Unterstützen kann ich die These, dass eine Öffentliche Einrichtung keinen User-Support für eine selbstentwickelte Freie Software Lösung anbieten sollte, der über das eigene Handlungsfeld hinausgeht. Das betrifft natürlich nicht das behandeln von Fehlern in der Software durch einen sogenannten Bugtracker. Dieser sollte nicht für allgemeine Supportanfragen genutzt werden. Ein Freier Zugang zum Bugtracker würde insgesamt zur Transparenz und Nachvollziehbarkeit beitragen.
Interessant finde ich die Einschätzung, dass Copyleft nicht zutrifft, wenn eine Software nur 'intern'. genutzt würde:

Die Veröffentlichung von Freier Software bietet nach meiner Einschätzung neue Möglichkeiten für den Freien Markt, auf dieser Basis Dienstleistungen aufzubauen. Da die Software für jeden gleichberechtigt zugänglich ist, kann nicht von einer Marktverzerrung gesprochen werden.
Ich würde euch bitten, das Gutachten durchzulesen und weitere Argumente zu sammeln, so dass wir abschliessend eine Stellungnahme verfassen können.

Der Rechtsanwalt Michael Stehmann war so nett, den Sachverhalt zu erläutern:
... Niemand kann gezwungen werden, Änderungen, die er an der Software vornimmt, weiterzugeben, solange er nicht die geänderte Software verbreitet.
Denn sonst könnte er vom Recht zur Anpassung der Software an seine Bedürfnisse keinen uneingeschränkten Gebrauch machen (s.a. „Desert Island“-Test - http://de.wikipedia.org/wiki/Debian_Free_Software_Guidelines#Debian-Legal ).
Nur soweit er die geänderte Software verbreitet, was bei Freier Software sein gutes Recht ist, muss dies bei sogenannten Copyleft-Lizenzen unter den gleichen Bedingungen geschehen.
Wann liegt nun eine Verbreitung in diesem Sinne vor?
Beim Einsatz in einem Unternehmen noch nicht.
Erlaubt das Unternehmen seinen Mitarbeitern jedoch, die geänderte Software auch häuslich zu privaten Zwecken einzusetzen, erscheint mir die Grenze zum Verbreiten überschritten. Denn dann müssen die Mitarbeiter das Recht haben, die zu privaten Zwecken eingesetzte Software auch zu studieren (der Chef könnte ja einen Trojaner o.ä. eingebaut haben).

Wenn man eine externe Firma für die Programmierung einer Feien Softare Komponente beauftragt, gelten die definierten (oder gesetzlich geregelten) Gewährleistungsvereinbarungen. Programmiert man selbst (wie in diesem Fall) ist man natürlich selbst verantwortlich.
Nutzt man einfach nur ein fertiges Freie Software Projekt, hat man keine Gewährleistungsansprüche, ausser man verhandelt sie mit dem Ersteller der Software oder einem Dienstleister (wie Red Hat, SUSE, Canonical etc).

Kosten: Stimmt so. Jedoch sollte Vendor-Lock-In und Spionage sowie Verfügbarkeit wichtiger sein.
Gewährleistungsansprüchen: RedHat macht damit 1,33 Mrd. US-Dollar Umsatz und 150 Mio. US-Dollar Gewinn im Jahr[1]. Das Prinzip ist dasselbe wie bei proprietärer Software: A gibt B viel Geld damit B sagt, dass das Produkt funktioniert. Wenn das Produkt nicht funktioniert kann A sagen dass B Schuld ist und alles ist gut. Bei proprietärer Software hat man keine Change das Produkt weiter zu verwenden wenn der Hersteller nicht mehr will oder kann. Bei Freier Software ist dies (mit ev. viel Aufwand) immer möglich.
Freie Software versus kommerzieller Software: Proprietäre Software ist das Gegenteil Freier Software. Freie Software kann kommerziell sein (Beispiel RedHat) und proprietäre kann nicht kommerziell sein (Freeware).
Mangelnde Interoperabilität: Kein Negativpunkt Freier Software, im schlimmsten Fall ist Freie Software gleich schlimm wie proprietäre Software.

Habe grad noch von einem Kollegen erfahren, der bei einer renommierten Bank arbeitet, dass sie dort zwar Freie Software nutzen, sich selbst aber ausdrücklich nicht an Freien Software Projekten beteiligen dürfen.

Es ist ein Punkt der im Gutachten explizit als mehr oder weniger 'extremistische Sicht' abgestempelt wurde. Das heisst ihnen ist es grundsätzlich klar, und wir brauchen es nicht nochmal hier wiederholen. Im Gegenteil, es kann dazu führen, dass unsere Stellungnahme direkt wieder so abgestempelt und gar nicht weiter beachtet wird.

Wenn man Software als Produkt anschaut funktioniert der Markt sowieso nicht. Nach den einfachen Modellen bestimmt Angebot und Nachfrage den Preis. Da es es ich um ein immaterielles Gut ohne künstliche Begrenzung geht, ist das Angebot unendlich, die Nachfrage jedoch endlich. Ergo ist der zu erwartende Preis 0.
Sieht man Software jedoch als Service stelle ich die Argumentation in Frage. Denn gerade so bieten sich ja Geschäftsfelder für lokale Unternehmen; den angesprochenen Support, den die öffentlichen Einrichtung nicht übernehmen, ist nur ein Beispiel.

+1 Es ist gerade das Gegenteil. Freie Software macht es allen Marktteilnehmern möglich Erweiterungen zu implementieren. Bei proprietärer Software kann dies meist nur der Originalhersteller machen.

In diesem konkreten Fall kann wohl auch nicht von einer Verzerrung gesprochen werden, denn der Ausschlag die Software selbst herzustellen war ja, weil es kein genügendes Produkt gab. Daraus kann man wohl schliessen, dass es keinen Markt für solche Produkte gibt.
Auch ist es ja nicht im Sinne Unternehmen zu verdrängen. Es gab keine solche Software, weshalb eine geschrieben wurde. Dies ist eine Basis. So lange wie die Software eingesetzt wird muss sie gewartet und erweitert werden. Somit kann bei einer Veröffentlichung der Freie Markt spielen und verschiedene Unternehmen können die Erweiterungen Offerieren.
Leider kein Argument, aber ich fordere das jegliche vom Staat, sprich den Steuerzahlern bezahlte Software als Freie Software veröffentlicht wird.

Sie kommen zu dem Schluss, das die Freigabe von Eigenentwicklungen unter einer Freien Software Lizenz zu einer Marktverzerrung führen würde. Als direkte Konsequenz hat das Bundesgericht nun beschlossen, die Weiterentwicklung von OpenJustitia zunächst nicht mehr öffentlich zur Verfügung zu stellen:
da findet ihr sicherlich auch Freunde / Verbündete die eine gelungene Stellungnahme unterschreiben. Ich denke, ein guter Moment um ein breites Bündnis für Freie Software inklusive der Fellowshipgruppe Zürich zu schaffen.

Haben wir eigentlich Rückläufe zur WeAgree Kampagne erhalten? Falls nicht, dann wäre es eventuell jetzt von Vorteil, wenn wir die Mitglieder des Parldigi darauf hinweisen ;)
Bis jetzt habe ich faktisch kein Feedback erhalten. Konkret heisst das, 2 Absagen und eine nicht zustellbare Sendung. Nachträglich betrachtet und nach einer Email Konversation mit einem Politiker heben sich ein paar Punkte hervor:
- Die eidgenössischen Wahlen sind erst im Oktober 2015. Sprich wir sind noch zu früh, um Politiker im Wählerfang anzutreffen. Wir sollten zu den Wahlen nochmals versuchen und dann eventuell mit Texten, die für die Parteien abgestimmt sind (Zum Beispiel SVP: Freie Software, Unabhägigkeit à la EU von Microsoft, Apple, Google & Co) - Viele Milizpolitker (Ich verwende bewusst Miliz) haben einfach schlichtwegs nicht die Zeit, solchen Briefen nachzugehen. Erschwerend kommt hinzu, dass oft der Bezug im Sinne von Backgroundwissen fehlt und sie Angst haben, sich später ein Ei zu legen - Fehlende Streuung: Ein Brief kann während dem alltäglichen Arbeiten unter & vergessen gehen. Wir müssten auf breiterer Front auf die Kampagne aufmerksam machen -> Stichwort wäre da wie bereits erwähnt die digitale Nachhaltigkeit, welche sowohl wirtschaftlich als auch politisch recht stark verankert ist.
Inwiefern wir da aber sozusagen "bereits versuchte Arbeit erneut versuchen" weiss ich nicht - ein Versuch ist es auf jeden Fall wert (Am Besten besprechen wir das kommenden Donnerstag)
Zudem möchte ich noch folgenden, recht konkreten Punkt, anhängen, der mir in letzter Zeit sehr oft begegnet ist und die Antwort ist schwieriger als sie auf den ersten Blick erscheint:
- Wenn Person/Organisation/Firma gemäss unseren Aussagen auf Freie Software umsteigen sollen, landen sie schlussendlich bei Linux (Man kann darüber streiten, ob jetzt zum Beispiel ein quelloffenes ERP System unter Windows wirklich Sinn macht, wenn der Softwarestack darunter closed Source ist - aber wie bereits gesagt: Diskutabel). Mit Linux landen sie schlussendlich auch bei Libre Office/Open Office - und jetzt kommt die Frage, wie sie weiterhin mit dem Umfeld/Kunden kompatibel Dokumente austauschen können. Ich habe mich in den OOXML Standard eingearbeitet und ich kann sagen, dass die Libre/Open Office <-> OOXML Kompatibilität (schon designmässig) nicht funktionieren kann. In meinem Umfeld gab es IMMER Probleme. Wir sollten uns ernsthaft überlegen, wie wir einem solchen K.O. Kriterium begegnen (Sprich das man schlussendlich beim Alten bleibt, nur weil MS Office nicht mehr funktioniert). Eventuell hast Du Erik da Input, was Limux angeht ?
Ich werde versuchen, morgen mich durch das Ganze durchzuarbeiten und eine provisorische Stellungsnahme zu formulieren. Michel, hast Du da eventuell Input (Hab dich mal cc't) ?

Dafür sollte das OpenDocumentFormat genommen werden. Microsoft Word unterstützt es angeblich. OOXML ist ein typischer Microsoft-Versuch was eigenes/spezielles durchzudrücken. Da kennt sich sonst Reinhard gut aus.
Es gibt auch immer wieder Bestrebungen den OOXML Support in LibreOffice zu verbessern, aber das wird immer Probleme machen. Das Grundproblem ist das fehlende Wissen der Anwender. Wenn es unter LibreOffice nicht so ausschaut wie im Word sehen sie die Schuld bei LibreOffice. Leider ist es jedoch meist das Problem von Word.
Abhilfe schafft sicher auch schon, wenn soweit wie möglich PDF verschickt werden und wirklich nur Dokumente welche weiterbearbeitet werden müssen als ODF ;)

Die Zukunft geht nach meiner Einschätzung in Richtung Online-Office. Google Docs erlaubt zum Beispiel den Export in Freie Formate. Leider ist Google Docs selbst aber keine Freie Software. Das sind die neuen Realitäten, denen wir uns stellen müssen. Dem Kunden ist es in den meisten Fällen egal, ob die Webanwendung selbst Frei ist, solange er/sie die Daten in einem Freien Format abspeichern kann. Hier ein Bewusstsein zu schaffen, dass auch die Webanwendung Frei sein sollte, ist viel schwieriger.

Wegen Dokumentenaustausch:
Dafür sollte das OpenDocumentFormat genommen werden. Microsoft Word unterstützt es angeblich. OOXML ist ein typischer Microsoft-Versuch was eigenes/spezielles durchzudrücken. Da kennt sich sonst Reinhard gut aus.
Ich versende Dokumente generell in PDF Format. Müssen die Dokumente weiter verarbeitet werden, dann versende ich die Dokumente konsequent im ODF. Leider kam es mehrmals vor, dass einige Personen Probleme hatten, diese zu öffnen/bearbeiten oder einige Funktionalitäten nicht klappten (z.B. Korrekturen anzubringen).
Gerade das ist bei gemeinschaftlichen Arbeiten an Dokumenten ein muss (Annotation/Korrekturfunktion). Diese funktioniert besonders im Austausch odf/ooxml gar nicht.
Über die allgemeine Qualität von Office-Programmen (egal ob proprietär oder Frei), möchte ich mich nicht äussern.
Was verwendest du - Latex?
Latex ist eine gute Möglichkeit. Ich mag auch gerne Markdown und kann das dann mit Pandoc in andere Formate umwandeln.
Es gibt auch immer wieder Bestrebungen den OOXML Support in LibreOffice zu verbessern, aber das wird immer Probleme machen. Das Grundproblem ist das fehlende Wissen der Anwender. Wenn es unter LibreOffice nicht so ausschaut wie im Word sehen sie die Schuld bei LibreOffice. Leider ist es jedoch meist das Problem von Word.
Das ist auch so bei dieser Analyse des Bundes.
"Als nachteilig erweisen sich dagegen unter anderem das weitgehende Fehlen von Gewährleistungsansprüchen, der allenfalls ungenügende Support von Seiten der Entwickler oder die mangelnde Interoperabilität mit kommerzieller Software.84"
Bei der mangenlnden Interoperabilität müsste man sich fragen, wer Auslöser des Problems ist - proprietäre, häufig nicht standardisierte Software oder freie Software.
Abhilfe schafft sicher auch schon, wenn soweit wie möglich PDF verschickt werden und wirklich nur Dokumente welche weiterbearbeitet werden müssen als ODF ;)
Was ich auch mache Textdateien in Owncloud zu verwenden für gemeinsame Dokumente, sofern es nicht allzu komplizierter Formatierungen bedarf.
Die Zukunft geht nach meiner Einschätzung in Richtung Online-Office. Google Docs erlaubt zum Beispiel den Export in Freie Formate. Leider ist Google Docs selbst aber keine Freie Software. Das sind die neuen Realitäten, denen wir uns stellen müssen. Dem Kunden ist es in den meisten Fällen egal, ob die Webanwendung selbst Frei ist, solange er/sie die Daten in einem Freien Format abspeichern kann. Hier ein Bewusstsein zu schaffen, dass auch die Webanwendung Frei sein sollte, ist viel schwieriger.

Mein Imput die Parteien nach persönlichem Thematischen Fokus an zu sprechen wurde damals von Marcus abgelehnt. Ich fände es gut. Durch diese jetzige Aktion haben wir den Vorteil, dass wir bestimmt vor allen anderen Werbern die Politiker erreichen konnten. Wir sind sicher aufgefallen auch wenn es sie derzeit nicht interessiert. Versenden wir später einen weiteren Brief können wir vom Wiedererkennungswert Profitieren.
Das die Konvertierung vom einen ins andere nicht möglich ist kann ja nur bedeuten, dass beim Transfer Informationen verloren gehen oder Informationen fehlen. Müsste man daher in Open/Libre Office die Funktionen um Informationen ergänzt werden, damit das Programm beim Konvertieren fehlende Informationen ergänzen kann? Wenn man weiss wo das Problem liegt könnte man vielleicht via Feature Request solche Probleme beheben.
Ich könnte auch hoch angepasste Vorlagen für Dokumente unserer Firma weiter geben. Daran kann man gut sehen wo bei Dokumenten in der Oberen Etage der Fokus liegt und je nach dem kann man dann auch die Entwicklung von Open/LibreOffice auf wichtiges kanalisieren.
Man könnte auch die Inkomaptibilität als Vorteil "schlankes Design" verkaufen. Eigentlich müsste LI und LO nur fähig sein fehlende Informationen so zu kompensieren, dass es dennoch gut aussieht.

- Fehlende Streuung: Ein Brief kann während dem alltäglichen Arbeiten
unter & vergessen gehen. Wir müssten auf breiterer Front auf die Kampagne aufmerksam machen -> Stichwort wäre da wie bereits erwähnt die digitale Nachhaltigkeit, welche sowohl wirtschaftlich als auch politisch recht stark verankert ist.
Inwiefern wir da aber sozusagen "bereits versuchte Arbeit erneut versuchen" weiss ich nicht - ein Versuch ist es auf jeden Fall wert (Am Besten besprechen wir das kommenden Donnerstag)
Zudem möchte ich noch folgenden, recht konkreten Punkt, anhängen, der mir in letzter Zeit sehr oft begegnet ist und die Antwort ist schwieriger als sie auf den ersten Blick erscheint:
- Wenn Person/Organisation/Firma gemäss unseren Aussagen auf Freie
Software umsteigen sollen, landen sie schlussendlich bei Linux (Man kann darüber streiten, ob jetzt zum Beispiel ein quelloffenes ERP System unter Windows wirklich Sinn macht, wenn der Softwarestack darunter closed Source ist - aber wie bereits gesagt: Diskutabel). Mit Linux landen sie schlussendlich auch bei Libre Office/Open Office - und jetzt kommt die Frage, wie sie weiterhin mit dem Umfeld/Kunden kompatibel Dokumente austauschen können. Ich habe mich in den OOXML Standard eingearbeitet und ich kann sagen, dass die Libre/Open Office <-> OOXML Kompatibilität (schon designmässig) nicht funktionieren kann. In meinem Umfeld gab es IMMER Probleme. Wir sollten uns ernsthaft überlegen, wie wir einem solchen K.O. Kriterium begegnen (Sprich das man schlussendlich beim Alten bleibt, nur weil MS Office nicht mehr funktioniert). Eventuell hast Du Erik da Input, was Limux angeht ?
Ich werde versuchen, morgen mich durch das Ganze durchzuarbeiten und eine provisorische Stellungsnahme zu formulieren. Michel, hast Du da eventuell Input (Hab dich mal cc't) ?

Das Thema ist sehr vielschichtig und alt. Und dennoch gibt es bisher keine spürbare Verbesserung. LibreOffice ist selbst ein Softwaremoloch, der mit vielen eigenen Problemen zu kämpfen hat. Es gibt aber auch Bereiche in denen der Austausch ganz gut funktioniert, z.B. bei Impress/Powerpoint.
Aus meiner Sicht wäre es Zeit für ein komplett neues Office Produkt, das klaren Focus auf Web hat und mit den vielen Altlasten aufräumt.
Schau dir mal den Funktionsumfang von Google Docs an. Das kann fast gar nichts, reicht aber für einen grossen Teil der Anwender vollkommen aus.

Ich hab noch ganz am Anfang des Projektes mal den Vorschlag gebracht solche abgestimmten Texte zu schreiben. In der Diskussion am Stammtisch haben wir das dann fallen lassen.
Mein Vorschlag von damals (06.2014):
Beispiele: SP: ... Das kooperative Denken und Gemeinschaftliche Entwickeln freier Software fördert die Reduktion der Abhängigkeit und gängeleien grosser Konzerne. Freie Software stärkt zudem die Position des Konsumenten gegenüber eines potentiellen Dienstleisters da eine höhere Vielfalt hilf genau die Software zu erhalten die man braucht. Sauber definierte internationale Standards in der Entwicklung und bei der Interaktion mit der Software garantieren langfristige Kompatibilität und fördern die Qualität bei Entwicklung und Dienstleistung.
FDP: ... eine Vielfalt freier Software erlaubt dem einzelnen selbstverantwortlich die Software zu verwenden die man möchte ohne in eine Abhängigkeit gezwungen zu werden und bei Bedarf den Dienstleister frei zu wählen. Gemeinschaftliches Arbeiten und Kontrollmöglichkeit durch das Volk erlaubt eine höhere Softwarequalität. Freie Software kann zudem neue Märkte erschliessen, welche sich durch die geförderte Konkurenz in der Waage halten kann und dauerhafte Innovation fördert.
SVP: ... Freie Software hilf dabei sich vor allem in kritischen Bereichen von den ausländischen Grosskonzernen unabhängig zu machen. Grundsätzlich finde ich die Idee sehr gut.
Was den Erfolg der Kampagne betrifft, habe ich damit gerechnet, dass wenig Rücklauf kommt. Wichtig ist, dass wir den Politikern immer wieder mitteilen, wie wichtig Freie Software ist.
An den aktuellen Entwicklungen bezüglich OpenJustitia sehen wir wie viel Nachholbedarf dort existiert. Es wird versucht klassische Ökonomische Modelle auf Freie Software Entwicklungen zu adaptieren, was nicht besonders gut funktioniert. Urs hat dazu in einer der letzten Mails etwas sehr gutes geschrieben.

Müsste man daher in Open/Libre Office die Funktionen um Informationen ergänzt werden, damit das Programm beim Konvertieren fehlende Informationen ergänzen kann? Wenn man weiss wo das Problem liegt könnte man vielleicht via Feature Request solche Probleme beheben.
Ich könnte auch hoch angepasste Vorlagen für Dokumente unserer Firma weiter geben. Daran kann man gut sehen wo bei Dokumenten in der Oberen Etage der Fokus liegt und je nach dem kann man dann auch die Entwicklung von Open/LibreOffice auf wichtiges kanalisieren.
Man könnte auch die Inkomaptibilität als Vorteil "schlankes Design" verkaufen. Eigentlich müsste LI und LO nur fähig sein fehlende Informationen so zu kompensieren, dass es dennoch gut aussieht.
Das Thema ist sehr vielschichtig und alt. Und dennoch gibt es bisher keine spürbare Verbesserung. LibreOffice ist selbst ein Softwaremoloch, der mit vielen eigenen Problemen zu kämpfen hat. Es gibt aber auch Bereiche in denen der Austausch ganz gut funktioniert, z.B. bei Impress/Powerpoint.
Aus meiner Sicht wäre es Zeit für ein komplett neues Office Produkt, das klaren Focus auf Web hat und mit den vielen Altlasten aufräumt.
Schau dir mal den Funktionsumfang von Google Docs an. Das kann fast gar nichts, reicht aber für einen grossen Teil der Anwender vollkommen aus.

Bis jetzt habe ich faktisch kein Feedback erhalten. Konkret heisst das, 2 Absagen und eine nicht zustellbare Sendung. Nachträglich betrachtet und nach einer Email Konversation mit einem Politiker heben sich ein paar Punkte hervor:
- Die eidgenössischen Wahlen sind erst im Oktober 2015. Sprich wir
sind noch zu früh, um Politiker im Wählerfang anzutreffen. Wir sollten zu den Wahlen nochmals versuchen und dann eventuell mit Texten, die für die Parteien abgestimmt sind (Zum Beispiel SVP: Freie Software, Unabhägigkeit à la EU von Microsoft, Apple, Google & Co)
- Viele Milizpolitker (Ich verwende bewusst Miliz) haben einfach
schlichtwegs nicht die Zeit, solchen Briefen nachzugehen. Erschwerend kommt hinzu, dass oft der Bezug im Sinne von Backgroundwissen fehlt und sie Angst haben, sich später ein Ei zu legen
- Fehlende Streuung: Ein Brief kann während dem alltäglichen Arbeiten
unter & vergessen gehen. Wir müssten auf breiterer Front auf die Kampagne aufmerksam machen -> Stichwort wäre da wie bereits erwähnt die digitale Nachhaltigkeit, welche sowohl wirtschaftlich als auch politisch recht stark verankert ist.
Inwiefern wir da aber sozusagen "bereits versuchte Arbeit erneut versuchen" weiss ich nicht - ein Versuch ist es auf jeden Fall wert (Am Besten besprechen wir das kommenden Donnerstag)
Zudem möchte ich noch folgenden, recht konkreten Punkt, anhängen, der mir in letzter Zeit sehr oft begegnet ist und die Antwort ist schwieriger als sie auf den ersten Blick erscheint:
- Wenn Person/Organisation/Firma gemäss unseren Aussagen auf Freie
Software umsteigen sollen, landen sie schlussendlich bei Linux (Man kann darüber streiten, ob jetzt zum Beispiel ein quelloffenes ERP System unter Windows wirklich Sinn macht, wenn der Softwarestack darunter closed Source ist - aber wie bereits gesagt: Diskutabel). Mit Linux landen sie schlussendlich auch bei Libre Office/Open Office - und jetzt kommt die Frage, wie sie weiterhin mit dem Umfeld/Kunden kompatibel Dokumente austauschen können. Ich habe mich in den OOXML Standard eingearbeitet und ich kann sagen, dass die Libre/Open Office <-> OOXML Kompatibilität (schon designmässig) nicht funktionieren kann. In meinem Umfeld gab es IMMER Probleme. Wir sollten uns ernsthaft überlegen, wie wir einem solchen K.O. Kriterium begegnen (Sprich das man schlussendlich beim Alten bleibt, nur weil MS Office nicht mehr funktioniert). Eventuell hast Du Erik da Input, was Limux angeht ?
Ich werde versuchen, morgen mich durch das Ganze durchzuarbeiten und eine provisorische Stellungsnahme zu formulieren. Michel, hast Du da eventuell Input (Hab dich mal cc't) ?

Aber auch dort schreiben sie, dass es zum Teil einfach nicht geht. Trotzdem gibt es ein paar gute Iipps finde ich (jedoch habe ich die nicht ausprobiert bis jetzt).

Passt eigentlich Perfekt. Ich habs noch nicht gelesen, aber wenn da ein Beispiel am Staat enthalten ist könnte man das vielleicht mit einbeziehen. Wenn so ein Beispiel fehlt, noch besser möglicherweise könnte man eines anhand der Schweiz entwerfen.

Unterstützen kann ich die These, dass eine Öffentliche Einrichtung keinen User-Support für eine selbstentwickelte Freie Software Lösung anbieten sollte, der über das eigene Handlungsfeld hinausgeht. Das betrifft natürlich nicht das behandeln von Fehlern in der Software durch einen sogenannten Bugtracker. Dieser sollte nicht für allgemeine Supportanfragen genutzt werden. Ein Freier Zugang zum Bugtracker würde insgesamt zur Transparenz und Nachvollziehbarkeit beitragen.
Interessant finde ich die Einschätzung, dass Copyleft nicht zutrifft, wenn eine Software nur 'intern'. genutzt würde:

Der Gesamte Focus der Analyse liegt darauf, dass Software nicht 'Gratis' zur Verfügung gestellt werden dürfe, da dies zu einer Verzerrung des Marktes führen würde.
Die Veröffentlichung von Freier Software bietet nach meiner Einschätzung neue Möglichkeiten für den Freien Markt, auf dieser Basis Dienstleistungen aufzubauen. Da die Software für jeden gleichberechtigt zugänglich ist, kann nicht von einer Marktverzerrung gesprochen werden.
Ich würde euch bitten, das Gutachten durchzulesen und weitere Argumente zu sammeln, so dass wir abschliessend eine Stellungnahme verfassen können.
