Feliz año a todo el mundo. El último mes del 2007 fue bastante interesante, la noticia más importante fue la liberación por parte de Microsoft de la información sobre interoperabilidad en relación con el caso europeo sobre abuso de posición dominante. El proyecto SAMBA ha conseguido acceso total a las especificaciones necesarias para una comunicación alternativa y competitiva a los productos privativos de Microsoft. Desde luego, esto no quiere decir que se haya resuelto la conducta monopolista de Microsoft. Puede que se celebre un nuevo caso antimonopolio ante la denuncia presentada por Opera Software acusando a Microsoft de distorsionar intencionadamente el mercado de los navegadores de Internet. Es importante resaltar que esto no resuelve de ninguna manera el problema de las patentes de software. Dichas patentes aún están garantizadas por la Oficina Europea de Patentes (OEP) violando la ley actual, y la FSFE está alentando a la Comisión Europea a tomar medidas para abolir permanentemente las patentes de software, tanto en la teoría como en la práctica.
Otras noticias: Google se ha comprometido a apoyar a la Freedom Task Force de la FSFE para que ayude al público a comprender las licencias de Software Libre. Los actos del Software Libre en Escandinavia y los Balcanes nos muestran la continua expansión de la tecnología y valores del Software Libre por toda Europa; y la preocupación por el control y retención de la información se ha mostrado en Alemania. ¡Parece que vamos a tener un 2008 muy ocupado!. 1. MS versus la UE - Microsoft libera información sobre la interoperabilidad para SAMBA
En el 2004 la Comisión Europea encontró a Microsoft culpable de abuso de posición dominante en el mercado de las TI y le requirió que toda la información para la interoperabilidad estuviera disponible para la competencia. Microsoft recurrió esta decisión, siendo rechazado su recurso por el Tribunal Europeo de Primera Instancia en septiembre del 2007. Dicho Tribunal encontró a Microsoft culpable de obstrucción deliberada de la interoperabilidad y mantuvo la obligación de Microsoft de compartir información sobre sus protocolos.
El equipo de Samba ha decidido hacer uso de la obligación de Microsoft con la justicia europea. A través de la Fundación para la Libertad de los Protocolos (PFIF, por sus siglas en inglés) se solicitó la información sobre la interoperabilidad de redes, pagando la cuota única de 10.000 euros, para que el equipo SAMBA obtuviera el acceso completo a las especificaciones.
«Este caso finalizó y la interoperabilidad ganó. El Tribunal Europeo dejó claro que la información para la interoperabilidad no se puede mantener en secreto, y el acuerdo muestra que Microsoft no encontró un camino para continuar con la obstrucción de la interoperabilidad en este campo. Esto fija una norma que todo el mundo ha de encontrarse de aquí en adelante», resume Georg Greve, presidente de la FSFE.

2. La FSFE Apoya el nuevo caso antimonopolio
Opera Software ha presentando formalmente una demanda contra la conducta anticompetitiva de Microsoft en el sector de los navegadores. Y existe la posibilidad de un nuevo caso antimonopolio de la Comisión Europea. La FSFE ha enviado una carta a la comisaria europea para la competencia Neelie Kroes ofreciendo su ayuda para cualquier investigación que se lleve a cabo sobre las bases de la reclamación.
«Aunque Opera Software no produce Software Libre, compartimos ampliamente su juicio y preocupación en cuanto a la situación presente en el mercado de los navegadores de Internet», escribe Georg Greve presidente de la FSFE en la carta. Y continúa: «Algunos de los navegadores de mayor éxito en el campo aludido son Software Libre, o contienen gran parte de Software Libre. Esto incluye a Mozilla Firefox y Konqueror, un navegador hecho por KDE. Estos productos son muy innovadores y ampliamente conocidos como más seguros que la aplicación dominante. Implementan fielmente los estándares abiertos internacionales fundamentales y relevantes en la tecnología de los navegadores.».

3. Google Colabora con la FTF
La Freedom Task Force de la FSFE proporciona formación, formación en la licenciación de Software Libre y consultorías en Software Libre. Dirigimos una red europea de expertos legales y trabajamos con gpl-violations.org para solucionar cuestiones de licenciación. En resumen, la FTF ayuda a construir infraestructuras que fortalezcan la adopción y uso correcto del Software Libre.
Recientemente, Google contribuyó a la FTF para ayudar a dar cursos de formación, conferencias y traducir documentación a otros idiomas. Como todas las ONG, disponemos de unos recursos limitados y la ayuda de Google marca una diferencia significativa. 4. Historia del Software Libre en Berlín
El 13 de diciembre el grupo de la Fellowship de Berlín celebró una reunión. Entre las más de 20 personas de Berlín que participaron, había también visitantes de fuera: Georg Greve, presidente de la FSFE, y Bernard Reiter, coordinador para Alemania de la FSFE. Durante el té, el pan de jengibre y otros dulces, además de cerveza, se habló sobre el nacimiento de la FSFE, como llegaron los participantes al Software Libre, y otras agradables, divertidas e interesantes historias, que se adaptaban bien al clima prenavideño.

5. FScons
En diciembre, cerca de 200 participantes asistieron a la FSCONS (Conferencia de Software Libre en Escandinavia). Durante dos días los participantes pudieron atender a una variada muestra de presentaciones, que abarcaba desde las licencias de Software Libre hasta el Software Libre en dispositivos integrados. La FSCONS fue organizada por la FSFE, y será un acto anual para reunir gente de todos los países nórdicos.
6. Privatsphaere.org, encuentro sobre privacidad
«Los ciudadanos deberían de controlar a los gobiernos, en lugar de ser los gobiernos quienes controlan a los ciudadanos» fue la protesta espontánea de los asistentes a un acto llamado privatsphaere.org -una iniciativa conjunta de UUGRN.org, el «Laboratorio de sistemas distribuidos seguros de la Universidad de Mannheim» y la FSFE. Tras seis presentaciones abordando la directiva de retención de datos europea, la «búsqueda en línea» alemana y la tarjeta electrónica de sanidad desde diferentes perspectivas; cerca de 80 personas de audiencia estuvieron de acuerdo en que la construcción de «minas de datos» no prevendría el terrorismo en Europa, pero causaría problemas adicionales a la sociedad en conjunto. Un asistente preguntó «¿Dónde están los periodistas locales, abogados, asesores de impuestos y médicos? ¡Deberían de haber acudido a este acto!». Tres oradores recomendaron repetidamente el uso del Software Libre para asegurarse un mínimo de privacidad, y la FSFE señaló que la gente debería tener cuidado al considerar confiar información personal a archivos.
7. Sesión STACS en Belgrado
El 4 de diciembre la FSFE presentó una sesión del proyecto STACS en Belgrado. La sociedad civil representativa tanto del área local como de la Unión Europea participó en los talleres y discusiones, inspirando proyectos interesantes para su futuro desarrollo.

8. El Ministro Serbio para la Sociedad de la Información promete esfuerzos de adaptación.
De acuerdo con la página oficial del Ministerio Serbio de Telecomunicaciones y Sociedad de la Información, el ministerio invertirá en la adaptación de Software Libre en Serbia para proporcionar soluciones a los sectores público y privado. Las distribuciones GNU/Linux Fedora y Ubuntu serán adaptadas con GNOME, KDE, los productos Mozilla (Firefox y Thunderbid) y OpenOffice.org. El trabajo se hará en colaboración con las universidades serbias. Se están realizando los contactos previos con equipos de traducción y la comunidad del Software Libre.
