Gewinner sind alle
Anwender von Applikationen, die die Produktivität in der Gruppe
steigern: Samba wird jetzt vollen Zugang zu allen Informationen
erhalten, die notwendig sind, um vollständige Interoperabilität mit den
heutigen und künftigen Workgroup Servern von Microsoft zu erzielen. Alle
Anwender werden davon profitieren - sogar die von Microsoft selbst, denn
steigender Wettbewerb wird vermutlich für sinkende Preise und Margen bei
Microsoft sorgen.
"Unter den gegebenen Umständen, dank den Verbesserungen, die wir
erzielen konnten ist dies die bestmögliche Lösung. Zwar werden damit
nicht alle Probleme beseitigt, die wir mit Microsoft haben - es
verbessert nur teilweise eine unfaire und illegale Situation. Damit wird
nichts bereinigt, sondern es werden lediglich die Auflagen erfüllt, die
die Kommission verhängt und der Europäische Gerichtshof bestätigt hat.
Und wenigstens steht die Vereinbarung völlig im Einklang mit Freien
Software Lizenzen," kommentiert Carlo Piana, Anwalt der FSFE.
Piana ergänzt: "Wir haben ein für allemal eine Liste von Patenten
erhalten, von denen Microsoft behauptet, dass sie sich auf die
Spezifikationen beziehen. Unerhörter Weise wurde uns nie genau
mitgeteilt, um welche Patente es sich handelt. Das sollte helfen, das
Verbreiten von Angst, Unsicherheit und Zweifeln gegenüber Samba zu
beenden und wir hoffen, dass das selbe auch auch mit anderen Freien
Software Projekten geschehen wird. Das ist gängige Praxis: Wer ein
Problem mit jemandem hat, sollte sagen, um was es geht - oder für immer
schweigen."
"Die Europäische Kommission wurde scharf wegen ihrer Vereinbarung mit
Microsoft kritisiert, insbesondere weil sie mögliche relevante Patente
von Microsoft nicht für unwirksam erklärt hat," Jonas Öberg fährt fort:
"Das System taugt nichts und bedarf der Überarbeitung, aber es ist nicht
die Aufgabe von Verwaltungsbeamten, bestimmte Patente für wirksam oder
unwirksam zu erklären. Was wir brauchen ist ein informativer,
transparenter und demokratischer Dialog in dieser Angelegenheit."
Georg Greve ergänzt: "Die Europäische Kommission ist weiter gekommen als
jede andere Wettbewerbsbehörde weltweit und war erfolgreicher. Sie
verdient unsere Anerkennung und Unterstützung dafür, dass sie 80 Prozent
des Weges zurückgelegt hat. Trotzdem wäre es wünschenswert gewesen, wenn
sie den Mut aufgebracht hätte, auch die Probleme beim Namen zu benennen,
die durch Patente auf Interoperabilität und dadurch für den Wettbewerb
entstanden sind, einschließlich einer klaren Ansage an die richtigen
politischen Adressaten."
"Wir sollten auch nicht vergessen, dass dies lediglich ein Bereich ist,
in dem Microsoft das gleiche Verhalten zeigt. Es gibt bedeutende
Kartellvorwürfe sowohl vom European Committee for Interoperable Systems
(ECIS) und von Opera bezüglich missbräuchlichen Verhaltens im Office-,
Internet- und Webbrowser- Bereich," ergänzt Greve. "Wenn die gleichen
Methoden in einem Bereich missbräuchlich sind, dann sollten sie es auch
in anderen sein. Daher sollte die Kommission nicht zögern, auch die
anderen Vorwürfe zu untersuchen, wenn sie dem positiven Beispiel folgen
will, das sie selbst seit 1998 gesetzt hat."
"Das Ergebnis insgesamt ist positiv. Als die FSFE 2001 begann, die
Kommission in ihren Wettbewerbsermittlungen gegen Microsoft zu
unterstützen, war es unser Ziel, diese Informationen für Freie Software
zur Verfügung zu stellen. Wir haben genau das erreicht, in dem wir seit
2003 mit dem Samba Team zusammenarbeiten."
Jonas Öberg kommt zu dem Schluss: "Softwarepatente waren bisher ein
Problem, und sie bleiben auch heute ein Problem. Wir müssen dieses
Problem politisch lösen und die FSFE hat weiterhin vor, daran zu
arbeiten. In der Zwischenzeit möchte ich ich all den Freiwilligen und
Angestellten der FSFE und Samba danken, die ohne große Unterstützung von
