I will ask Erik (Josefsson) if he is interested in helping Johans as well. I am not sure about what the others (at ffii.se) will say to him about things that relate to Free Software. Thoughts on that?

Upphovsrätten och programvara. Programvara skyddas idag av Upphosrätten. Upphovsrätt får man direkt på det skrivna verket, utan kostnad och utan en dyr anökningsprocess. För små företag eller innebär detta att de utan extra personal kan skydda sin verk. Detta skydd finns idag. Bern-konventionen och TRIPS styr dett.
Det finns idag rörelser som vill slopa upphovsrätten helt. Free Software Foundation vill inte detta. Det vi vill är att kunder (tex myndigheter, skolor, Regering, Riksdag..) skall kräva full insyn i programmet och rättighet att kopiera, studera, modifiera samt vidaredistribuera ändringar i koden. I dag skriver och sparar de flesta svenska offentliga organ sin information, ibland hemlig sådan, ibland känslig, i mha program som vi inte har en aning om vad den gör. Vad vi vet är att vid en sökning på nätet skickas själva söksträngen till en av leverantörerna av en populär programvara.
Om vi istället had satsat på användning av Fri Programvara hade myndigheter kunnat: - Själva ändra programmet så att det pasasade dem. Detta skulla kunna göras mha tex lokala företag, i stället för utländskt.
- Sprida detta modifierade program till andra instanser för att andra kommer i åtnjutande av de investerade pengarna.
Ibland får vi hör att vi är anti-kommersiella. Så är det inte. Det är en alldeles för lätt retorik att vifta bort Fri Programvara med det argumentet. Vi vill och uppmuntrar därför folk och företag att sälja Fri Programvara. Det är dock framför altt tjänsterna kring Fri Progrmvara som vi tjänar pengar på. Vi ser inte inlåsning till en leverantör som en schysst affärsmetod utan vill istället låta företag och myndigheter själva kunna bestämma vilka de skall anlita vid inköp eller support. Detta stimulerar konkurensen och motverkar monopol.
Varför skall vi då införa sk mjukvarupatent?
Jag vet inte, men för att säkerställa ett monopol kan ju vara en av orsakerna. Jag tycker att det är intressant att tex Microsoft är så aktiva (tex hotar danska staten om att säga upp sina (Microsofts) anställda om inte mjukvarupatent röstades fram i EU). Microsoft tillverkar mig veterligen ingen hårdvara som tex ABS-bromsar eller diskmaskiner.
Det stora problemet är att avgöra vad som är kvalificerar en teknisk uppfining som skall utgöra grunden för patentansökan. Att via ett program låta något mekaniskt utföras. När du skriver att dokument och sparar detta till disk kommer en massa mekaniska saker att utföras, tex kommer en arm inuti hårddisken kommer att flyttas.
För mig som programmerare är det lätt att inse att patentsystemet inte fungerar. När man skriver ett program använder man mängder med ideer som andra redan använt. Ett program består till största delen av kod (implementationer av ideer) som redan använts flera gånger. Om dessa ideer (inte implemenationen, dvs koden) vore patenterad skulle vi få ett minfält att gå igenom när vi programmerar. Detta minfält är riktigt dyrt för storföretagen, men de kan lösa situationen genom att "byta användning av patent" med varandra. Småföretagen däremot har inga egna patent, då det är för dyrt att ansöka sådana. Vidare har småföretagen ingen ekonomisk möjlighet att anlita jursiter. De små kommer att gå under.
Varför skall programvara skyddas av båda Upphovsrätten och Patent. Upphovsrätten har fungerat bra som kydd. Patentsystemet i USA är en katastrof.

Jag tycker att man kan likna programmering ganska bra vid musikskapande.
Musiken som tex Mozart skrev är en implementation av ideer. Implementation är nedskriven på papper med hjälp av noter (abstrakt beskrivning av ett ton). För en programmerare är implementationen nedskriven till disk på en dator på ett språk.
Om vi tänker oss att Mozart inte fick skriva en opera om ett bröllop (Figaros bröllop) för att detta var patenterat hade förmodligen hans samtid tyckt att han var en knäppgök (de trodde nog det ändå, memn det är en anna historia) och snyltare som inte ville foga sig efter patenthållarens givna regler. Tycker vi idag att det vore ok om inte Mozart hade fått skriva Figaros Bröllop? Idag känns tanken absurd.
Tänk om Mozart hade kontrat med att ta patent på att skriva en dödsmässa. Då hade inte Brahms kunnat skriva sin faktastiska sådana.
Hade Mozart, som det geni han var, kunnat ta patent? Skulle han haft råd till det? Hade det ökat kreativiteten hos honom?
Tänk om Haydn hade tagit patent på ideen om Symfoni, då hade inte Beethoven kunnat skriva några alls. Och EU hade inte haft sin truddelutt.
Men skall vi då inte skydda Mozart, Beethoven, Brahms och Haydn? Skall vi inte skydda dagens programmerare och se till att vi får en fortsatt utveckling av program?
De gamla kompositörernas verk var skyddade av upphovsrätten på samma som program idag är skyddade av den samma. Upphovsrätten är gratis och behöver inte ansökas mha kunniga och ofta dyra jurister. Upphovsrätten bara finns där i samma stund som du skrivit ett verk.... givet att det har en viss höjd.
För övrigt tycker jag bäst om Haydn av de ovan nämda!
