FSFE, Samba: Ein Triumph für die Freiheit und den freien Wettbewerb
"Microsoft kann sich nun nicht mehr über dem Gesetz wähnen," sagt Georg Greve, Präsident der Free Software Foundation Europe (FSFE).
"Mit Taktiken, die in anderen Teilen der Welt erfolgreich die Antitrust-Verfahren ausgehebelt haben, sogar in den USA, hat es Microsoft bisher geschafft, den heutigen Tag um fast ein Jahrzehnt hinauszuzögern. Dank der Beharrlichkeit und der hervorragenden Arbeit der Europäischen Kommission haben diese Taktiken in Europa nun versagt," setzt Greve fort.
Carlo Piana, der juristische Berater der FSFE: "FSFE und das Samba Team begrüßen die Entscheidung des Gerichts. Dies ist ein Meilenstein für den freien Wettbewerb. Der Vorstellung, dass willentliche Verdunkelung von Standards und vorsätzliches "lock-in" akzeptable Geschäftspraktiken seien, wird nun ein Riegel vorgeschoben."
"Das Samba Team möchte sich bei der Europäischen Kommission für ihre außergewöhnliche Arbeit in den vergangenen Jahren bedanken," kommentiert Jeremy Allison, Coautor des Sambaprojekts. "Dies ist ein sehr wichtiger Tag für das Samba Team: wir hoffen, endlich mit gleichen Waffen im freien Wettbewerb zu kämpfen, ohne dass uns die Schnittstelleninformationen verwehrt werden. Samba wird dann auch dem Konsumenten eine echte Wahl anbieten können, mit allen Vorteilen freier Software."
Volker Lendecke vom Samba Team: "Nun da das Urteil gesprochen ist, werden wir die genauen Lizenzkonditionen für die Schnittstelleninformationen aus nächster Nähe beobachten. Es wird sehr wichtig sein, dass diese Informationen auch mit Freier Software nutzbar sind, sonst wäre der große Erfolg der Kommission arg beeinträchtigt. Samba ist einer der wichtigsten Akteure im Arbeitsgruppen-Servermarkt, jenem Markt in dem die Kommission den freien Wettbewerb wieder herstellen wollte."
"Dies ist ein sehr guter Tag für Europa, es ist jedoch nur ein Schritt auf dem richtigen Weg. Das wiederholte Thema im Verhalten von Microsoft in den letzten Jahren ist offensichtlich ihre Wahrnehmung, dass Interoperabilität eine Bedrohung ist, die bekämpft werden muss," fasst Carlo Piana, juristischer Berater der FSFE, zusammen. "Das letzte Beispiel wurde durch MS-OOXML geliefert. Laut Dough Mahug vom Microsoft ist MS-OOXML eine geschäftlich motivierte Antwort auf die Bedrohung durch den ISO-Standard ODF und der Interoperabilität und freien Wahl, welche dieser Standard bietet. Taktische, nicht technische Betrachtungen sind der Motor hinter Microsofts globalen Bemühung, nationale Standartisierungsgremien so zu beeinflussen, dass sie MS-OOXML blind als Standard absegnen."
FSFE Präsident Greve schließt: "Die heutige Entscheidung ist ein wichtiger Präzedenzfall für die Zukunft. Geheime Manipulationen von offenen Formaten und Protokollen wurden klar als nicht akzeptables Verhalten gebrandmarkt. Wir ermutigen nun die Europäische Kommission, die erst kürzlich durch die ECIS eingebrachte Antitrustklage aufzugreifen. Für die Untersuchung dieses Falles bietet die FSFE, gemeinsam mit dem Samba Team und OpenOffice.org, der Europäischen Kommission gerne ihre Expertenwissen an.
