"Organización Mundial del Patrimonio Intelectual"
Apoyo a la Declaración de Génova
La Declaración de Génova [1] es un paso ingente hacia la creación de una ámplia coalición de personas, organizaciones y países [2] que piden que la comunidad internacional rediseñe los objetivos y los mecanismos para otorgar control monopolístico sobre los diferentes tipos de conocimiento.Ofrece muchas sugerencias concretas y constructivas acerca de cambios en los objetivos, políticas y prioridades de la WIPO, y aporta argumentos abundantes y certeros para rediseñar los tratos de copyright y patentes para que sirvan mejor al interés público de toda la humanidad.
Estamos convencidos de que las nuevas respuestas a veces requieren nuevas preguntas, y no una repetición más cuidadosa de las viejas preguntas. Una Organización Mundial de la Propiedad Intelectual (World Intelectual Property Organisation, o WIPO), comprensiblemente, siempre se inclinará a aplicar el juego de monopolización preconcebido al que se refiere como Propiedad Intelectual; un término que encontramos como cargado ideológicamente y peligrosamente ajeno a las diferencias significativas que existen entre las muchas áreas de la ley que pretende subsumir.
Aunque puede contemplar formas de concesión de monopolios, semejantes a la propiedad, mejores y posiblemente más sostenibles socialmente, WIPO no lo tendrá fácil a la hora de buscar soluciones alternativas. WIPO no es lo que necesitamos.
Necesitamos una Organización Mundial del Patriomonio Intelectual, dedicada a la investigación y promoción de formas nuevas e imaginativas de estimular la producción y diseminación del conocimiento. Otorgar monopolios limitados y control limitado sobre ciertos tipos de conocimiento puede ser parte de los instrumentos de estas nuevas organizaciones, pero no el único, y puede que incluso no el más importante.
Respaldamos y apoyamos la Declaración de Génova, e invitamos a sus autores, firmantes, y a las naciones unidas a comenzar a pensar ahora no sólo acerca de cual debería de ser el papel de la WIPO, sino qué tipo de organización necesitamos en su lugar.
