= Saarland - Nur wenige deutliche Aussagen zu Freier Software =
== Piraten: Abhängigkeit und restriktive Lizenzen sind "gutes Recht" ==

Die Free Software Foundation Europe veröffentlicht heute ihre Freien-Software-Wahlprüfsteine für die Wahl zum Landtag des Saarlandes am 25. März. Die Parteien konnten Stellung nehmen zu Fragen über die generelle Förderung von Freier Software, dem Problem der Herstellerabhängigkeit bei unfreier Software, Offenen Standards, dem Einsatz von Freier Software in der Bildung, Werbung für unfreie Software auf Webseiten der öffentlichen Verwaltung sowie zu Softwarepatenten.
Verglichen mit den vielen positiven Antworten auf unsere Wahlprüfsteine vor der letzten Landtagswahl in Berlin, sind die Positionen der meisten Parteien im Saarland eine Enttäuschung. Sie reichen zumeist von seicht bis unverbindlich. Geradezu schockierend wirkt jedoch die Position der Saarländer Piratenpartei. In ihrer Antwort bezeichnet sie die Schaffung von Abhängigkeiten und restriktiven Lizensierungen als "das gute Recht" proprietärer Softwareunternehmen.
== Einige Ergebnisse der Befragung ==
Die *CDU* Saarland hebt sich positiv von anderen Landesverbänden der eigenen Partei ab. Zwar sind die meisten Antworten leider abweisend, doch immerhin bleiben sie - im Gegensatz zu anderen Landesverbände der CDU - beim Thema und lässt erkennen, dass sie sich mit den Fragen beschäftigt hat. Die Aufzählung von Unix und AIX in einem Zug mit GNU/Linux als Antwort auf eine Frage nach offenen Standards zeigt allerdings, dass noch viel Nachholbedarf besteht. Aber zumindest scheint im Saarland ein Landesverband der CDU im digitalen Zeitalter angekommen zu sein.
Die Aussagen der *FDP* wirken sind insgesamt unverbindlich und reichen von verhalten positiv bis vorsichtig negativ. Bestehende Monopole sind "grundsätzlich nicht im Interesse der FDP" und sie wollen zudem Marktbeschränkungen für Freie Software beseitigen. Wie dies insbesondere mit ihrer verhaltenen Position zu Offenen Standards in Einklang zu bringen ist, bleibt allerdings unklar.
Im Vergleich zu anderen Landesverbänden der *Grünen* ist die Position der saarländischen Grünen eher durchschnittlich: Zwar sind die Antworten fast durchgehend positiv zu bewerten - sie sind aber leider auch unkonkret. Es entsteht der Eindruck, als wüssten die Grünen im Saarland zwar, dass Freie Software etwas Gutes und Unterstützenswertes ist. Doch tatsächlich scheinen sie sich nur oberflächlich, mit dem Thema auseinandergesetzt zu haben.
Die Positionen der *Linken* sind ebenfalls durchgehend positiv und lassen auch erkennen, dass sie sich mit dem Thema Freie Software beschäftigt haben. Beispielsweise verweist die Linke explizit auf "die soziale Komponente" Freier Software. Manche Antworten bleiben dennoch oberflächlich und im Allgemeinen wird der Kostenaspekt Freier Software an erster Stelle genannt - ohne auf die anderen wirtschaftlichen, politischen und gesellschaftlichen Zusammenhänge weiter einzugehen. Im Vergleich zu ihren anderen Landesverbänden schneiden die Linken im Saarland daher eher mittelmäßig ab.
Die große Überraschung im Saarland ist die *Piratenpartei*, deren Antworten bei der FSFE starkes Kopfschütteln ausgelöst haben. Bisher hatten die Landesverbände der Piratenpartei meist mit einer starken Befürwortung Freier Software geglänzt. Dieses Ziel wurde sogar im Grundsatzprogramm der Partei [1] beschlossen: "Wir setzen uns für die Förderung von Software ein, die von allen uneingeschränkt benutzt, untersucht, verbreitet und verändert werden kann."
Bei der ersten Frage unserer Wahlprüfsteine möchte auch die Piratenpartei des Saarlandes noch feststellen, dass die "Piratenpartei DIE politische Kraft darstellt, die das Konzept „freier Software“ am meisten vorantreiben möchte." Doch auf die Frage, ob die Piratenpartei etwas gegen die Dienstleistungsmonopole unfreier Software zu tun gedenkt, antwortet sie:
"Es ist das gute Recht, dass bei unfreier Software der Hersteller das Monopol besitzen darf, das eigene Produkt vor Manipulation zu schützen. [...] Es kann nicht das Ziel sein, unfreie Software komplett abzuschaffen, indem man politisch darauf Druck ausübt."
Diese Antwort stellt selbst frühere Aussagen von CDU und FDP in den Schatten und erweckt den Anschein, dass die Saarländer Piraten auch im Widerspruch zu anderen Punkten ihres eigenen Grundsatzprogramms Politik machen wollen. "Das klingt gerade so, als ob die Piratenpartei im Saarland Formulierungen von Verwertungsgesellschaften und großen IT-Konzernen übernommen hat", so Matthias Kirschner, Deutschlandkoordinator der FSFE. Dabei sind die "Piraten" seinerzeit mit dem Ziel angetreten, das Urheberrecht zu reformieren. Die Piratenpartei Saarland hingegen scheint sich für das "Recht" von Rechtverwertern stark zu machen, Nutzern restriktive Lizenzen aufzudrücken. Deshalb fragt sich Kirschner weiter: "Haben sich die Piraten um eine Woche vertan und das ist ein schlechter Aprilscherz, oder ist die Lobby von Microsoft, SAP und anderen jetzt auch bei der Piratenpartei angekommen?"
Positiv hebt sich schließlich im Saarland noch die *SPD* hervor: Wie auch in vielen anderen Bundesländern, sind die Aussagen durchgehend positiv; doch mehr als die anderen Parteikollegen noch, zeigt die saarländische SPD, dass sie sich mit dem Thema beschäftigt hat und kann darauf ihre Positionen aufbauen. Leider verbleiben die Zusagen jedoch äußerst unspezifisch und damit auch unverbindlich.
