= Gericht weist AVMs Anspruch gegen Modifizierungen dritter an GPL-Software zurück =
Am 8. November hat das Landgericht Berlin eine Entscheidung im Rechtsstreit zwischen der AVM Computersysteme Vertriebs GmbH (AVM) und der Cybits AG (Cybits) gefällt. Darüber wurde an dieser Stelle bereits früher berichtet. In diesem Rechtsstreit versuchte AVM im Wesentlichen, Cybits zu verbieten, Freie Software unter der GNU GPL Lizenz auf AVM Fritz!Box-Geräten zu verändern. Gestern verwarf das Gericht diese Hauptforderung. Folglich bestätigte es auch, dass Benutzer von Embedded-Geräten mit vorinstallierter Freier Software rechtlich die Freiheit haben, Veränderungen an dieser Software durchzuführen, diese zu installieren, zu benutzen und auch weiterzugeben. Die Free Software Foundation Europe (FSFE) und gpl-violations.org begrüßen diese Entscheidung.
Die schriftliche Begründung des Urteils liegt noch nicht vor. Es ist aber bereits klar, dass das Gericht AVMs Ansprüche bezüglich der GNU GPL ablehnt. Dritten sollte es nicht gestattet sein, die Firmware von AVMs Produkten zu verändern, selbst wenn dabei GNU GPL-Komponenten betroffen sind. Dem Urteil zufolge dürfen Cybits und alle anderen solche Veränderungen vornehmen. Außerdem ist es aufgrund des Urteils Cybits nicht verboten, ihre Software zu verbreiten. Diese hilft den Benutzern, Modifikationen an der GNU GPL-lizenzierten Software (dem Linux-Kernel, der in den Fritz!Box-Geräten verwendet wird) vorzunehmen und sie zu installieren.
Ich bin hocherfreut, dass das Gericht jeglichen Anspruch AVMs, jede Veränderung an den GNU GPL-lizenzierten Komponenten der Fritz!Box-Firmware zu kontrollieren, zurückgewiesen hat. Jedermann zu erlauben und zu ermutigen, aufbauend auf bestehenden Programmen und Produkten innovativ zu sein ist ein Schlüsselaspekt der Freie-Software-Bewegung, sagt Harald Welte, Gründer von gpl-violations.org und in dem Verfahren Streithelfer auf Seiten von Cybits.
Andererseits hat das Gericht eine von AVM gestellte Zusatzforderung aufrechterhalten. In seiner Entscheidung untersagt es Cybits, ihre Software zu verbreiten, falls diese dazu führt, dass in der Web-Oberfläche ein falscher Zustand der Internetverbindung und der Filter-Software angezeigt wird. Dies ist jedoch ein Randproblem. Der wichtige Teil ist: Freie Software gibt jedem Menschen das Recht, sie zu verwenden, zu verstehen, zu verteilen und zu verbessern. Niemandem sollte erlaubt werden, andere daran zu hindern, diese Rechte auszuüben, sagt Matthias Kirschner, Deutschlandkoordinator der FSFE.
Die Entscheidung ist noch nicht rechtskräftig; die Parteien können gegen die Entscheidung Berufung einlegen.
Die FSFE und gpl-violations.org fördern die Verwendung Freier Software durch Unternehmen und Entwickler, indem sie Lizenzierung und Lizenz-Konformität so einfach wie möglich machen. Es ist für gewöhnlich wesentlich einfacher, Freie-Software-Lizenzen zu befolgen als EULAs und andere Lizenzabkommen unfreier Software. Oftmals ist es ausreichend, eine Kopie des Lizenztextes der GNU GPL zur Dokumentation hinzuzufügen und das Angebot zu unterbreiten, den Quelltext zur Verfügung zu stellen (siehe dazu die Tipps der FSFE zur Lizenzeinhaltung http://fsfe.org/projects/ftf/useful-tips-for-vendors.de.html).

The gpl-violations.org project is taking legal and other means to make sure commercial users of Free Software are adhering to the GNU General Public License. gpl-violations.org has enforced the GNU GPL in hundreds of cases, most of them amicably and out of court. However, if necessary, legal means such as warning notices, preliminary injunctions and civil copyright lawsuits are used in order to ensure companies are following-up with their obligations under the GNU GPL. gpl-violations.org was started by Free Software developer Harald Welte, who has received multiple awards in recognition of his legal efforts on enforcing the GNU GPL.
