Jag skulle väldigt gärna vilja prata med någon från FSF i Sverige om vad ni anser om patentbarheten av datorprogram, vilken effekt det har på enskilda programmerare och småföretag samt vad ni anser in EU-kommissionens förslag om ett direktiv om patent på datorrelaterade uppfinningar (KOM (2002) 92).

Jag skulle rekommendera att du också pratar med Erik Josefsson med flera från FFII som kan prata om patenterbarhet på programvara mer allmänt. Men jag kan berätta som hastigast hur vi ser på patenterbarhet från vårt perspektiv; fri programvara.
Att utveckla programvara, om man måste ta hänsyn till patent på programvara, kommer att bli lika riskfyllt som att ta sin söndagsutflykt över ett minfält i Kosovo. Det kan fungera, men när som helst riskerar man att trampa på en mina.
Nu exploderar kanske inte minorna i mjukvaror på samma sätt, och ibland kan man till och med komma undan med att ha trampat på en mina. Men det är svårare för fri programvara att komma undan med det eftersom vem som helst kan undersöka källkoden. Kanske är det därför företag som tillverkar icke-fri programvara inte tänker på det på samma sätt; de hoppas kunna undvika processer, inte genom att undvika att trampa på minorna, utan på att ingen ska upptäcka det.
Fri programvara utvecklas i stor grad av privatpersoner eller SMEs. För dessa är problemet ännu större eftersom mjukvarupatent leder till monopol på idéer, i största delen till gagn för de företag som redan har signifikanta patentportföljer. Genom korslicensering av patent kan dessa företag undvika att hamna i utdragna processer gentemot privatpersoner och SMEs, men privatpersoner och SMEs får inte samma möjlighet mot de större patentportföljerna.
Det här leder till en snedvriden konkurrens på marknaden där nystartade företag får väldigt svårt att hävda sig. Vad som inte är uppenbart, men som följer av detta, är att även de större företagen kommer få det svårt att överleva i konkurrens med andra företag utanför Europa. Vi behöver en konkurrens mellan företagen inom Europa för att behålla den innovativa miljö vi har idag.
