FSFE unterstützt Firmenkunden vor Europäischem Gerichtshof gegen Kontrolle durch Microsoft
(Hamburg/Luxemburg) Die Europäische Union will dem schwächelnden Markt der ITK (Informations- und Telekommunikationstechnik) auf die Beine helfen. Dazu sollte auch das Kartellverfahren gegen Microsoft beitragen, bei dem EU-Kommissar Mario Monti im März eine Geldstrafe in Höhe von 500 Millionen Euro von dem Konzern und zusätzlich Auflagen verhängte.
Eine dieser Auflagen ist das Offenlegen von Schnittstellen- informationen. Die sind beispielsweise für das Freie Software Projekt SAMBA wichtig: SAMBA verbindet die UNIX- und GNU/Linux-Welt mit der der Microsoft-Betriebssysteme. Über diese Brücke reduziert SAMBA somit die Abhängigkeit der Kunden gegenüber der Monokultur wie sie in Redmond gepflegt wird. Ohne diese Informationen kann SAMBA nicht optimal arbeiten.
Obwohl diese Maßnahmen kaum ausreichen dürften, um das Monopol des Konzerns zu brechen, scheint Microsoft so besorgt, daß es gegen den Schiedsspruch der Kommission Berufung eingelegt hat.
Nachdem die Free Software Foundation Europe bereits als Sachverständige an dem Kartellverfahren beteiligt war, wurde sie nun auch zu der (dem Prozeß) vorausgehenden Anhörung am heutigen Dienstag zugelassen, um die Entscheidung der Europäischen Union und die Freiheit von SAMBA zu verteidigen. Neben der Wahrnehmung der Interessen Freier Software im Allgemeinen wird sich die FSFE im Speziellen für die Belange des SAMBA Teams einsetzen.
Der italienische Anwalt Carlo Piana der Mailänder Kanzlei Tamos Piana&Partners wird die Interessen der FSFE und des SAMBA Teams vertreten. Piana kommentiert: "SAMBA ist praktisch der einzige Wettbewerber von Microsoft auf diesem Gebiet. Die FSFE kann sich garnicht aus diesem Verfahren heraushalten. Die Entscheidung der Kommission stellt einen wichtigen Präzedenzfall dar, der von größter Bedeutung für den Softwaremarkt und die gesamte Gesellschaft ist. Die Freiheit ist in Gefahr. Deshalb bin ich stolz auf meine Berufung in dieser Sache."
"Mit diesem Fall wird über die letzte Hürde vor einem vollkommen durch Microsoft beherrschten Severmarkt entschieden. Es geht dabei nicht in erster Linie um die Freiheit des Einzelnen, sondern die der Firmen." so Georg Greve, Präsident der FSFE. "Wir fordern alle Unternehmen auf, uns in diesem Kampf zu unterstützen. Diejenigen, die diesen Aufruf heute ignorieren, müssen damit rechnen, daß sie morgen ihre Speicher- und Verzeichnisdienste nur noch aus einer Hand beziehen können."
