Lieber Herr Professor Köhler,
"Deutschland soll ein Land der Ideen werden" haben Sie in der Rede nach
Ihrer Wahl zum Deutschen Bundespräsidenten formuliert. - Diese Ideen zu
patentieren, haben Sie nicht verlangt! – unserer Ansicht nach aus gutem
Grund. Denn nur mit dieser Einstellung werden wir dem Lissabon-Ziel der
Staats- und Regierungschefs näher kommen, bis 2010 "wettbewerbsfähigste
wissensbasierte Wirtschaft" zu werden.
Tatsächlich unternimmt Europa - mit massiver Unterstützung von
Deutschland - das genaue Gegenteil, von dem, was getan werden sollte:
Mitte Mai hat der Ministerrat der Europäischen Union bekräftigt, ein
Gesetz zum Einklagen von Lizenzgebühren aus Softwarepatenten schaffen
zu wollen - entgegen der Bedenken von 30 Informatikprofessoren in Europa
[1], der Monopolkommission [2], dem MIT [3], der Boston University
School of Law [4] und fachkundigen Personen aus Politik, Wirtschaft und
Wissenschaft [5].
Nun patentieren Softwarepatente keine Softwareprogramme (der Quellcode
ist nämlich durch das Urheberrecht geschützt!), sondern sie verhindern,
dass kreative Sperrgebiete von Softwareentwicklern betreten werden, die
zu langsam mit dem Patentantrag waren. Es handelt sich in Wahrheit also
um Software-Ideen-patente.
Ich möchte den entstehenden Schaden für Staat, Wirtschaft und
Gesellschaft an drei Beispielen dokumentieren: Hätte es Mitte des
18. Jahrhunderts schon Ideenpatente gegeben, hätte Joseph Haydn
ein „Musikstück aus vier Sätzen mit Gesang und Melodie“ patentieren
können. Die Folge: Haydn hätte für jede von Mozarts 41 Sinfonien
Lizenzzahlungen in beliebiger Höhe verlangen können.
Ähnlich ist es heute. Der Telefonie übers Internet wird zugetraut, ihren
Umsatz bis 2007 zu vervierfachen - ein wahrer Wachstumsmarkt also. In
den USA beschäftigen sich 880 Patente mit diesem Thema. De facto
entsteht ein riesiges kreatives Sperrgebiet mit dem neue Lösungen
verhindert werden.
Das wäre etwa so, wie wenn Tim Berners Lee - der Erfinder des World
Wide Web - seine einmalige Idee hätte schützen lassen wollen: Das WWW
wäre einem engen zahlungskräftigen Club von Auserwählten vorbehalten
geblieben.
Wir sind selbstverständlich mit Ihnen einer Meinung, dass die
Gesellschaft die Leistung eines Softwareentwicklers angemessen
honorieren und belohnen muss - sonst fehlt dem Einzelnen der Anreiz,
seine Fähigkeiten der Gemeinschaft zur Verfügung zu stellen. Um
Software zu schützen, gibt es bereits ein funktionierendes Urheberrecht.
Zusätzliche Softwarepatente sind da eher hinderlich.

**AGNULA: ein "lebendiges Ökosystem" für Entwickler und Anwender*
Freier Multimediasoftware*
"Für große Tonstudios wäre es sicher interessant, wenn sie ihre
Audiosoftware flexibel individuell auf ihre Bedürfnisse hin anpassen
könnten - schliesslich müssen sie heute erst beim Hersteller fragen,
wenn sie was geändert haben wollen. Das kostet Zeit und Geld."
so die Einschätzung von Michael Spiess, Toningenieur aus dem
Südbayerischen Babensham.
Und für die kleine Dorfband sei so Spiess - die Freiheit, mit der
Software das zu tun, was sie tun wollten allemal von Vorteil: "Unter
Windows gibt es viel, aber auch viel Schrott - professionelle
Anwendungen laufen unter GNU/Linux oder Apple. Gerade Hobbymusiker
sind aber häufig zum Improvisieren gezwungen. Die heute üblichen Systeme
lassen genau das nicht zu."
"Die künstlerische Freiheit in technischer Hinsicht herstellen" - so
hätte das Motto von AGNULA (A GNU/Linux Audio distribution -
www.agnula.org) lauten können : Im Rahmen des EU Projekts wurden zwei
lauffähige GNU/Linuxdistributionen für Debian und Redhat speziell für
professionelle Musiker und Multimediaautoren entwickelt - "AGNULA stellt
somit heute schon die umfangreichste Freie Softwareumgebung für Künstler
überhaupt", ist sich Projektleiter Nicola Bernadini sicher. Zu den
bereits vorhandenen Anwendungen
gehören auch Synthesizer oder eine graphische Benutzungsoberfläche zur
Bedienung von "Csound" - einer in "C" geschriebenen (ebenfalls freien)
Klangsoftware. Der technische Leiter Andrea Glorioso sieht AGNULA als
"Ökosystem" aus Entwicklern und Anwendern: "Wir brauchen die Erfahrungen
der Anwender, um Fehler beheben zu können, die bei der Anwendung
auftreten. Deshalb ist es von größter Bedeutung, möglichst viele
Entwickler und Anwender von den Vorteilen Freier Software zu überzeugen.
Je mehr Menschen an diesem Ökosystem teilhaben, desto lebendiger kann es
sich entwickeln. Deshalb muß AGNULA so schnell wie möglich die kritische
Masse bei Entwicklern und Anwendern erreichen."
Auch in rechtlicher Hinsicht will AGNULA Beispiel für andere Freie
Software Projekte sein: Von besonderer Bedeutung ist für den Präsidenten
der Free Software Foundation Europe (FSFE) Georg Greve, die
AGNULA-Sammlung Freier Software davor zu bewahren, "durch proprietäre
Software verunreinigt zu werden. Damit gibt es ein 'Freiheits
Gütesiegel' für Anwender, die wissen, daß sie bei "AGNULA" immer die
volle Freiheit bekommen."

Rund um die offizielle Generalversammlung der Free Software Foundation
Europe am 15. Mai haben die Kernmitglieder die Gelegenheit genützt,
verschiedene Ideen zu diskutieren, wie die Öffentlichkeit noch besser
über die Aktivitäten der FSFE informiert werden könnte. Eines der
Ergebnisse war die Entscheidung, periodisch einen Newsletter
herauszugeben, und dies hier ist der erste.
2. Entscheidung des Rates zur Softwarepatent-Direktive
Das meistdiskutierte Ereignis im Mai war wahrscheinlich die Entscheidung
des Rates der Europäischen Union über die Softwarepatent-Direktive.
Nachdem das Europäische Parlament klar gegen die unbeschränkte
Patentierbarkeit von Software-Algorithmen abgestimmt hatte, hat die
irische Präsidentschaft eine Version der Direktive vorgeschlagen, die
praktisch alle Änderungen des Parlaments rückgängig macht. Obwohl manche
Länder ihr nicht zugestimmt haben, erhielt diese Version die notwendige
qualifizierte Mehrheit im Rat.
Die Tatsache, dass der Widerstand des Rates gegen Softwarepatente doch
noch stärker als erwartet war, kann wohl auch als Ergebnis der
erfolgreichen Zusammenarbeit zwischen FSFE, FFII und vielen anderen
Organisationen betrachtet werden, die Bürger und Politiker gleichermaßen
über die Gefahr informierten, die vom Vorschlag der Präsidentschaft
ausgeht. Da der Entscheidungsprozess noch nicht abgeschlossen ist, wird
die FSFE weiterhin mit diesen Organisationen an der Softwarepatent-
Problematik arbeiten.
3. AGNULA
Auch wenn AGNULA (A GNU/Linux Audio Distribution) bereits von allen
Beteiligten (und auch von der EU, die das Projekt mitfinianziert hat)
als großer Erfolg angesehen wird, ist die Arbeit mit der Freigabe der
ersten Version noch nicht abgeschlossen. Die FSFE unterstützt dieses
Projekt nach wie vor, indem Sie bei Sachen wie der "AGNULA trademark
license" (der Lizenz für den Markennamen "AGNULA") mithilft.
4. FSFE Pressesprecher Joachim Jakobs
Um die Kernmitglieder von der zunehmend arbeitsintensiven Pressearbeit
zu entlasten, wird Joachim Jakobs auf Teilzeitbasis als Pressesprecher
der FSFE arbeiten.
5. Georg Greve in Südamerika
Georg Greve besucht derzeit mehrere Ziele in Südamerika, um dort
Kontakte mit lokalen Freie-Software-Aktivisten zu knüpfen, und sie beim
Aufbau eines Freie-Software-Netzwerks nach dem Vorbild der FSFE zu
unterstützen. Unter seinen öffentlichen Auftritten in Südamerika finden
sich ein Interview für Argentiniens wichtigste Zeitung, eine Rede in der
Universität von Cordoba über Freie Software in der Bildung, ein
Fernsehinterview, ein Interview für die größte Radiostation in Uruguay
und die Keynote für USUARIA, einem südamerikanischen Kongress über Freie
Software. Wir erwarten, dass diese Aktivitäten dazu beitragen werden,
ein globales Netzwerk von Organisationen rund um Freie Software
aufzubauen, worin die FSFE ein wesentlicher Teil sein wird.
6. Schutz Freier Software vor Überregulierung
Das italienische Team war sehr damit beschäftigt, auf ein neues
italienisches Gesetz Einfluss zu nehmen, das der Freien Software schaden
könnte. Um den Schaden zu begrenzen, den Peer-to-Peer-Filesharing der
Film- und Musikindustrie angeblich zufügt, schlug die Regierung ein
Gesetz vor, das es verbietet, digitale Inhalte im Internet zu
veröffentlichen, ohne gegenüber der SIAE zu deklarieren, dass man eine
Lizenz dazu hat. Das Gesetz führt noch weitere Restriktionen ein und
macht die Verbreitung jeglicher Dateien im Internet ohne ausdrückliche
Zustimmung des Autors (auch die Verbreitung ohne Gewinnabsicht) zu einem
kriminellen Akt, der mit bis zu vier Jahren Gefängnis bestraft wird.
Das Gesetz ist so absurd, dass die FSF Europe von der BSA (Business
Software Alliance) um eine Kooperation gebeten wurde, um seine
Verabschiedung zu verhindern. Obwohl sich schlussendlich die Regierung
und die Opposition darüber einig waren, dass das Gesetz sehr schlecht
ist, wurde es beschlossen. Die Regierung hat bereits versprochen, es
rasch zu korrigieren und halt bereits eine Überarbeitung angekündigt.
Die FSFE wird diesbezüglich weiterhin starken Druck auf das gesamte
Parlament ausüben.
7. Andere wichtige öffentliche Auftritte
Stefano Maffulli nahm an einem Forum über "Intellectual property" am
Istituto Bruno Leoni (IBL) in Italien teil, wo er einige der Probleme
von Softwarepatenten aufzeigen konnte. Am Ende des Monats nahm er an
einem Treffen von italienischen Organisationen rund um Freie Software in
Avellino teil, wo vor allem die bessere Koordination untereinander
diskutiert wurde.

Die Free Software Foundation Europe FSFE will ab sofort an jedem
ersten Montag eines Monats einem "einflussreichen" Europäer per
eMail erklären, was Softwarepatente für ihn und sein Land, seine
Firma oder Organisation bedeuten würden. Diese eMail wird auf
Englisch, Italienisch und Deutsch veröffentlicht. Die nationalen
Abgeordneten in Großbritannien, Irland, Italien, Österreich und
Deutschland erhalten eine Kopie. Der erste Adressat wird der
künftige Deutsche Bundespräsident Horst Köhler sein.
"Softwarepatente werden erhebliche Nachteile für die Wirtschaft,
die Gesellschaft und die Demokratie in Europa nach sich ziehen.
Diese Tatsache konnten wir aber bislang nicht verständlich machen.
Deshalb werden nun den Meinungsführern in Politik, Wirtschaft und
Gesellschaft erklären, was die Patentierung von Ideen für Ihr
Geschäft bedeuten wird", so Georg Greve, Präsident der Free
Software Foundation Europe (FSFE). Seine Hoffnung: "Wenn die
Meinungsführer das Problem einmal verstanden haben, werden sie der
Politik Dampf machen!" Den Beginn der Kampagne mit Horst Köhler
erklärt die FSFE mit dessen Rede nach der Wahl zum Bundespräsidenten:
"Professor Köhler wünscht sich ein 'Deutschland der Ideen' - vom
Monopolisieren dieser Ideen hat er - zu Recht - nichts gesagt!"
Zwar existieren in Europa nach Angaben der FSFE bereits 30.000
Softwarepatente. Denen fehlt allerdings die gesetzliche
Anspruchsgrundlage. Somit sind diese Patente derzeit nutzlos. Nun hat
sich aber der Ministerrat der Europäischen Union vor zwei Wochen
entschieden, eine derartige Regelung einführen zu wollen. Sollte das
neue Europaparlament dem zustimmen, würden "mit einem Schlag 30.000
Zeitbomben aktiviert und es können Lizenzgebühren "in beliebiger Höhe
eingetrieben werden", erläutert Greve und resümiert: "Damit bekommen
wir zwar eine Arbeitsbeschaffungsmassnahme für Patentfachleute,
schädigen aber die gesamte übrige Wirtschaft."
Zum Thema Softwarepatente wird von der Computer Zeitung aus dem Konradin
Verlag ein Diskussionsforum eingerichtet (www.computerzeitung.de). Hier
erfolgt zudem eine Veröffentlichung der Briefe der FSFE. Es besteht aber
auch die Möglichkeit, hier per Mail mitzudiskutieren.
Eine ähnliche Zusammenarbeit mit einem Englischen oder Italienischen
Fachmedium kann Greve derzeit noch nicht vorweisen. "Wir sind aber
zuversichtlich, auch diese noch laufenden Gespräche bald zum Abschluß
bringen zu können."

"Europa ist im Begriff, sich endgültig vom Ziel der Staats- und
Regierungschefs zu verabschieden, bis 2010 'wettbewerbsfähigste
wissensbasierte Region' zu werden und hat zumdem zum wiederholten
Male demokratisch versagt. Es ist schade, daß der Zweckoptimismus
und das Vertrauen in die deutsche Regierung etwas voreilig
gewesen zu sein scheinen. Gestern war kein guter Tag für Europa
und Deutschland!" so die traurige Bilanz von Georg Greve, dem
Präsidenten der Free Software Foundation Europe (FSFE) zu dem
Beschluß des Ministerrats der Europäischen Union über
"computerimplementierte Erfindungen".
So sei die Directive unter falschen Zielen entstanden: "Das Europäische
Patentamt hat bisher c.a. 30.000 Softwarepatente vergeben. Das
erklärte Ziel war die Möglichkeit der Patentierung von
'computerimplementierten Erfindungen' und die Legalisierung dieser
bereits erteilten Patente."
Wie Jeremy Philpott vom britischen Patent Office sagte: "Wenn
die Direktive mit allen (Anm: vom Europäischen Parlament
gemachten) Änderungen akzeptiert worden wäre, hätte es viele
Patente gegeben, die nicht mehr gültig gewesen wären. Ich kann
es nicht deutlich genug sagen: [...] Der ganze Zweck war, daß
was heute patentierbar ist auch morgen patentierbar sein wird
[...]"
"Es ging also zu keinem Zeitpunkt um die Festlegung von
innovativ sinnvollen Grenzen der Patentierung, mit der Direktive
sollen vielmehr die bereits erteilten Patente rechtlich
durchsetzbar werden. Stimmt das Europäische Parlament nun dieser
Direktive zu, werden quasi 30.000 Zeitbomben scharf gemacht -
ohne Rücksicht auf die Wirkung der Explosionen in
wirtschaftlicher und sozialer Hinsicht."
Greve's Schlussfolgerung: “Die Deutsche Justizministerin Zypries hat
einen 'Runden Tisch' mit den verschiedenen Interessengruppen zur
Förderung des gegenseitigen Verständnisses angesprochen. Anstatt
nach der Entscheidung 'Verständnisförderung' zu betreiben, schlage ich
vor, den Anlaß dazu zu nutzen, einen permanenten Runden Tisch zur
Diskussion zukunftsfähiger politischer Entscheidungen einzurichten.
Das Ziel dabei sollte es sein, wenigstens den Anschluß an den
internationalen Wettbewerb wieder zu gewinnen.“
In Bezug auf die Direktive raten wir dem Europäischen Parlament
dringend, sich nicht wider besseres Wissen auf den aktuellen
Vorschlag einzulassen. Speziell eine Definition dessen, was als
'technisch' gelten soll ist unverzichtbar, baut doch die gesamte
Direktive auf diesem Begriff. "Das wäre sonst, als baute man ein
Haus auf Rädern und ohne Bremsen in der Annahme die späteren
Bewohner würden es nicht vom Fleck bewegen, obwohl eine solche
Bewegung ihnen große Profite verspricht."

Die Free Software Foundation Europe (FSFE) "begrüßt das Bekenntnis der
Bundesregierung, dass die Freiheit von Softwarepatenten für die
europäische Innovationsgesellschaft eine herausragende Bedeutung hat",
kommentiert der Präsident der Organisation Georg Greve.
"Offensichtlich", so Greve in einer Pressemitteilung "befindet sich die
Bundesregierung im Bezug auf die Informationsgesellschaft in einem
Sinneswandel hin zu einer klaren und bürgerfreundlichen Position. "Die
FSFE wird die Bundesregierung auf diesem Weg nach Kräften unterstützen."
Der laufende Lernprozeß ist für die FSFE "besonders bemerkenswert", weil
die Bundesrepublik bei den vorbereitenden Treffen der Arbeitsgruppe des
Ministerrats lange Zeit du den "Hardlinern" gehört hat. Diese wollten
beispiels-
weise sogenannte Programmansprüche durchsetzen. Würden diese eingeführt,
wäre eine Patentverletzung bereits durch die Existenz eines Softwarepro-
gramms möglich und nicht erst mit seiner kommerziellen Verwertung. "Damit
wären schlagartig alle bedroht, die Software entwickeln - egal ob die
Software
fürs Studium, das Hobby oder den gewerblichen Gebrauch bestimmt ist -
genau das, was sich die Patentindustrie wünscht", erläutert Greve die
Bedenken und macht darauf aufmerksam, "dass es widersprüchlich ist, in
so vielen staatlichen Einrichtungen Freie Software einzusetzen und sie
gleichzeitig mit Softwarepatenten zu bedrohen." Genauso wollten die
Patentbefürworter Schnittstellen und Dateiformate monopolisieren. Das
hätte zur Folge, dass Import-/Export- oder auch simple Druckfunktionen
nur von jeweils einem Monopolisten angeboten werden könnten.
Mit dem Richtungswechsel zahlen sich für Greve die Ratschläge aus, die
die FSFE der Bundesregierung seit Jahren gebe. Große Teile der
Bundesregierung hätten in der Patentierung von Software schon länger
eine Bedrohung der Informationsgesellschaft gesehen, nun scheine sich
das Justizministerium dieser Haltung anzuschliessen.
Am vergangenen Mittwoch hatte der Ministerialdirektor im Bundesjus-
tizministerium Elmar Hucko auf einer Veranstaltung in Berlin ange-
kündigt, dass die Bundesregierung Anfang kommender Woche gegen die
umstrittene Softwarepatentrichtlinie des Rats der Europäischen Union
stimmen werde. Hucko übte nach Information des Online-Magazins
"heise.de" gleichzeitig heftige Kritik an der gegenwärtigen Vergabe-
praxis des Europäischen Patentamts (EPA) im Bereich der umkämpften
"computerimplementierten Erfindungen". "Nicht alle diese Patente
hätten erteilt werden dürfen", betonte er. "Nach dieser Bemerkung
sind wir zuversichtlich, dass auch das Justizministerium früher oder
später einsieht, dass Software niemals patentwürdig sein kann - auch
dann nicht, wenn sie zur Steuerung von Maschinen dient", heißt es in
der Stellungnahme der FSFE weiter.
Nach Ansicht von Greve muß die Bundesregierung "angesichts neuer
Erkenntnisse jetzt kurzfristig bei den anderen Mitgliedsländern der EU
dafür einsetzen, Anfang nächster Woche keine falsche Entscheidung zu
fällen.." Anschliessend müsse sie Ihre Kollegen in der Arbeitsgruppe
überzeugen, Softwarepatente in Zukunft auszuschliessen.
Dann könne dem Europäischen Parlament womöglich am Jahresende ein
Richtlinienentwurf - "zum Wohle der Freiheit und zum Segen von
Innovation und Wachstum" vorgelegt werden, der es auch in Zukunft
verhindert, "daß die Patentlobby Softwareunternehmen niederknüppelt!"

Wenn Sie am Computer sitzen, können Sie auf eine Nummer klicken und
der Computer wählt für Sie - ganz automatisch!
Wollen Sie sich mit Ihren Freunden fürs Wochenende verabreden, können
Sie genauso
einfach eine Telefonkonferenz einberufen. Und wenn Sie und Ihre
Gesprächspartner über eine Webcam verfügen, sehen Sie sich auch
noch.Sollten Sie eine 'Flatrate' in Anspruch nehmen, entstehen Ihnen
keinerlei Verbindungsgebühren.
Entsprechend beträchtlich sind die Geschäftserwartungen: IBM rechnet
bei professionellen Anwendern mit Kostenreduzierungen von 30 Prozent.
Die Marktforschungsgesellschaft Gartner rechnet damit, dass sich das
Marktvolumen bis 2007 gegenüber 2002 fast vervierfacht. Ein
hochinteressantes Geschäft also.
Und doch - die Sache hat einen Haken. Und der heisst 'Softwarepatent':
Während das Urheberrecht beispielsweise verhindert, dass jemand
"Microsoft Word" unter einem anderen Produktnamen verkauft, werden mit
Softwarepatenten Ideen geschützt und für viele Jahre zum kreativen
Sperrgebiet erklärt. So hält die Firma Apple ein Patent auf einen
virtuellen Papierkorb. Wo es entsprechende rechtliche Grundlagen gibt,
kann Apple Papierkörbe in Softwareanwendungen verhindern bzw. von den
Herstellern Lizenzgebühren in beliebiger Höhe fordern.
Doch zurück zur Internet-Telefonie: Hier ist ein ganzes Kartenhaus von
Ideen notwendig: Wie kommen Audio- und Video gemeinsam beim Anwender
an? Wie können die Daten so komprimiert werden, dass Anwender mit
schmalbandigem Analoganschluß nicht ausgeschlossen werden? - Und
dieses Gebäude der Internet-Telefonie steht und fällt mit jeder
einzelnen dieser Ideen. Professor Henning Schulzrinne von der
US-Amerikanischen Columbia University sieht nur eine Chance:
17 Jahre warten, bis alle Patente abgelaufen sind!
In den USA gibt es bereits gesetzliche Grundlagen, um Ansprüche aus
Softwarepatenten durchzusetzen. Das Europäische Patentamt vergibt seit
Jahren Patente, deren Ansprüche aber mangels Gesetz hierzulande nicht
durchgesetzt werden können. Der Ministerrat der Europäischen Union
will nun die rechtlichen Regelungen hierzulande denen jenseits des
Atlantiks anpassen. Und das, obwohl das Europäische Parlament noch im
September 2003 bekräftigt hat, es solle auch
künftig keine Softwarepatente in Europa geben. Und jetzt - keine
sieben Monate
später - machen Ministerrat und Kommission der Europäischen Union
Anstalten das genaue Gegenteil zu beschliessen. Ein
Affront gegen unsere gewählten Volksvertreter!
Dass damit die Spielregeln der Demokratie mit Füssen getreten werden,
ist dabei nur eine Randerscheinung. Viel mehr werden uns die
wirtschaftlichen und gesellschaftlichen Konsequenzen zu schaffen machen:
Das Europäische
Patentamt
hat 30.000 Softwarepatente erteilt. Wieviel kreatives und damit
wirtschaftliches Potential wird damit auf viele Jahre hinaus
blockiert? Wieviele Arbeitsplätze könnten ohne Softwarepatente künftig
entstehen??
Wer aber hat nun ein Interesse daran, Ideen zu monopolisieren und mit
Ihnen zu handeln? Im November 2003 haben die Vorstandsvorsitzenden von
Alcatel, Ericsson, Nokia und Siemens an
die EU-Kommission geschrieben und sich für die Softwarepatente stark
gemacht. Wussten Sie was sie tun? Offenbar nicht - denn gerade die
Telekomausrüster würden ein glänzendes Geschäft mit der IP-Telefonie
machen!
Auf jeden Fall haben die Patentanwälte ein Interesse an neuen und
komplexen Gesetzen: Nach der Entscheidung des Europäischen Parlaments
gegen Softwarepatente hat die Patentanwaltskammer eine zwölfseite
Stellungnahme veröffentlicht, gezeichnet vom Vorsitzenden des
"Computer-Software-Ausschusses". Aus der Sicht der über 700 Patentan-
wälte allein in München (Hier muß man natürlich noch die
Rechteverwalter in den Unternehmen und Kammern hinzuzählen!) scheint
dieser Aufwand auch gerechtfertigt, schliesslich schien diesen ja ein
wesentliches Betätigungsfeld mit Wachstumspotential abhanden zu
kommen. Aber kann es sich die Europäische Volkswirtschaft leisten,
ihre Wettbewerbs-
fähigkeit zugunsten dieser Partialinteressen zu opfern?? Solange aber
die öffentliche Diskussion von Patentanwälten in Patentämtern,
Anwaltskanzleien, Kammern, Verbänden und Ministerien bestimmt wird,
wird der Eindruck erweckt werden, die Partialinteressen seien die
Interessen der gesamten Gesellschaft.
Wissenschaftlich bestätigt wurden die Auswirkungen des Krebsgeschwürs
"Patentunwesen" vom US-amerikanischen Massachusetts Institute of
Technology. Das hat in einer Studie im Jahr 2003 festgestellt, dass
Unternehmen umso weniger in Forschung und Entwicklung investieren, je
mehr Softwarepatente sie halten.
Was passiert nun in Staat, Gesellschaft und Wirtschaft insgesamt, wenn
diese Entwicklungen nicht gestoppt werden? Wir verbieten den Menschen,
kreativ zu sein. Wir überlassen die gesellschaftliche Entwicklung den
Bürokraten, die uns auf Schritt und Tritt zu ihrem eigenen Vorteil
gängeln wollen. Der Tschechische Präsident Vaclav Klaus formuliert es
so: "Die EU besteht nicht aus Freiheit und Offenheit, sondern aus
Bürokratisierung, Dirigismus, Regulierung und Harmonisierung." Wir
können diese Diskussion also nicht weiterhin anderen überlassen, die
nur behaupten, unsere Anliegen zu vertreten.
Liebe Mitbürgerinnen und Mitbürger, Sie kennen uns - die www.fsfeurope.org
und den www.ffii.org - als Organisationen, die sich mit der Förderung
öffentlicher Informationsgüter und Freier Software beschäftigen. Das
werden wir auch in Zukunft tun. Nun werden Softwarepatente auch Freie
Sofware erheblich behindern, in der Konsequenz geht es allerdings um
weit mehr - nämlich die Versklavung der gesamten Gesellschaft durch
die Patentindustrie! Daher bitten wir Sie um Ihre Unterstützung in
unserem Kampf für die Freiheit in Europa! Dies können Sie tun, indem
Sie:
1. Bei den Politikern und Behörden Ihres Landes protestieren
2. Unternehmer -- und nicht deren Patentabteilung -- auf die Gefahren
von Software-Patenten aufmerksam machen und darum bitten
sich bei ihrer Regierung für die Innovation und gegen
Software-Patente einzusetzen.
3. Die Zeitungen in Ihrer Region/ in Ihrem beruflichen Umfeld
ansprechen. Journalisten haben Einfluss - sie müssen aber zunächst
erkennen, dass den Menschen ein Problem auf den Nägeln brennt!

Sehr geehrte Damen und Herren,
im September letzten Jahres hat das Europäische Parlament bekräftigt,
keine Softwarepatente in Europa zuzulassen. Keine sieben Monate später
hat die Irische Ratspräsidentschaft der Europäischen Union im Frühjahr
mit Unterstützung einiger Nationalregierungen (unter anderem auch der
Deutschen!) und der Europäischen Kommission eine gegenteilige
Beschlußvorlage für Softwarepatente eingebracht. Über diese
Beschlußvorlage soll am 17. Mai 2004 abgestimmt werden. Damit werden
nicht nur die Beschlüsse der legislativen ad absurdum geführt und die
Demokratie mit Füßen getreten, sondern ein derartiges Gesetz würde
negative Folgen für Wirtschaft und Gesellschaft in erheblichem Umfang
nach sich ziehen (siehe "Gemeinsame Position ..." unten).
Die Free Software Foundation Europe[1] und der Förderverein für eine
Freie Informationelle Infrastruktur e.V. [2] planen derzeit eine
Aktionswoche vom 10. bis 14. Mai, um Bürger, Wirtschaft und Politik über
die schädlichen Folgen dieser Initiative zu informieren . Im Rahmen
dieser Aktionswoche sind Demonstrationen und Podiumsdiskussionen in
zahlreichen Europäischen Hauptstädten [3]. Diese Aktionen werden von
einem offenen Brief an die Bürger Europas begleitet.
Wir würden uns freuen, wenn Sie Ihre Leser über dieses Thema informieren
und eine möglichst objektive Diskussion mit uns und anderen führen

Softwarepatente sollen künftig nach dem Willen des EU-Ministerrats Ideen
schützen. Das bedeutet, dass nicht nur Verfahren patentiert werden
können, sondern auch das Ergebnis. Somit wären auch andere Lösungswege
mit gleichem Ergebnis von einem derartigen Patent bedroht. Dadurch
können beliebige und beliebig viele Softwareideen zu intelellektuellen
Sperrgebieten erklaert werden: Dazu muss die Lösung noch nicht einmal
vorliegen: Die Idee genuegt! Bereits heute fördert die Patentdiskussion
seltsame Stilblueten zu tage: Der Buchhändler Amazon hat seine
"1-Click-Technik", mit der registrierte Benutzer mit nur einem Mausklick
eine Bestellung aufgeben koennen auch in Europa zum Patent angemeldet.
Das Patent auf den "Fortschrittsbalken" von Installationsprogrammen ist
bereits erteilt.
In einem Brief [4] an die EU-Kommission vom November letzten Jahres
haben sich die Vorstandsvorsitzenden von Alcatel, Ericsson, Nokia und
Siemens vehement für Softwarepatente ausgesprochen. So könnte man
meinen, dass zumindest Grosskonzerne von Softwarepatenten profitiere
könnten: Kleine Wettbewerber koennen schnell verdraengt werden und mit
den anderen Grossen kann man "querlizensieren": "Wenn ich tausend von
deinen Patenten nutzen darf, darfst du tausend von meinen nutzen".
Dieser Eindruck ist allerdings trügerisch: Beispielsweise ist die
IP-Telefonie in technischer Hinsicht ein komplexes Geflecht
unterschiedlicher Kompressionsverfahren - oder besser: unterschiedlicher
patententierter Ideen. In den Märkten, in denen Softwarepatente eine
gesetzliche Grundlage bekommen, hat die IP-Telefonie nach Meinung von
Professor Henning Schulzrinne von der US-Amerikanischen Columbia
University keine Chance. Er sieht dann nur eine Möglichkeit: Etwa 17
Jahre warten, bis die Patente ausgelaufen sind [5]. Die genannten
Vorstandsvorsitzenden leisten ihren eigenen Unternehmen einen
Bärendienst - denn schliesslich würden Telekomausrüster ja den
Löwenanteil des Umsatzes einheimsen, den die Marktforschungsgesellschaft
Gartner bis 2007 auf 3,6 Milliarden Euro [6] schätzt.
Wie aber ist es möglich, dass vier Weltkonzerne eine so kurzfristige
Politik betreiben? Des Rätsels Lösung ist simpel: Sie vertrauen auf die
"falschen Freunde" - ihren Patentabteilungen, Patentanwälten,
Patentfachleuten in Kammern und Verbänden. Allein in München gibt es 700
niedergelassene Vertreter [7] + [8] dieser Profession - kein Wunder
also, dass sich die Patentanwaltkammer sich in einer 12-seitigen
Stellungnahme [9] für Softwarepatente ausspricht.

Spenden-Aufruf der Free Software Foundation Europe

Im Ausblick auf das kommende Jahr
ruft die Free Software Foundation Europa[1] (FSFE)
zu Spenden für die Sicherung und Ausweitung ihrer Arbeit auf.
Die Ziele des gemeinnützigen Vereins im Bereich Freier Software
gehen weit über Technik hinaus und erfordern deshalb
eine solide finanzielle Basis.
Die Free Software Foundation Europe betreibt ein Büro in Essen.
Dort wird das Tages-Geschäft (Buchungen, Anfragen beantworten, Versand von
Materialien) abgewickelt. Dies ist notwendig, schon als Basis
für die wichtige Tätigkeit von Georg Greve,
der in Vollzeit für den Verein auf europäischer Ebene arbeitet
und Aufklärungsarbeit für Freie Software betreibt.
Die FSFE steht jeder Person als Anlaufpunkt und Orientierungshilfe
für Fragen bezüglich Freier Software zur Verfügung.
Sie steht in Kontakt zu vielen Organisationen und Gremien auf Bundes-
Europa- und UN-Ebene und leistet grundlegende Informationsarbeit zu den
vielschichtigen und komplexen Aspekten und Perspektiven Freier Software.
Der Schwerpunkt liegt dabei auf Europa,
wie kürzlich auf dem World Summit on the Information Society (WSIS) der UN.
Sie arbeitet eng mit auf diesem Gebiet tätigen Juristen
an renomierten Universitäten und in namhaften Kanzleien zusammen.
Die bislang recht begrenzten Mittel sind ein limitierender Faktor dabei,
den enorme Informationsbedarf welcher aus vielen verschiedenen Richtungen
an die FSFE heran getragen wird auch adäquat abdecken zu können.
Für die Finanzierung der laufenden und zukünftigen Arbeit ist die FSFE
auf Spenden angewiesen. Konkreter besteht ein Mehrbedarf
für das Büro in Essen, Informationsmaterial und
die anfallenden Reise- und Organisationskosten,
beispielsweise für Vorträge oder Freiwillige auf Messeständen.
Mit Stefano Maffulli, dem FSFE-Koordinator in Italien,
besteht die aktuelle Chance einen weiteren Verfechter Freier Software
mit einer Teil- oder Vollzeitstelle zu gewinnen.
Gerade in der europäischen Politik macht nur die Beteiligung
mehrerer Länder einen einflußreichen Auftritt möglich.
Die FSFE ist in Deutschland als gemeinnütziger Verein anerkannt
und freut sich über jede Spende, mit welcher sich
Entwickler, Anwender und Förderer am Fortbestand wichtiger
Aufklärungsarbeit beteiligen. Wenn ein bestimmter monatlicher
Spendenbetrag erreicht wird, erfolgt auf Wunsch die Nennung
auf der Webseite der FSFE:

die ihre Leistungen im Bereich der Freien Software begründen.
