"Pensiamo che sia durata abbastanza" dice l'Avvocato Carlo Piana, che rappresenta la Free Software Foundation Europe (FSFE) davanti alla Corte Europea. "Aspettare che Microsoft proponga soluzioni per ristabilire la concorrenza sembra una totale perdita di tempo. Perciò abbiamo cominciato a lavorare sulle condizioni che realizzino ciò che la Commissione Europea ha cercato di ottenere con la sua decisione, sostenuta dalla Corte Europea."
"Il Team Samba ha oltre 12 anni di esperienza di lavoro sull'interoperabilità col software Microsoft. Abbiamo lavorato per molti anni nell'area del software per Workgroup server," spiega Jeremy Allison del Team Samba. "Sappiamo esattamente quali informazioni sono necessarie per ripristinare almeno la possibilità di una concorrenza. Così metteremo quell'esperienza a disposizione della Commissione Europea."
"Microsoft s'è comportata come certi bambini riottosi che si buttano per terra e devono essere trascinati per tutta la strada," afferma Georg Greve, presidente della FSFE. "Dal momento che Microsoft sembra non aver voglia di alzarsi e camminare, aiuteremo la Commissione a rimetterla in piedi e a farla procedere verso il ristabilimento della concorrenza. Se continuano a puntare i piedi, la Commissione dovrebbe mettere termine a quest'indegno spettacolo e multare una volta per tutte Microsoft di un 5% sul giro d'affari giornaliero netto del mercato di riferimento per ogni giorno in cui non saranno in regola."
Il caso antitrust nell'Unione Europea va avanti da anni. Per tutto il tempo, Microsoft ha tergiversato, cercando di bloccare e rallentare l'indagine della Commissione Europea e il ripristino della concorrenza a ogni occasione.
E addirittura, a fronte di una multa dalla Commissione che ha battuto tutti i record, Microsoft ha speso svariate volte quella cifra per sollecitare i sostenitori della Commissione Europea a non partecipare alla causa di appello presso la Corte Europea, promossa per evitare di dare ai concorrenti le informazioni necessarie per ottenere l'interoperabilità.
La Corte Europea non si è fatta ingannare da queste tattiche ed ha ordinato a Microsoft di adeguarsi immediatamente alle condizioni della Commissione Europea. In risposta a questo, Microsoft ha offerto un accordo di licenza progettato per creare ulteriori ostacoli alla concorrenza.
La Commissione Europea ha ora riconosciuto in modo ufficiale questo fatto, chiedendo ancora a Microsoft di consentire la concorrenza, dopo aver mostrato negli anni passati un'incredibile pazienza con Microsoft, un fatto del quale il gigante del software ha fin troppo abusato.
Adesso è tempo che la Commissione chieda attivamente a Microsoft di adottare soluzioni e condizioni che possano davvero ripristinare la concorrenza. La mancata adozione di tali soluzioni e ulteriori ritardi costituirebbero un danno per l'intera area economica europea.
La Commissione Europea dovrebbe fissare un termine definitivo perché Microsoft si adegui a quanto stabilito e alla decisione della Corte Europea. Se Microsoft continuerà a perdere tempo, la Commissione dovrebbe imporre la massima sanzione possibile di un 5% del giro d'affari netto sul mercato di riferimento per ogni giorno di ritardata applicazione.
"Microsoft abusa della pazienza dell'Europa da anni, ormai" conclude Georg Greve. "Dovrebbero mettersi in regola o compensare il danno che hanno causato. Dato il loro comportamento durante gli anni passati e i loro portafogli eccezionalmente gonfi, ai quali l'Europa ha contribuito non poco, il 5% sembra effettivamente adeguato."
