Al massimo si può applaudire il fatto che chiariscono che con "sorgente aperto" si intende FLOSS come lo intendiamo noi, anche senza una definizione. Ma il comunicato è del tutto fuorviante, perché l'obbligo di valutare il FLOSS c'è anche adesso.
Questa definizione non apporta alcuna miglioria e la legge continua a consentire l'utilizzo di software proprietario; l'obbligo di valutazione non implica la scelta di SL a parità di necessità, ne l'obbigo di adottare una exit strategy dal software proprietario.
Insomma questa, come praticamente tutte le leggi dette "sul Software Libero" (che nel 99% sono state fatte proprio da o con ASSOLI), è del tutto inutile alla causa e fine solo a far procurar lavoro a gli avvocati.
Mi chiedo cosa ci voglia a fare una legge chiara del tipo "La PA deve usare solo software libero, qual'ora ci fossero impedimenti tecnici, può avvalersi una deroga di 3 anni in cui deve produrre un'alternativa che dev'essere rilasciata come software libero; ai bandi di concorso pubblici sono ammessi tutti i produttori, che accettano di rilasciare come software libero il software che includono nel bando stesso[1]"

Vedo una discussione attiva sulle varie mailing list sul tema. Soprattutto una critica che è più una modifica di forma che di contenuto.
Lati positivi: - si discute di software libero nella PA
Lati critici: - sembra che ci sia una forte distinzione tra Software Libero e Open Source e questo crea confusione, potrebbe essere pericoloso il fatto che ci sia scritto "software libero o open source", che potrebbe essere interpretato come "software libero" ma anche non del tutto e solo qualche progetto che si dichiara "open"
Azioni che FSFE potrebbe pensare di fare: - comunicato stampa in cui applaude il fatto che il software libero abbia ricevuto ulteriore conferma di importanza per la PA - includere una definizione precisa di Software Libero - comunicare che questa azione è un ulteriore passo verso una definizione chiara del fatto, che la PA deve spendere i soldi pubblici creando valore accessibile a tutti.

Ciao Patrick, un programma "open source" tecnicamente non è "software libero" e la fis Il fatto che si possa avere accesso al codice sorgente non significa necessariamente che si possa modificarlo, ricompilarlo e ridistribuirlo. Se non è possibile adottare un software libero (scelta consigliata) almeno si adottino software open source (per vedere cosa fa esattamente il programma).

L'idea del comunicateo stampa mi piace, ci avevo pensato anch'io. Mi sono informato presso Matthias, possiamo anche fare un comunicato in inglese e distribuirlo in generale alla stampa europea. Cosa ne pensate?
Nel caso io me ne posso occupare domani mattina, ovviamente se qualcuno si occupa di redigere il comunicato stampa oggi pomeriggio domani posso inoltrarlo senza fare troppo tardi.

Mi piacerebbe vedere nel comunicato anche una parte dove dichiariamo di non accontentarci di questo piccolo passo.
Mi spiego; questa modifica è chiaramente priva di qualunque significato pratico e anche a livello politico non porta alcuna miglioria, mancando totalmente di definizioni (cosa intendono per "sorgente aperto"? cosa intendono per software libero?).
Inoltre la legge continua a richiedere alla PA la semplice considerazione del Software Libero, senza richiesta di preferirlo o, come piacerebbe fosse fatta una legge del genere a me, senza obbligare la PA ad adottare una strategia per l'uscita dal software proprietario.
Senza questi punti, la legge rimane sostanzialmente inutile, ma questa modifica ci permette di alzare il tiro e richiedere l'intenzione politica di un cambiamento (in nome della trasparenza, del risparmio, della redistribuzione del reddito sul territorio, ecc...)

ho dato una letta alla bozza e corretto un po' di inglese (non sono espertissimo – se qualcosa non vi torna guardate la revisione precedente). Sarebbe bene che qualcuno con un po' di esperienza di inglese "giornalistico" (io di per me sono piuttosto sul tecnico) ci dia un'ulteriore occhiata.
Riguardo il contenuto, ho due perplessità:
A un certo punto si dice:

Non so quale sia la posizione di FSFE in proposito, ma personalmente credo che i benefici pratici (e soprattutto l'essere svincolati da un particolare fornitore) siano di gran lunga più convincenti di quelli etici.
Altro paso:
*Considering the objectives and the requirements of* *the Public Administration, Free Software adoption should be required by law to* *any public service (including institutions charged of education, of the* *administration of justice, of public governance). *
Non sono sicuro che si debba *obbligare* la PA ad adottare FOSS – la mia posizione personale è che si dovrebbe:
- adottare ovunque possibile formati aperti per l'archiviazione e la pubblicazione di dati (ivi compresi i database) e documenti - adottare *sempre *per la pubblicazione di documenti formati ben supportati da software FOSS - preferire sempre il software FOSS a quello proprietario *a parità di funzionalità* (non credo ci siano ragioni per continuare ad usare msoffice invece che openoffice, ma per applicazioni più specifiche le alternative FOSS potrebbero non essere all'altezza o magari non esistere del tutto). - investire in progetti FOSS per colmare i buchi in quei settori ove si sia di fatto obbligati a usare software proprietario (sì – vabbe' – come se ci fossero i fondi per farlo...)
Bozza alternativa (da integrare nell'altra, se vi pare):

In questo caso a mio avviso i benefici pratici sfumano facilmente in quelli etici. Infatti se la p.a. non preferisce nessun particolare produttore significa che favorisce la concorrenza, ma anche che dà alle imprese che producono software libero la possibilità di essere considerate, il che significa anche giustizia sociale. Secondo me sarebbe necessario che l'idea di software libero venisse associata a qualcosa di non solo tecnicamente, ma anche eticamente preferibile, soprattutto quando si parla di istruzione.
Comunque, scanso equivoci, ho modificato la bozza e ho messo "for ethical and practical reasons"
Altro paso:

Sono d'accordo in linea di principio, poi bisogna vedere i criteri per valutare la funzionalità e soprattutto chi dovrebbe farlo. Probabilmente i casi in cui il software libero non risulta all'altezza di sostituire il software proprietario non superano il 10% dei programmi utilizzati dalla p.a. (soprattutto se la intendiamo in senso ampio includendo le scuole e le università - come secondo me si dovrebbe fare).
Evidentemente passare dal software proprietario al software libero comporta dei costi di transizione (anche se dopo 2 anni il costo medio annuo tende a scendere - ah! non ricordo più dove avevo letto questa statistica dei 2 anni, comunque da qualche studio), ho come l'impressione che l'esistenza di questi costi verrebbe utilizzata come pretesto per restare al software proprietario.
- investire in progetti FOSS per colmare i buchi in quei settori
ove si sia di fatto obbligati a usare software proprietario (sì – vabbe' – come se ci fossero i fondi per farlo...)
Beh nel lungo periodo ci sarebbe un risparmio netto, il problema è che forse manca la concezione di lungo periodo.

Non mi sono spiegato proprio bene.... con "convincenti" non invendevo "validi", ma proprio "capaci di convincere"... I benefici, che li si consideri "etici" o "pratici", naturalmente son sempre quelli che sappiamo, ma io volevo solo suggerire di comunicarli come dei benefici concreti piuttosto che delle questioni di principio, altrimenti IMHO si rischia che un lettore occasionale consideri FSFE come un gruppo di fanatici che combattono per la loro stramba idea di giustizia piuttosto che un gruppo di persone che vogliono dare suggerimenti concreti su come migliorare la PA (beh, non solo la PA).
Con questo non è che io conosca quale sia la linea "ufficiale" di FSF in proposito o che la voglia cambiare se non corrisponde al 100% a come la vedo io – voglio solo contribuire i miei 2 cent :)

Una veloce considerazione: non pensate che sottolineare una differenza tra "free software" e "open source" crei confusione e paura? Non sarebbe meglio formularlo positivamente, che viene sottolineata l'importanza della liberta' nella nostra societa' dell'informazione?
Non vorrei creare l'impressione che ci siano incromprensioni fra chi propaga il software libero, che a livello di licenze corrisponde a quelle Open Source, con chi propaga OS. Tutti vogliamo che la pa utilizzi free software.

Mi puoi spiegare bene cosa sono le differenze "tecniche"?

Rileggendo... ammetto che mi sono espresso male... ;-) La licenza, per esempio, potrebbe non permettere la ridistribuzione di un sorgente modificato ma consentire solo la distribuzione del sorgente originale con i "patch file" del caso. Inoltre la licenza potrebbe obbligare a cambiare nome nel software derivato. Un software è libero se rispetta le 4 libertà... quelli open source se corrispondono alla definizione stabilita da OSI... sono molto simili ma non uguali.

Ciao Patrick, rileggendo... ammetto che mi sono espresso male. ;-) La licenza, per esempio, potrebbe non permettere la ridistribuzione di un sorgente modificato ma consentire solo la distribuzione del sorgente originale con i "patch file" del caso. Inoltre la licenza potrebbe obbligare a cambiare nome nel software derivato.
