All'attenzione del Direttore Generale dell'Organizzazione Mondiale della Sanità

I brevetti sul software garantiscono il monopolio sulla loro specifica idea. Il detentore di brevetto può concedere o negare l'autorizzazione all'uso di tale idea e unilateralmente definire i termini sotto cui tale autorizzazione è concessa o negata. Tutto ciò ancora prima che venga scritta una singola linea di codice: in effetti gli avvocati sono generalmente avvantaggiati rispetto alla maggioranza dei programmatori nell'ottenere un brevetto sul software. Ogni programma consiste di migliaia di idee, ognuna delle quali potenzialmente soggetta a rivendicazioni di brevetto. Nonostante la Convenzione Europea sui Brevetti escluda esplicitamente la possibilità di brevettare il software, di fatto fino ad ora sono già stati concessi 30000 brevetti software.
Il dibattito [1] in merito all'introduzione formale dei brevetti software è in corso da diversi anni e gradiremmo che lei fosse cosciente degli effetti dei brevetti software sulla medicina a distanza, un'area sulla quale molti ripongono grandi speranze.
Al giorno d'oggi, stiamo assistendo ai primi passi nel campo della telemedicina. Anziché essere consegnate attraverso la posta tradizionale, le radiografie vengono trasferite elettronicamente, riducendo i tempi di disponibilità da giorni a secondi. I medici saranno presto in grado di controllare singoli pazienti da remoto, cosa che in particolare permetterà di aumentare la copertura medica degli abitanti di aree remote in varie parti del mondo. Dato lo sviluppo demografico delle popolazioni del nord e il crescente bisogno di cure mediche per le persone anziane potenzialmente ricche, questa idea particolare era stata brevettata anni fa. [2]
Il database dell'Ufficio Europeo dei Brevetti contiene attualmente 69 brevetti che fanno riferimento diretto alla "telemedicina". Questo numero apparentemente basso non dovrebbe comunque farle dormire sonni tranquilli: è probabile che il numero dei brevetti salirà alle stelle dopo l'introduzione formale dei brevetti software.
Ogni applicazione nel campo della telemedicina dipenderà inoltre dai principi base del software per funzionare. Questi principi base includono sicurezza, networking e lo stoccaggio dei dati. La sicurezza in particolare è il punto chiave, dal momento che il numero di modi per rendere un sistema informatico sicuro è limitato. Non esistendo la possibilità di licenza obbligatoria per i brevetti software, è possibile che le battaglie legali finiscano col far scomparire molte applicazioni ancora prima che esse siano disponibili ai pazienti. Non solo: oltre a dover finanziare le spese legali, ogni applicazione di telemedicina e di chirurgia a distanza potrebbe presentare buchi di sicurezza noti e problemi di stabilità.
I brevetti sul software stanno anteponendo il bene della lobby dei brevetti al benessere dei cittadini dell'Europa e del mondo.
Per questo crediamo che i brevetti software influiranno negativamente sulla sua causa e le chiediamo di prendere una posizione chiara contro di essi.
