"Organizzazione Mondiale della Ricchezza Intellettuale"
Supportando la Dichiarazione di Ginevra
La Dichiarazione di Ginevra [1] è un significativo passo verso la creazione di una larga coalizione di persone, organizzazioni e Paesi [2] che chiedono che la comunità internazionale ripensi gli scopi ed i meccanismi per i quali viene offerto il controllo monopolistico su alcuni tipi di conoscenza. La dichiarazione offre molti soggerimenti costruttivi e concreti per il cambiamento di scopi, politiche e priorità della WIPO, e fornisce ampi e dettagliati argomenti per ridisegnare gli istituti del diritto d'autore e dei brevetti per un migliore servizio dell'interesse pubblico di tutta l'umanità.
Siamo convinti che nuove risposte talvolta richiedano domande nuove e non una ripetizione più attenta di quelle vecchie. Una Organizzazione Mondiale della Proprietà Intellettuale (World Intellectual Property Organisation o WIPO) sarà, comprensibilmente, sempre incline all'applicazione di quell'insieme preselezionato di strumenti di monopolizzazione a cui ci si riferisce con «Proprietà Intellettuale»; un termine che troviamo carico ideologicamente e pericolosamente ignaro delle significative differenze che esistono fra le molte aree della giurisprudenza che cerca di sottintendere.
Mentre potrà cercare nuove forme, possibilmente più sostenibili dal punto di vista sociale, per garantire monopoli simili alla proprietà sulle diverse forme di conoscenza, la WIPO non tenderà facilmente a cercare soluzioni alternative. La WIPO non è quello che ci serve.
Abbiamo bisogno di una World Intellectual Wealth Organisation (Organizzazione Mondiale della Ricchezza Intellettuale), dedicata alla ricerca e alla promozione di modalità nuove e creative per incoraggiare la produzione e la disseminazione della conoscenza. Una garanzia di monopoli limitati o di un controllo limitato su certi tipi di conoscenza potrà esser parte degli strumenti di questa nuova organizzazione, ma non il solo e neanche il più importante.
Promuoviamo e appoggiamo la Dichiarazione di Ginevra, ed invitiamo i suoi autori, i firmatari, e le Nazioni Unite a iniziare a pensare non solo riguardo al ruolo che potrebbe avere la WIPO, ma piuttosto al tipo di organizzazione di cui abbiamo bisogno al suo posto.
