Golpe giuridico all'Ufficio Brevetti Europeo. EuroLinux chiede ai Governi Europei di sostituire la direzione dell'Ufficio Brevetti Europeo e di rafforzare il controllo democratico.

Senza aspettare che il voto del Parlamento Europeo su di una direttiva a proposita` della brevettabilita` del software, l'Ufficio Brevetti Europeo (EPO, European Patent Office) ha appena pubblicato una nuova direttiva per gli esaminatori che estende il campo di brevettabilita` in Europa al software, ai modelli economici e alla matematica [1,2].
Questa decisione costituisce una violazione della democrazia europea e una provocazione nei confronti dei governi che hanno pubblicamente affermato nel Novembre 2000 di vover un controllo politico piu` stretto sull'Ufficio Brevetti Europeo, governi che hanno anche deciso di mantenere la eccezione alla brevettabilita` per i programmi per elaboratore [3].
Questa decisione, vergognosa e inaccettabile, costituisce anche una violazione dell'articolo 22 della Concenzione Europea Sui Brevetti, articolo che prevede che solo il Collegio di Appello Allargato possa prendere decisioni su questioni importanti di politica brevettuale. Nonostante cio`, l'Ufficio Brevetti Europeo ha esteso il campo della pratica brevettuale europea con delibere interne del proprio comitato direttivo per non dover chiedere il parere dei governi europei. L'Ufficio Brevetti Europeo ha cercato di aggirare il controllo democratico dei governi europei attraverso audaci processi amministrativi. L'Ufficio Brevetti Europeo ignora le autorita` che lo dirigono [4]. L'Ufficio Brevetti Europeo disprezza l'80% delle aziende che producono software, aziende contrarie alla brevettabilita` del software [5.6].
EuroLinux chiede che i governi europei prendano una posizione.
Tutti i progetti per una direttiva sulla brevettabilita` del software, basate sull'opinione dei governi europei e redatte dal Direttorato Generale Per Il Mercato Interno, richiedono che l'Ufficio Brevetti Europeo agisca in modo controllabile e ragionevole. Invece controllo e buon senso non sembrano termini appropriati per il comportamento corrente dell'Ufficio Brevetti Europeo. Percio` EuroLinux chiede ai governi di:
* esprimere chiaramente la propria oppozione alla brevettabilita` del software e delle invenzioni intangibili.
* dimostrare all'pinione pubblica la propria capacita` di controllare l'Ufficio Brevetti Europeo sostituendo con urgenza la direzione attuale, responsabile di ripetute violazioni della Convezione Europea Sui Brevetti e della Conferenza Diplomatica.
EuroLinux chiede a tutte le aziende, a tutti gli utenti di software e a tutto i cittadini che desiderano proteggere l'innovazione nel software in Europa e la libera concorrenza nella societa` dell'informazione, di unirsi alle 90.000 persone e alle 300 aziende che appoggiano la nostra perizione per un'Europa libera dai brevetti [7].
